Dear Quoter:

Attached is a solicitation package prepared by the Federal Bureau of Prisons (BOP), Field Acquisition Office

(FAO), for the provision of Mortuary Services for the USMCFP Springfield, located in Springfield, MO. This package contains all necessary information to submit a quote.

Quoters should consider all information provided herein when submitting quotes. Please carefully follow all instructions located in the solicitation package concerning the content, format and submission of your quotes.

Failure to provide all required documentation detailed in Section L, Quote Submission Instructions, of the solicitation document may result in your quote being eliminated from consideration for award.

All potential quoters are advised that this solicitation includes the provision at FAR 52.204-7, System for Award

Management (SAM). This provision requires that all quoters doing business with the Federal Government to be registered in the SAM database for “All Awards”. Quoters should include their Unique Entity Identification (UEI) number with their quotes. The Contracting Officer will verify registration in the SAM database prior to award by entering the potential awardees UEI number into the SAM database. Failure to complete the registration procedures outlined in the clause may result in elimination from consideration for award. For the purposes of this solicitation, all quoter’s SAM registration should include NAICS code 812210 (Funeral Homes and Funeral Services).

Faxed and hand delivered quotes will not be accepted.

STATEMENT OF WORK - MORTUARY SERVICES - USMCFP SPRINGFIELD

SUBJECT

The Federal Bureau of Prisons (FBOP), Field Acquisition Office (FAO), located in Grand Prairie, Texas intends to make a single award for the provision of Mortuary Services to a responsible contractor, in accordance with the stated requirements. These services shall be performed for the for the male, Adult in Custody (herein after referred to as AIC) population at the United States Medical Center for Federal Prisoners (USMCFP) Springfield, located at 1900 West Sunshine Street, Springfield, MO 65807. General information regarding the Bureau of Prisons (BOP) and its facilities can be found at www.bop.gov.

SCOPE OF SERVICES

Upon notification by USMCFP Springfield of an AIC death, the Contractor shall provide, on a nondiscriminatory basis, mortuary services consistent with the requirements of this solicitation and the rules and procedures of the USMCFP.

This will include but is not limited to the removal of the body, local transportation, embalming and body preparation, clothing, casket, as well as professional mortuary services of federal AICs who have passed away during their time of incarceration. The Contractor must observe and comply with all local, state, and federal laws and regulations relating to transportation, embalming, preparation, burial, cremation, and shipment of bodies.

PERFORMANCE

The manner and the method of performing the tasks outlined in the statement of work are within the sole discretion of the Contractor who shall perform in accordance with professional standards according to local, state, and federal laws and regulations. The Bureau of Prisons has the sole discretion to determine the Contractor’s compliance with the contract.

DESCRIPTION OF WORK

Complete embalming services will be performed, including all standard practices to conform to applicable state laws.

There are, in general, two different types of cases. Each body shall be embalmed according to its condition and in the manner to ensure thorough preservation of all tissues. All body orifices shall be treated and closed in accordance with state laws. A post-embalming inspection of each body shall be made by the embalmer to determine whether the preservation is uniform and complete, or whether further treatment is required. If further treatment is required, it shall be given before final delivery of the body. The body must be in an acceptable state of preservation at the time of final delivery. After embalming and dressing, the Contractor shall transport the body to the air terminal of the indicated airline and airport, or local cemetery as directed by the Contracting Officer or his/her designee. The Contractor shall secure or furnish all necessary papers and permits for shipment or interment. Suitable space in the undertaking establishment shall be available for the performance of postmortem examinations when requested by the Government.

Normal Cases:

Appropriate when death has been due to disease or other causes, and where there has been little or no mutilation or breakdown of body tissue. For such cases, preservation shall be accomplished by a thorough cavity treatment. Standard preservation solutions shall be used for the arterial injections and cavity saturation.

Autopsied Cases:

This will be where a partial or complete autopsy has been made to an extent which will not permit a normal arterial embalming operation. Sectional embalming shall be used to thoroughly preserve the body, including organs, and the inside of the body cavity shall be treated with a hardening compound. The cranial cavity shall be filled with plaster of paris or other suitable material and the calvarium securely replaced. All incisions shall be tightly sutured and treated to prevent leakage. Autopsies must be performed by a licensed pathologist. A pathologist must have a current medical degree with a board certification in forensic pathology and maintain necessary certifications and/or licenses to perform autopsies in the State of Missouri.

