Other Than Full and Open Competition

Sole Source

1. CONTRACTING ACTIVITY: Procurement & Contracting U.S. Department of Justice (USDOJ) Executive Office for Immigration Review 5107 Leesburg Pike Falls Church, VA 22041

2. DESCRIPTION OF ACTION: This justification for other than full and open competition will result in award of a firm fixed price delivery order for brand name GoTo Webinar and Open Voice Audio software, and components in support of the EOIR Public Affairs. EOIR Office of Information Technology (OIT), Office of the Chief Immigration Judge (OCIJ) and the Office of Legislative and Public Affairs (OLPA) must continue to utilize GoToWebinar Pro and Open Voice Integrated Audio to support on line web meetings with audio recording collaboration within EOIR components as well as external agencies to include the White House.

3. DESCRIPTION OF SUPPLIES: This requirement is for the renewal of GoTo Webinar and Open Voice Audio service with additional add in software. This procurement will be used to sustain the ability to provide on line web meetings with audio recording collaboration for EOIR’s OIT, OCIJ, and OLPA, internally and with its affiliates. The renewal services for GoToWebinar are as follows:

GoToWebinar Pro (500 attendees) Quantity: 5 Unit Price: 2,988.00 Total Price: $14,940.00

GoToWebinar Plus Quantity: 15 Unit Price: $492.00 (per month) Total Price: $7,380.00

Open Voice Integrated Toll Free Audio (45,000 monthly minutes) Quantity: 1 Unit Price: $15,120.00

Total Price: $15,120.00

USF Fee Quantity: 1 Unit Price: $2,706.48 Total Price: $2,706.48

Total Estimate Contract Price: $40,146.48

4. AUTHORITY CITED: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy this requirement.”

5. REASONS FOR AUTHORITY CITED: For this action, The Office of Information Technology, USDOJ Headquarters request a sole source justification for LogMeIn who is the only service provider for GoToWebinar Pro and Open Voice Integrated Audio.

GoToWebinar with Open Voice Integrated Audio is in use throughout EOIR and no other services will currently satisfy the ongoing need of EOIR’s requirement. Not only is GoToWebinar and Open Voice Integrated audio integrated into our infrastructure, but without the renewal of the specified software the mission critical offices mentioned in the paragraph 2 would not be able to continue to attend online meetings or connect to the audio conferences related to mission objectives or the organization. As a result of not renewing this service, EOIR’s mission of fairly, accurately, and expeditiously adjudication immigration cases would not be upheld.

6. EFFORTS TO OBTAIN COMPETITION: Market research was conducted on GSA, NASA SEWP, and the open market. Similar products are available; however, none researched have Open Voice audio integration which is a critical feature EOIR currently makes use of to meet its mission needs. The procurement of the renewal licenses will continue to support EOIR as well as provide a venue to provide an enterprise solution for all of EOIR. Procuring software support from another manufacturer would not provide the full capabilities of this product or the needs of the agency.

7. ACTIONS TO INCREASE COMPETITION: USDOJ OIT continually works to seek compatible equipment beyond the accepted standard. However, at this time, the stated product listed in Paragraph 3 is currently the brand name that meets the Government requirements and is critical to the current user base at EOIR.

8. MARKET RESEARCH: Market research was conducted and this product meets the current needs for EOIR’s offices. Because of the user support requirements at the offices mentioned above, it is critical to have the right software. Any procurement of incompatible software poses a risk to the existing infrastructure.

9. TECHNICAL CERTIFICATION: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.

Pricing has been established to be fair and reasonable at the time of award and is reflected in the Vendor’s GSA Schedule pricing. Cost and pricing data is not required in accordance with FAR 15.403-1(c).
