This cover letter precedes the solicitation package that has been prepared by the Federal Bureau of Prisons, Federal Acquisition Office, for the acquisition of Mortuary/Funeral Services. This package contains all necessary information for submitting a quote for evaluation for performing these services at USMCFP Springfield, MO.

Quoters should consider all information provided herein when submitting quotes. Please carefully follow all instructions located in the solicitation package concerning the content, format and submission of your quotes.

2.1 Schedule Continued

Pricing Methodology Quoters are required to submit, as part of their quote, a completed copy of Section 2, “Commodity or Services Schedule.” The quantity of services to be provided by the Contractor is estimated. These estimates are not a re presentation to a quoter or contractor that the estimated quantities will be required or ordered, or that conditions affecting requirements will remain stable or normal. Contract pricing shall include all charges to the Governm ent for providing the services required by this solicitation/contract.

Pursuant to FAR 17.203(b), the Government’s evaluation shall be inclusive of options. The Government will e valuate quotes for award purposes by adding the total price of all options to the total price of the base year requi rement. Pursuant to FAR 17.203(d), the quoters may offer varying prices for options, depending on the quant ities actually ordered and the dates when ordered.

This is an existing requirement. The current incumbent is Adam’s Funeral Home with the contract number as DJBP044400000066 in the amount of $516,600.00, which expires on September 30, 2020.

2.2 Statement of Work

The Federal Bureau of Prisons, Field Acquisition Office, Grand Prairie, Texas intends to make a single award for Mortuary Services for the male inmate population located at the United States Medical Center for Federal Prisoners (USMCFP) located in Springfield, Missouri.

SUBJECT

The Contractor shall provide, on a nondiscriminatory basis, mortuary services consistent with the requirements of this solicitation and the rules and procedures of the USMCFP. This will include, but is not limited to the removal of the body, local transportation, emb alming and body preparation, clothing, casket, as well as professional mortuary services of federal inmates who have passed away dur ing their time of incarceration. The Contractor must observe and comply with all local, state, and federal laws and regulations relating to the embalming, preparation, burial, cremation, and shipment of bodies.

PERFORMANCE

The USMCFP is located at 1900 West Sunshine Street, Springfield, MO 65807.

The manner and the method in performing the tasks outlined in the statement of work are within the sole discretion of the Contractor who shall perform in accordance with professional standards according to local, state, and federal laws and regulations. The Bureau of Prisons has the sole discretion to determine the Contractor’s compliance with the contract.

DESCRIPTION OF WORK

Complete embalming services will be performed including all standard practices to conform to applicable state laws. There are, in g eneral, two different types of cases. Each body shall be embalmed according to its condition and in the manner to ensure thorough p reservation of all tissues. All body orifices shall be treated and closed in accordance with state laws.

A post-embalming inspection of each body shall be made by the embalmer to determine whether the preservation is uniform and comp lete, or whether further treatment is required. If further treatment is required, it shall be given before final delivery of the body. The body must be in an acceptable state of preservation at the time of final delivery.

After embalming and dressing, the Contractor shall transport the body to the air terminal of the indicated airline and airport, or local cemetery as directed by the Contracting Officer or his designee.

The Contractor shall secure or furnish all necessary papers and permits for shipment or interment. Suitable space in the undertaking es tablishment shall be available for the performance of postmortem examinations when requested by the Government.

Appropriate when death has been due to disease or other causes, and where there has been little or no mutilation or breakdown of bod y tissue. For such cases, preservation shall be accomplished by a thorough cavity treatment. Standard preservation solutions shall be used for the arterial injections and cavity saturation.

Autopsied Cases:

This will be where a partial or complete autopsy has been made to an extent which will not permit a normal arterial embalming operat ion. Sectional embalming shall be used to thoroughly preserve the body, including organs, and the inside of the body cavity shall be tr eated with a hardening compound. The cranial cavity shall be filled with plaster of paris or other suitable material and the calvarium securely replaced. All incisions shall be tightly sutured and treated to prevent leakage.

Preparation of the Body:

The Contractor shall restore the body to be as lifelike in appearance as is possible in the individual case applying suitable cosmetics, performing derma surgery and other restorative work as may be necessary.