Preparation of the Body:

The Contractor shall restore the body to be as lifelike in appearance as is possible in the individual case applying suitable cosmetics, performing derma surgery and other restorative work as may be necessary. The Contractor will furnish and dress the body in all necessary clothing, including cotton undershorts and undershirts, regular length socks and manufactured burial suit of dark conservative color. The body will be placed in the casket in such a manner as to create an appearance of rest and composure, and to ensure maintenance of position during shipment and local burial.

Review/Approval:

A Contracting Officer Representative (COR) will be appointed in this contract. The Contractor shall obtain approval from the Contracting Officer or designee prior to shipment of the remains to the final destination in all cases. Additionally, the contractor will take a close-up, color photograph of the upper half of the dressed, prepared, and casketed body to be provided, via e-mail, to the Contracting Officer and/or designee for review and approval BEFORE shipment to the final destination. Additional pictures shall be provided without delay upon request.

A standard casket, manufactured in accordance with industry standards or modern practices, shall be furnished as follows:

(A) Metal - State perfection cut, 20 gauge steel shell, light copper with no shading. Lacquer finish, interior plain panel, ivory twill, no shirring and cooper hardware.

(B) Sealed Casket (Alternative) - Metal, 20 gauge steel shell, constructed in accordance with industry standards of commercial practice so as to form a hermetic seal which will prevent leakage or escape of odors when properly closed and sealed. This item is to be furnished only when contractor seeks authorized by the Contracting Officer, as in cases of death by a communicable disease, to meet pertinent state and interstate regulations, or in cases of badly decomposed or odoriferous body, or

(C) When required and approved by the Contracting Officer, due to size of the deceased, an extra-large casket shall be furnished.

Outside Container:

Each casket shall be furnished with the types of outside container required by industry standards. The type of container may differ depending on the mode of transportation required.

(A) In cases of shipment by commercial air, shipping bags used by commercial airlines or an air shipment tray available for purchase and used by Funeral Directors shall be provided. The contractor will arrange and pay for all air freight to ship the body to the designated location and ensure compliance with all federal regulations governing the shipment of the remains for both domestic and international destinations. The Contractor will be entitled to reimbursement of required costs after approval. The cost will be a separate charge to the established prices in the schedule of items. A detailed itemized invoice and copy of the air freight bill must be provided by the Contractor for payment. If the location is such that transportation by air is beneficial to the government, these transportation services will be required.

(B) In cases of local burial, rules and regulations of the cemetery in which interment is made shall govern the type of container to be furnished.

Shipment of Body:

In the event of an AIC death the same regulations apply as those for transportation for the AIC release. Per the Program Statement for Release Gratuities, Transportation, and Clothing, the BOP pays for transportation to the AIC’s residence of record or place of trial. If the AIC’s family wants the body returned to an alternate location, the family is responsible for pickup of the body from that point or directly from the burial services contractor. The following methods are authorized for transportation:

1. Air/Train Transportation. If the location is such that transportation by air or train is beneficial to the Government, these transportation services can be acquired.

2. Ground Transportation. If the location is such that transportation by ambulance or hearse is beneficial to the Government, the burial contract mileage rate will be the rate in the burial services contract.

Cremation: Occasionally, the legal next of kin makes written request for cremation.

(A) If requested by the Government, or due to extended time between death and receipt of all necessary legal documentation, normal arterial embalming will be performed in accordance with all standard practices, conformance with applicable state laws and as outlines in PREPARATION OF BODY. Prior approval will be obtained from the Government before embalming.

(B) Contractor will be notified as soon as WRITTEN VERIFICATION has been received authorizing cremation.

(C) The Contractor will provide for crematory services that conform to standard practices and all applicable state laws and shall ensure the identity of the remains.

(D) A standard container shall be provided that is sealed and capable of transportation through U.S. Mail or another common carrier.

