About this file

This document is a Limited-Source Justification for a Federal Supply Schedule Contract issued by the Federal Bureau of Prisons (BOP) National Acquisitions Section. The contract is for an Automated Staffing Tool (AST) and Wellness Program Development with Deloitte Consulting LLP, to be issued as a firm-fixed-price task order with option years under GSA MAS contract 47QRAA18D001P. The primary objectives include continuing development of the AST, which calculates staffing requirements using mission-critical variables, implementing the tool across all disciplines, providing advanced analytics, offering leadership guidance on AST governance, and developing the Wellness Branch Program.

The justification emphasizes that Deloitte is the only viable contractor due to their existing investment in the project, proprietary research, field studies, and software development. The Bureau has already invested substantial funds in the system's development, and changing vendors would be cost and time prohibitive. Market research conducted on December 11, 2025, confirmed Deloitte's active GSA contract through November 20, 2037. The contract will be a continuation of the previous Task Order 15BNAS25F00000025, with the Contracting Officer anticipating fair and reasonable pricing based on GSA's existing price determinations.

ACQUISITIONS SECTION

LIMITED-SOURCE JUSTIFICATION

FEDERAL SUPPLY SCHEDULE CONTRACT

GSAR 538.7104-3(b)(ii): Identification of the agency and the contracting activity, and specific identification of the document as a “Limited-Source Justification”

Central Office:

Federal Bureau of Prisons National Acquisitions Section 320 First St. N.W., Room 200 Washington, DC 20534

Nature and/or description of the action, including a description of the supplies or services required to meet the agency’s needs and the estimated value.

This action will be a firm-fixed-price task order with option years for an AST and Wellness Program Development for the Bureau’s Human Resource Division. It will be issued pursuant to the terms and conditions of the GSA MAS 47QRAA18D001P as a continuation award/follow-on of Task Order 15BNAS25F00000025.

The BOP has a requirement to continue development of the Automated Staffing Tool (AST), which uses a bottoms-up approach, calculating staffing requirements based on mission critical variables. Work to date has included the design, development, and pilot of a tool that is currently focused on Correctional Officers. To achieve full implementation and adoption of the AST across all disciplines and occupations, the BOP requires a partner who understands its unique mission needs and evolving complexity, has successfully navigated the Agency’s data and IT ecosystem, and has established relationships with critical stakeholders.

Support services will consist of:

1. Continuation to fully develop the Agency Automated Staffing Tool (AST), to deliver a holistic, one-stop-shop for staffing, resource allocation, overtime, augmentation, and leave data, along with transitioning the ownership and maintenance of the AST.

2. Implementation of the AST.

3. Advance Analytics to build on the development and deployment phases by implementing requested user enhancements to mature the tool.

4. Will provide guidance and training to Agency leadership on AST Governance, Sustainment, and Automation for future resource allocation, and interpreting analytic results.

5. Continued development and implementation of the Wellness Branch Program.

The estimated cost for AST support services for a base period of 12 months, plus four 12-month option periods, is not expected to exceed

The authority and supporting rationale (see GSAR 538.7104-3(b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

This acquisition is conducted under the authority of the MAS program per 41 U.S.C. 152 (3), Competitive Procedures, and Title 40 U.S.C. 501, Services for Executive Agencies, and in accordance with FAR Subpart 8.4 – “Ordering under the Federal Supply Schedules,” and in accordance with GSAR 538.71, specifically; 538.7104-3(b)(ii) – “Sole Source Justifications.

The Bureau’s Human Resources department requires a staffing development tool to assist in their updated efforts to attract, develop, and retain staff. The Bureau has invested a substantial amount of funds in developing this system with the incumbent vendor, who has already conducted the field research for deployment of the AST, established a rollout plan, and began training for Phases 1 & 2.

The contractor is the only source capable of and positioned to continue and complete the requirements that are currently underway for the development of the AST. Changing to a different vendor would be cost and time prohibitive to the Agency.

The Contracting Officer (CO) has reviewed the GSA FSS pricing catalog and the recent prices of similar purchases, as well as the Independent Government Estimate. Based on the information gathered, the CO anticipates the price will be fair and reasonable. In addition, a task order will be made in accordance with the terms and conditions of the GSA FSS. The CO will seek further price reductions for the required services.

Market research was conducted by the Contracting Officer through the GSA eLibrary on December 11, 2025, which revealed that Deloitte Consulting, LLP has an active GSA MAS contract 47QRAA18D001P with an active option period through November 20, 2027, and ultimate contract completion date of November 20, 2037.

The incumbent vendor has stated they do not share their proprietary information with other vendors. Proprietary information in this instance shall be considered as prior research and development of unpublished data collected from the BOP field studies, software codes utilized in the buildout of the AST, and technical reports generated in the development of the Wellness Program. As such, the incumbent vendor is the only source capable and positioned to continue and complete the AST requirements.

A determination by the ordering activity contracting officer that the order represents a fair and reasonable price consistent with GSAR 538.7102-2(d)(2) and 538.7104-2(a)(3).

GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by GSAR 538.7102-2(d)(2).

Any other facts supporting the justification.

N/A

A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the brand name justification before any subsequent acquisition for the supplies or services is made.

Deloitte Consulting LLP is the only source capable of and positioned to continue and complete the requirements that are already significantly underway. The Bureau will continue to conduct market research and make efforts to obtain competition for future acquisitions, when applicable.

At the present time, no actions are available which could remove competition barriers for the required product.

The ordering activity contracting officer’s certification that the justification is accurate and complete the best of the contracting officer’s knowledge and belief.

I hereby certify this justification is made in good faith and the supporting data and information are accurate and complete to the best of knowledge and belief.