The Contractor will furnish and dress the body in all necessary clothing, including cotton undershorts and undershirts, regular length s ocks and manufactured burial suit of dark conservative color.

The body will be placed in the casket in such a manner as to create an appearance of rest and composure, and to assure maintenance of position during shipment and local burial.

Review/approval:

A Contracting Officer Representative (COR) will be appointed in this contract. The Contractor shall obtain approval from the Contrac ting Officer or designee prior to shipment of the remains to the final destination in all cases, except cremation. Additionally, the co ntractor will take a close-up, color photograph of the upper half of the dressed, prepared, and casketed body to be provided, via e-mail , to the Contracting Officer and/or designee for review and approval BEFORE shipment to the final destination. Additional pictures s hall be provided without delay upon request.

A standard casket, manufactured in accordance with industry standards or modern practices, shall be furnished as follows:

(A) Metal - State perfection cut, 20 gauge steel shell, light copper with no shading. Lacquer finish, interior plain panel, ivory twill, no shirring and cooper hardware.

(B) Sealed Casket (Alternative) - Metal, 20 gauge steel shell, constructed in accordance with industry standards of commercial practi ce so as to form a hermetic seal which will prevent leakage or escape of odors when properly closed and sealed. This item is to be furnished only when contractor seeks authorized by the Contracting Officer, as in cases of death by a communicable disease, to meet pertinent state and interstate regulations, or in cases of badly decomposed or odoriferous body, or

(C) When required and approved by the Contracting Officer, due to size of the deceased, an extra-large casket shall be furnished.

Outside Container:

Each casket shall be furnished with the types of outside container required by industry standards. The type of container may differ depending on the mode of transportation required.

(A) In cases of shipment by commercial air, shipping bags used by commercial airlines or an air shipment tray available for purchase and used by Funeral Directors shall be provided. The contractor will arrange and pay for all air freight to ship the body to the desig nated location and ensure compliance with all federal regulations governing the shipment of the remains for both domestic and intern ational destinations. The Contractor will be entitled to reimbursement of required costs after approval. The cost will be a separate c harge to the established prices in the schedule of items. A detailed itemized invoice and copy of the air freight bill must be provided by the Contractor for payment. If the location is such that transportation by air is beneficial to the government, these transportation se rvices will be required.

(B) In cases of local burial, rules and regulations of the cemetery in which interment is made shall govern the type of container to be furnished.

Shipment of Body:

In the event of an inmate death the same regulations apply as those for transportation for the inmate release. Per the Program State ment for Release

Gratuities, Transportation, and Clothing, the BOP pays for transportation to the inmate’s residence of record or place of trial. If the inmate’s family wants the body returned to an alternate location, the family is responsible for pickup of the body from that point or di rectly from the burial services contractor. The following methods are authorized for transportation:

1. Air/Train Transportation. If the location is such that transportation by air or train is beneficial to the Government, these tra nsportation services can be acquired.

2. Ground Transportation. If the location is such that transportation by ambulance or hearse is beneficial to the Government, t he burial contract mileage rate will be the rate in the burial services contract.

Cremation:

Occasionally, the legal next of kin makes written request for cremation.

(A)If requested by the Government, or due to extended time between death and receipt of all necessary legal documentation, normal ar terial embalming will be performed in accordance with all standard practices, conformance with applicable state laws and as outlines in PREPARATION OF BODY. Prior approval will be obtained from the Government before embalming.

(B)Contractor will be notified as soon as WRITTEN VERIFICATION has be received authorizing cremation.

(C)The Contractor will provide for crematory services that conform to standard practices and all applicable state laws, and shall ensure the identity of the remains.

(D)A standard container shall be provided that is sealed and capable of transportation through U.S. Mail or other common carrier.

(E)Shipment of remains to the next of kin will be made by either the Contractor or the crematory, and will be sent first class, certified return receipt.

Body Viewing:

If the inmate died prior to the arrival of the next of kin, the relatives will be allowed to view the body. The Contractor will be required to allow up to fifteen (15) minutes for viewing the body at no cost to the Government.

Local Burial:

In cases of local burial, rules and regulations of the cemetery in which interment is made shall govern the type of container to be furn ished. Unless otherwise specified, the casket shall meet the specifications of section (A) listed above.

