National Acquisitions Section Federal Supply Schedule

Limited-Sources Justification

This procurement is being conducted in accordance with the ordering procedures of Federal Acquisition Regulation (FAR) Subpart 8.4 – Federal Supply Schedules. Under FAR 8.405-6 Limiting Sources, Contracting Officers (CO) are required to document the circumstances when soliciting limited-source justification. Therefore, in accordance with FAR 8.405-6(a)(1)(i)(A), “An urgent and compelling need exists, and following the procedures would result in unacceptable delays.” In accordance with FAR Subpart 8.405-6(c)(2) this justification includes the following information:

Identification of the agency and the contracting activity – U.S. Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section (NAS).

Nature and/or description of the action being approved – This action being approved is a limited-sources justificatio in accordance with FAR 8.405-6. The Bureau intends to a pursuant to the terms and conditions of the General Service Administration (GSA) Federal Supply Schedule (FSS) contract. The will allow the Bureau to continue receiving uninterrupted Foreign Language Translation and Interpretation services

A description of supplies and services required to meet the agency’s needs – (including the estimated value) –

The period of performance will be from July 1, 20 until 30, 2020. The estimated cost is not expected to exceed

The authority and supporting rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service – The primary statutory authorit for the MAS program are 41 U.S.C.

152 (3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies. In accordance with 8.405-6(a)(1)(i)( ), which states, “An urgent and compelling need exists, and following the procedures would result in unacceptable delays ” he rationale for using the urgent and compelling procedure is due to unforeseen circumstances causing an urgent need for mission critical services. The incumbent vendor is able to continue to perform the services without a gap or delay. Furthermore, this delay was not caused by circumstances that were reasonably foreseeable; this is necessary to ensure continuity of services.

The Bureau is in a transition phase from the incumbent vendor to the new vendor and interruption in service must be avoided. The new vendor is currently in the process of getting security background clearances for the linguists to perform under the BPA. The length of time to obtain clearances can take up to one year.

A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d) – In the interest of economy and efficiency, th will allow the Bureau to continue to receive vital services during the transition phase into a new 5-year BPA vehicle. Without the current service, the Government would undertake additional costs and undue delays in obtaining services from another viable source. An award document (SF1449) will be issue to

ALSI in accordance with the terms and conditions of their GSA FSS contract. As stated in FAR 8.404(d), the GSA CO has already determined the price quoted by ALSI from their FSS schedule fair and reasonable. Based upon market research results historical procurement data, the CO determined the price for the represents the best value for the Government . Th ALSI price schedule for recorded audio increased slightly an average of $0.48 for each language. Also, the price schedule for written translation increased slightly an average of $0.0148 .
