Response to Questions
15JA0522Q00000071
Grand Jury & Deposition Court Reporting Services, USAO-OHN
The following questions were received for RFQ 15JA0522Q00000071 —
Question 1. We would like to know if this is a brand new contract OR if there is (was) an incumbent performing these services. If not brand new, could you please provide the current / previous contract number?
Answer 1. This is not a new requirement. The incumbents are Fincun-Mancini Inc, IDIQ DJJ-16-D-EOA02-0144 and bridge contract 15JA0522P00000075 and the Cefaratti Group, IDIQ DJJ-16-D-EOA02-0062 and bridge contract 15JA0522P00000085.
Question 2. I would greatly appreciate getting a copy of the current contract(s), any information as to the activity during the last contract period.
Answer 2. I am not permitted to distribute awarded contracts. Please contact EOUSA FOIA for record requests at https://eousafoia.usdoj.gov/app/Home.aspx. I can provide the incumbents and the PIIDs. They are included above in Answer 1.
Question 3. On page 18 it states: "If the Contractor and the CO mutually agree to only using USAO provided space in lieu of the Contractor’s own space, then the physical security requirements of subparagraphs 3d, 3e, and 3f contained in this Annex do not apply."
Are you able to clarify this issue prior to the closing of bids? The answer to this question drives our pricing.
Answer 3. The U.S. Attorney’s Office (USAO) does not have enough space to store all of the grand jury material for the entire period of performance of this contract and previous ones. The USAO currently only has one safe designated for grand jury materials.
Question 4. Next question. according to FAR 52.219-14 "Limitations on Subcontracting", independent contractors are defined as subcontractors. For the purposes of contractual compliance, does the DOJ consider an independent contractor, a person, to be a similarly situated entity (i.e. a Small Business)?
Answer 4. Thank you for the question. From this I was able to see that the CO marks in 52.212-5 were erroneously omitted. It has been corrected in Amendment 0001.
For this contract, FAR 52.219-14 is not applicable because this requirement is not set aside for small business and it is not a solicitation or contract that is set aside or awarded on a sole-source basis in accordance with subparts 19.8, 19.13, 19.14, or 19.15, regardless of dollar value.
