NON COMPETITIVE MEMORANDUM

FOR SIMPLIFIED ACQUISITION ACTIONS

IAW FAR 13.106-3(b)(2)

1. REQUIRING AGENCY: DOJ/Bureau of Prisons, Field Acquisition Office

2. NATURE/DESCRIPTION OF ACTION BEING APPROVED: Soliciting from a single source.

3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS: Catholic Priest Services for the Catholic community with the ability to work with federal offenders who are in the care and custody of the U.S. Attorney General. The work is to be performed in the Religious Services Area of the Federal Metropolitan Detention Center in Brooklyn, NY.

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION: 41 U.S.C. 253; 41 U.S.C. 1901(e)

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE

NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED:

The Brooklyn Diocese has religious jurisdiction to assign clergy in Brooklyn, New York, for ministry assignments and grants religious facilities to their Catholic Priests to perform Catholic services.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICABLE:

The service area for Catholic Priest is governed by the area Diocese. The Diocese of Brooklyn is assigned to service Brooklyn, New York.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE:

An estimated cost of services was provided by MDC Brooklyn. Estimated pricing was derived from previous prices paid for services at MDC Brooklyn. Prior to award of a contract, a determination will be made that quoted pricing for services will be fair and reasonable per FAR 13.106-3(a) (2).

8. A DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS:

A market survey was not considered appropriate because areas of the community where Priest may exercise their ministry are designated by the Catholic Diocese.

9. ANY OTHER FACT SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION:

None

10. A LIST OF SOURCES THAT EXPRESSED IN WRITING AN INTEREST IN THE ACQUISITION:

None

11. ACTIONS TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITIONS:

MDC Brooklyn will continue to monitor commercial market trends for Catholic Priest Services. Should further competitive opportunities become available in the future, MDC Brooklyn will take appropriate action to procure Catholic Priest Services in a manner that offers the best value to the Government.
