. l LIMITED SOURCE JUSTIFICATION Revised 12/7/2017

1. Identification of the agency and the contracting activity, and specific identification of the document as a IILimited Source Justification."

Contracting Activity Processing the Requirement: DEA Headquarters, Office of Acquisition and Relocation Management, 8701 Morrissette Drive, Springfield, VA 22152. POC: Nancy Costello 202-353-1493

Name of Organization Originating the Requirement: DEA Special Testing ·and Research Laboratory, 22624 Dulles Summit Court, Dulles, VA 20166, POC: Thomas Duncan 703- 668-3326

Identification Number (purchase request/solicitation number): 15DDHQ18Q00000062

2. The nature and/or description of the action being approved.

This is a riew Purchase Order that wilrbe funded up to $312,500.

3. A description of the supplies or services required to meet the agency's needs and estimated value.

The contractor shall collaborate with the DEA Special Testing and Research Laboratory in the acquisition of hydrogen and oxygen isotope ratios as well as carbon and nitrogen if requested of fentanyl and 4-ANPP. Individual pricing for Carbon/Nitrogen (EA-I RMS), Hydrogen (Reduced Chromium TCEA-IRMS) and Oxygen (TCEA-IRMS) will be provided. The contractor must have the capability to make Hydrogen isotope ratio determinations individually using current reduced chromium TCEA-IRMS methodology. The contractor must have the capability to make Oxygen isotope ratio determinations individually using conventional TCEA-IRMS with appropriate bypass or venting to .eliminate potential nitrogen interferences; The contractor must have the capability to make dual Nitrogen and Carbon isotope ratio determinations using conventional EA-IRMS. The contractor must have or identify appropriate primary and secondary IRMS standard materials to be utilized as appropriate in the acquisition and normalization of measured isotope ratio values to the international scale. The contractor shall have proven experience and expertise in:

• Handling controlled substances.

• Obtaining and evaluating stable isotope data.

• Scientific publications relating to interpretation of isotopes for controlled

• substances.

The contractor shall complete the following tasks in support of the "IRMS Fentanyl Project":

• Obtain IRMS hydrogen and oxygen (carbon and nitrogen if requested) data on up to 1000 samples (approximately 100 samples/month) during the contract period.

• Ele'ctronically transmit all isotope results (raw and normalized) to the D.EA as analyses are completed using Excel-based spreadsheets.

• Identify, utilize in IRMS analyses, and share a useable (250 mg minimum) portion

· of each secondary reference material along with any QA/QC materials used in the analysis of all samples .

. • Reserve fentanyl sample and precursor materials provided to the contract laboratory will ,be returned to the DEA if requested.

LIMITED SOURCE JUSTIFICATION

Revised 12/7/2017

Total estimated value Inclusive of all options: $312,500.00

Period of performance or final delivery date: April 30, 2018 through December 31, ·201 a

4. Identification of the justification. rationale (see 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service.

Isotope Ratio Mass Spectrometry (IRMS) is a highly specialized ~echnique that requires unique laboratory instrumentation along with highly trained scientists to acquire and analyze stable isotope data. IRMS technology/expertise is not common to begin with and the requirement to analyze ·and store controlled substances (which is the focus ofthis work) further limits available sources. An initial Request for Information (RFI) was posted and the only qualified company to respond was lsoForensics. The Special Testing and Research Laboratory has had previous experience working with lsoForensics and has found that lsoForensics has the necessary equipment, expertise and required licenses to handle controlled substances.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).

I hereby determine that the anticipated cost to the Government for this Purchase Order will be the Best Value to the government; price will be determined fair and reasonable based on price analysis and. the independent government cost estimate. Certified cost or pricing data will not be required because of the prohibition at FAR 15.403-i(b)(l).

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

The DEA Special Testing and Research Laboratory has been utilizing IRMS technology and resulting data in support of their various Signature and Profiling Programs for more than a decade. As such, they have knowledge of other institutions and facilities with IRMS capabilities but none of them have the capability to both perform the needed analyses and have the appropriate facilities and/or licenses necessary to analyze controlled substances.

In addition, an Internet search of laboratories capable of IRMS analysis was performed and no facility was found to meet the minimum requirements. Finally, a Sources Sought Notice · and RFI was recently issued and the only vendor that responded was lsoForensics.

7. Any other facts supporting the justification.

Procurement History is as follows:

(1) Purchase order for similar services DJD-H -HQ-P-0434; period of performance 08/25/2011-03/25/2012.

(2) Sole Source to lsoForensics (Small Business).

(3) FAR 13, Only One Source is Reasonably Available.

LIMITED SOURCE JUSTIFICATION

Revised 12/7/2017

(4) lsoForensics was identified as the only vendor possessing DEA certification to receive and process samples. .

(5) Circumstances have not changed since the last procurement.

(6) There are no unusual patterr:,s revealed by the procurement history.

(7) .A Limited Sources Justification was prepared to support the last procurement several years ago for a similar requirement and there have been no significant changes since that time.

8. , A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

The agency will continue to post Sources Sought Notices as requirements are identified.