(E) Shipment of remains to the next of kin will be made by either the Contractor or the crematory, and will be sent first class, certified return receipt.

Body Viewing:

If the AIC died prior to the arrival of the next of kin, the relatives will be allowed to view the body. The Contractor will be required to allow up to fifteen (15) minutes for viewing of the body at no cost to the Government.

Local Burial:

In cases of local burial, rules and regulations of the cemetery in which interment is made, shall govern the type of container to be furnished. Unless otherwise specified, the casket shall meet the specifications of section (A) listed above.

In cases of local burial, cemeteries located within a 30-mile radius of the institution will be local for burial purposes unless specified by the Contractor. The Contracting Officer shall notify the Contractor in these cases. All necessary papers and permits for interment shall be secured or furnished by the Contractor.

Death Certificates:

The Contractor shall provide two (2) certified copies of the death certificate to the Contracting Officer and/or designee.

SCHEDULE

The Contractor shall perform services on an as needed basis to coincide with the death of an AIC. Exact days and time cannot be determined in advance due to the nature of the services required. However, the Contractor shall call for the body within four (4) hours of notification from the institution and transport it to the Contractor’s funeral parlor in a suitable close conveyance.

After normal working hours, and holidays, the designated institutional staff will provide the Contractor with the AIC’s name, social security number, and location of the body. Once the information is obtained, they will also be provided with the name and telephone number of the next of kin. The institution Chaplain staff will always be the first to notify the next of kin regarding the death of an AIC.

During normal working hours, the Nurse Supervisor or designee will notify the Contractor with the above information.

The Contractor shall not provide the news media with any information. The Contractor must notify the Executive Assistant of any outside requests for information.

PLACE OF PERFORMANCE

The place of performance will be provided by the Contractor.

PROGRAM MANAGEMENT

The service be provided in a manner considered appropriate in the local community. The Contracting Officers Representative (COR) will provide direction to the Contractor which clarifies the scope of work as well as inspection and acceptance of services.

The program shall be under the general guidance of the institutional Chaplain, Unit Management, and the Case Management Coordinator/(COR) shall be assigned to coordinate and monitor the program.

QUALIFICATIONS

The Contractor must be able to prove responsibility in the areas of credit, capacity to perform, tenacity, and integrity.

The Contractor must be properly licensed to perform these services in the State of Missouri. The Contractor must agree that the quality of all materials and services furnished will not be inferior to the specifications. All state and interstate shipment laws relating to the embalming, preparation, burial, cremation and shipment of the body must be fully observed and complied with, and in any case herein the state law contains requirements more rigid than the requirements set forth herein, such laws will override.

SUPPLIES

All supplies will be provided by the Contractor.

ADULT IN CUSTODY MANAGEMENT

There may be an occasion where the contractor will be required to acquire the body from the institution. The Contractor awarded this contract will not be subject to frequent contact with adults in custody. As a contractor, you are not subject to Government supervision, except for security related matters. However, contractor performance will be closely monitored while in the institution.

INSTITUTION SECURITY

The Contractor agrees to adhere to all regulations prescribed by the institution for the safety, custody, and conduct of adults in custody. The Contractor will attend an orientation program prior to assuming institutional involvement. As mentioned, occasions may arise that will require the contractor to enter the institution.

PRICING METHODOLOGY

The Contractor shall provide nonpersonal services, upon request by the institution as detailed in the Statement of Work.

The Government reserves the right to award without discussion, along with making single award and therefore; each initial offer should contain the offeror's best terms from a cost or price standpoint.

Services are required to be provided in accordance with the Statement of Work (SOW).

The contract rate for these services shall be on a per item basis. The contract rate shall include all charges for providing these services. The contract pricing shall include all charges to the Government for performing the services required by this solicitation/contract. (e.g., bonding, overhead, profit, supervision)

TAILORING: Contract Administration Data - Mortuary Services - USMCFP Springfield

Type of Contract: The Government contemplates a single award of an indefinite delivery/requirements type contract with firm-fixed unit prices resulting from this solicitation. It is anticipated that the contract resulting from this solicitation will be awarded in January 2026, with an anticipated Effective Date of Award (EDOA) of April 01, 2026. On or about the EDOA, USMCFP Springfield will issue a delivery/task order to the contractor. The contractor shall commence full performance services on the EDOA.

