Response
What are the names of any incumbent collection vendors?
Overton, Russell, Doerr, LLP

Meggesto, Crossett & Valerino Manfredi Law Group, PLLC

What were the fee rates of any incumbent or previous vendors?
This information cannot be disclosed. See FAR 3.104-4.

How much did your current or past vendor collect monthly (expressed as dollars recovered) and what was their liquidation rate?

This information is not readily available. Also, liquidation rates can vary greatly depending upon the quantity, quality, and nature of the debt referred from a Federal agency. For example, Education referrals were the primary source of collection cases in the past, now the majority of referrals are provided by USDA, HUD, SBA, any other Federal agencies.

On average, how many accounts (expressed as number and dollar amount) do you anticipate placing with a successful vendor monthly?

A successful vendor can expect to receive previously assigned cases that are still deemed collectible if case reassignments need to occur as a result of the procurement process. We cannot provide an estimate on the number of new referrals.

Does CLIN002AD include fee for referee to compute?
See response to Question No. 6.
Will the contractor be entitled to reimbursement for postage, postal, or courier charges?
The Contractor’s contingency fee and flat fee rates should cover these expenses. These costs would only be cost-reimbursable with explicit indication from the Court that the correspondence from Private Counsel (PC) on the matter must be done in such an explicit manner.
On page 3, section B.4 of the solicitation, it sets forth a list of costs and fees that are not authorized for direct reimbursement. The last sentence in the first paragraph sets forth that the flat fee and contingency fee should cover these expenses, one of which is travel. The first bullet point then references travel expenses being built into contractor’s contingency fees, but does not state flat fees. Under the current contract my office has been entitled to and received reimbursement for travel expenses related to flat fee matters. For example, and the most common occurrence, is that a mandatory foreclosure conference is scheduled. Many of those conferences are held at locations that are 4-6 hours round trip from my office. The practice and procedure that is used now is to obtain approval for the travel from the AUSA and the travel would then be billed at the attorney hourly rate and my office would receive reimbursement for that travel time. Please confirm that the contractor will be entitled to travel expenses for flat fee matters, such as described above, with regard to this solicitation, as it will make a significant impact on the amount to be set forth in the proposal for the flat fee work.
In reference to travel greater than 50 miles for foreclosure activities within a widely dispersed geographical district, it is the Department’s intention to reimburse Private Counsel (PC) for time traveling to and from the activity (i.e. foreclosure sale) from the PC’s place of business.