The quantity of services to be provided by the Contractor is estimated. These estimates are not a representation to a quoter or contractor that the estimated quantities will be required or ordered, or that conditions affecting requirements will remain stable or normal. Contract pricing shall include all charges to the Government for providing the services required by this solicitation."

Pursuant to FAR 17.203(c), the Government’s evaluation shall be inclusive of options. The Government will evaluate quotes for award purposes by adding the total price of all options to the total price of the base year requirement. Quoters may offer varying prices for options, depending on the quantities actually ordered and the dates when ordered.

Service Contracting Information: This service is a contactual arrangement and not a personal appointment. Payment is based on the provison of an end product or the accomplishment of a specific task. The service does not constitute an employer/employee relationship. The contractor will not be subject to Government supervision, except for security related matters. However, contractor performance shall be monitored. The contractor shall attend all training required by the Bureau of Prisons for contract workers. The contractor will not be permitted to attend istitution meetings, staff recalls or Government training sessions for institution staff.

Reviews: The Contracting Officer or designee is authorized to review by on-site survey, review of records, or by any other reasonable manner, the quality of supplies rendered under this contract. All records shall be subject to review by the Contracting Officer or other representative of the BOP. Payments will be denied when such service does not support the charges or if the service is deemed not necessary or appropriate. Such determinations may be made by the Contracting Officer or Contracting Officer Representative (COR), whichever is appropriate. All records shall be subject to review by the Contracting Officer or other delegated representatives of the

BOP.

Contracting Officer Responsibility: Authority to negotiate changes in the terms, conditions, or amounts cited in this contract is reserved to the Contracting Officer. This responsibility may be delegated to an Administrative Contracting Officer by the Contracting Officer.

Contract Administration Office (CAO): The Contracting Office at USMCFP Springfield is assigned to be the CAO for a resultant contract. This assignment carries with it the authority to perform all normal contract administration functions as listed in FAR 42.302(a), items 1 through 71; to the extent those functions apply to this contract. This assignment also includes delegation of authority to perform functions specified in FAR 42.302(b), items 1 through 11.

Authorized Ordering Official: Individual task orders may be issued only by the Contracting Officer, Administrative Contracting Officer, or an ordering official for USMCFP Springfield with an appropriate certificate of appointment. Each task order will identify the services schedule for that period. Orders can be issued orally, by facsimile, mail, or electronic commerce methods. Task orders will take the form of an SF-1449.

Delivery Tickets and Invoices: An itemized invoice shall be submitted on a per month basis and/or upon expiration the contract, whichever occurs first, for all services received during a billing period to include total dollar values and from which payment has not been received.

A proper invoice shall consist of:

The individual invoice will be paid once monthly. Requirements for Security Clearances: The Contractor will not be subject to Government supervision, except for security related matters and monitoring of contract performance. The following investigative procedures may be applied and appropriate forms completed before any Contractor employees are permitted inside an institution:

(1) National Crime Information Center (NCIC) check;

Quoters should also note that clause DOJ-03, Personnel Security Requirements for Contractor Employees (Nov 2021) requires that contractor personnel have a "favorable credit report". Quoters are strongly encouraged to pre-screen potential candidates for credit issues before submitting the candidate to USMCFP Springfield.

By submitting a quote for service, the contractor and its employees agree to complete the required documents and undergo the listed procedures. An individual who does not pass the security clearance will be unable to enter the Bureau facility. Any individual employed by the contractor who is deemed not suitable by the Bureau requirements will not be granted access to perform services under the contract. This is a condition of the contract. Finally, the contractor shall be in compliance with 8 CFR 274a regarding employment of aliens.

System of Records: (Privacy Act Notification) The contract will require contracted staff to operate a system of records and maintain documentation that will require adherence to the Privacy Act of 1974. The system of records will be maintained in accordance with community standards for adult health care. The contractor and/or staff are not authorized to disclose this or any information pertaining to an inmate to any non-Bureau source. Any request for such information shall be forwarded to the Contracting Officer or COR for proper disposition.

DOJ-05 Security of Department Information and Systems (OCT 2023)

I. Applicability to Contractors and Subcontractors Section 2839.102 of the Justice Acquisition Regulation (JAR), (48 C.F.R. § 2839.102), applies to this contract. Accordingly, all contractors are obligated to comply with all applicable DOJ security policies, directives, or guidance documents, including the security requirements in the provisions in this contract clause. This contract clause applies to all contractors and subcontractors, including cloud service providers (“CSPs”), and personnel of the contractors and subcontractors (hereinafter collectively, “Contractor”) that may access, collect, store, process, maintain, use, share, retrieve, disseminate, transmit, or dispose of DOJ Information. The security requirements set forth herein are in addition to those required by the Federal Acquisition Regulation (“FAR”), and any other applicable laws, mandates, contract clauses, DOJ policies, directives or guidance documents and Executive Orders pertaining to the development and operation of Information Systems and/or the protection of Government Information. This clause does not alter or diminish any existing rights, obligations, or liability under any other civil and/or criminal law, rule, regulation, or mandate.

II. General Definitions The following general definitions apply to this clause. Specific definitions also apply as set forth in other paragraphs.

A. Authorization to Operate (“ATO”), as defined in National Institute of Standards and Technology (“NIST”) Special Publication (“SP”) 800-37 Revision 2, is the official management decision given by a senior Federal official or officials to authorize operation of an information system and to explicitly accept the risk to agency operations (including mission, functions, image, or reputation), agency assets, individuals, other organizations, and the Nation based on the implementation of an agreed-upon set of security and privacy controls.

B. Cloud Computing, as defined in DOJ Order 0904 Cybersecurity Program, is a model for enabling ubiquitous, convenient, on-demand network access to a shared pool of configurable computing resources (e.g., networks, servers, storage, applications, and services) that can be rapidly provisioned and released with minimal management effort or service provider interaction. This cloud model is composed of five essential characteristics, three service models, and four deployment models in accordance with NIST SP 800-145.

C. Covered Contract is any contract, order or other agreement under which the contractor, or a subcontractor at any tier, including a cloud service provider, may access, collect, store, process, maintain, use, share, retrieve, 15BGCS26Q00000013 Page 17 of 43 disseminate, transmit, or dispose of DOJ Information (as defined below) in the course of providing a product or service to the Department, with the exception of acquisitions under the micro-purchase threshold.

D. Covered Information System means any information system used for, involved with, or allowing, the processing, storing, or transmitting of DOJ Information under a Covered Contract.

E. Data means recorded information, regardless of form or the media on which it may be recorded. The term includes technical data, computer software, and personally identifiable information (PII) (defined below). The term does not include information incidental to contract administration, such as financial, administrative, cost or pricing, or management information.

F. DOJ Information, as defined in DOJ Order 0904, means any Information that is owned, produced, controlled, protected by, or otherwise within the custody or responsibility of the DOJ, including, without limitation, information related to DOJ programs or personnel. It includes, without limitation, Information (1) provided by or generated for the DOJ, (2) managed or acquired by the Contractor for the DOJ in connection with the performance of the contract, and/or (3) acquired to perform the contract.

G. Information, as defined in DOJ Order 0904, is any communication or representation of knowledge such as facts, data, or opinions, in any form or medium, including textual, numerical, graphic, cartographic, narrative, or audiovisual. This includes any communication or representation of knowledge in an electronic format that allows it to be stored, retrieved, or transmitted.

H. Information System, means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502(8)).

I. Personally Identifiable Information (“PII”), as defined in the FAR 24.101, means information that can be used to distinguish or trace an individual's identity, either alone or when combined with other information that is linked or linkable to a specific individual. It includes but is not limited to common data elements such as names, addresses, dates of birth, and places of employment, to identity documents, Social Security numbers or other government-issued identifiers, precise location information, medical history, and biometric records.

This definition covers all PII that is created by or becomes available to the contractor, including its employees, subcontractors, or affiliates, as a result of performing under this contract. PII, as supplementally defined in DOJ Order 0904, also includes information about an individual maintained by an agency, including, but not limited to, information related to education, financial transactions, medical history, and criminal or employment history and information, which can be used to distinguish or trace an individual’s identity.

J. Private Cloud, as defined in NIST SP 800-145, is the deployment model for cloud infrastructure provisioned for exclusive use by a single organization comprising multiple consumers (e.g., business units). It may be owned, managed, and operated by the organization, a third party, or some combination of them, and it may exist on or off premises.

K. Security Breach means any security incident (as defined below) that directly relates to the loss of control, compromise, exfiltration, manipulation, unauthorized disclosure, unauthorized acquisition, unauthorized exposure or unauthorized access or any similar occurrence of any Covered Information System or any DOJ Information or any PII accessed by, retrievable from, processed by, stored on, or transmitted within, to or from any such system. This includes incidents where (1) a person other than an authorized user accesses or potentially accesses PII or DOJ Information or (2) an authorized user accesses or potentially accesses PII or DOJ Information for an unauthorized purpose.

a. Potential Security Breach (hereinafter, “Potential Breach”) means any suspected, but unconfirmed security breach (as defined above).

b. Confirmed Security Breach (hereinafter, “Confirmed Breach”) means any confirmed security breach (as defined above).

L. Security Incident means any occurrence that (1) may actually or imminently jeopardize, without lawful authority, the availability, integrity, authentication, confidentiality, or nonrepudiation of DOJ Information or a Covered Information System; or (2) may constitute a violation or imminent threat of violation of law, security policies, security procedures, or acceptable use policies.

a. Potential Security Incident means any suspected, but unconfirmed security incident (as defined above).

b. Confirmed Security Incident means any confirmed security incident (as defined above).

M. Vulnerability, as defined in DOJ Vulnerability Management Plan, and the OCIO Information Security Management Procedure, means a weakness or flaw discovered in the design of a system that, when exploited, may result in a loss of confidentially, integrity, or availability of DOJ Information or an Information System.

III. Confidentiality and Non-Disclosure of DOJ Information A. Preliminary and final contract deliverables and all associated working papers and material generated by the Contractor developed using DOJ Information, product, source code, and/or methods of operations, are the property of the U.S. Government and must be submitted to the Contracting Officer (“CO”) or the CO’s Representative (“COR”) at the conclusion of the contract. The U.S. Government has unlimited data rights to all such deliverables and associated working papers and materials in accordance with FAR 52.227-14 (Rights in Data-General). The Contractor will define a method of monitoring the development activity to include any activity associated with DOJ Information, product, source code, and methods of operations. The data rights and development details shall be defined within the Contract.

If the Contractor intends to utilize its existing data, for which it has a patent or copyright, to develop a contract deliverable, it is incumbent upon the Contractor to negotiate with the CO the proper FAR Part 27 clauses in the contract to protect its existing data.

B. Pursuant to FAR 52.227-14(d)(2), all documents and data produced in the performance of this contract containing DOJ Information, product code, source code, and/or methods of operations are the property of the U.S. Government and, without the prior written permission of the CO, the Contractor shall neither reproduce nor release such information to any third-party at any time, including during performance or following expiration and/ or termination of the contract.

C. Any DOJ Information made available to the Contractor under this contract shall be used only for the purpose of performance of this contract and shall not be divulged or made known in any manner to any persons except as may be necessary in the performance of this contract. In performance of this contract, the Contractor assumes responsibility for the protection of the confidentiality of all DOJ Information processed, stored, or transmitted by the Contractor. The Contractor shall comply with information security responsibilities and duties throughout the contract and after expiration/termination as appropriate per contract close-out activities. When requested by the CO (typically no more than annually), the Contractor shall provide a report to the CO identifying, to the best of the Contractor’s knowledge and belief, the type, amount, and level of sensitivity of the DOJ Information processed, stored, or transmitted under the Contract, including an estimate of the number of individuals for whom PII has been processed, stored or transmitted under the Contract and whether such information includes social security numbers (in whole or in part).

IV. Compliance with Information Technology Security Policies, Procedures and Requirements A.