In cases of local burial, cemeteries located within a 30-mile radius of the institution will be local for burial purposes unless specified b y the Contractor. The Contracting Officer shall notify the Contractor in these cases. All necessary papers and permits for interment s hall be secured or furnished by the Contractor.

Death Certificates:

The Contractor shall provide two (2) certified copies of the death certificate to the Contracting Officer or his designee.

SCHEDULE

The Contractor shall perform services on an as needed basis to coincide with the death of an inmate. Exact days and time cannot be determined in advance due to the nature of the services required. However, the Contractor shall call for the body within four (4) hour s of notification from the institution and transport it to the Contractor’s funeral parlor in a suitable close conveyance.

After normal working hours, and holidays, the designated institutional staff will provide the Contractor with the inmate’s name, social security number, and location of the body. Once the information is obtained, they will also be provided the name and telephone numb er of the next of kin. The institution Chaplain staff will always be the first to notify the next of kin regarding the death of an inmate.

During normal working hours, the Nurse Supervisor or designee will notify the Contractor with the above information.

The Contractor shall not provide the news media with any information. The Contractor must notify the Executive Assistant of any out side requests for information.

PROGRAM MANAGEMENT

The Contracting Officers Representative (COR) will provide direction to the Contractor which clarifies the scope of work as well as inspection and acceptance of services.

The program shall be under the general guidance of the institutional Chaplain, Unit Management, and the Case Management Coordina tor/COR shall be assigned to coordinate and monitor the program.

QUALIFICATIONS

The Contractor must be able to prove responsibility in the areas of credit, capacity to perform and integrity.

The Contractor must be properly licensed to perform these services in the State of Missouri. The Contractor must agree that the qua lity of all materials and services furnished will not be inferior to the specifications. All state and interstate shipment laws relating to the embalming, preparation, burial, cremation and shipment of the body must be fully observed and complied with, and in any case he rein the state law contains requirements more rigid than the requirements set forth herein, such laws will override.

SELECTION CRITERIA

The award will be made to the responsible quoter most advantageous to the Government meeting the set forth specifications based on past performance and price.

PRICING METHODOLOGY

The Contractor shall provide non-personal services, upon request by the institution as detailed in the Statement of Work. The Gover nment reserves the right to award without discussion, along with making single award and therefore; each initial offer should contain the quoter’s best terms from a cost or price standpoint.

Services are required to be provided in accordance with the Statement of Work (SOW).

The contract rate for these services shall be on a per item basis. The contract rate shall include all charges for providing these services . The contract pricing shall include all charges to the Government for performing the services required by this solicitation/contract. ( e.g., bonding, overhead, profit, supervision)

The quantity of services to be provided by the Contractor is estimated. These estimates are not a representation to an offeror or contr actor that the estimated quantities will be required or ordered, or that conditions effecting requirements will remain stable or normal.

The offerors are required to submit a completed copy of the Schedule of Items, inclusive of the base year and all option periods.

Pursuant to FAR 17.203(b), the Government's evaluation shall be inclusive of options. Pursuant to FAR 17.203(d), the offeror may off er varying prices for options, depending on the quantities actually ordered and the dates when ordered.

2.3 Special Contract Conditions

Type of Contract:

The Government contemplates a single award of an indefinite delivery/requirements type contract with firm-fi xed unit prices resulting from this solicitation. It is anticipated that the contract resulting from this solicitation w ill be awarded in August 2020 and with an anticipated effective date of award (EDOA) of October 1, 2020. On or about the EDOA, USMCFP Springfield will issue a task order to the contractor. The contractor shall comm ence full performance of services on the EDOA.

The resulting contract will include a base year period from October 1, 2020 through September 30, 2021 with four (4) possible 12-month option years for renewal at the unilateral discretion of the Government with a six (6 ) month optional period. Quoters are advised that the Government has the unilateral right to exercise option pe riods in accordance with FAR 52.217-9, "Option to Extend the Term of the Contract” and 52.217-8, "Option to Extend Services." Pursuant to FAR 17.203(b), the Government's evaluation shall be inclusive of options.

Performance:

The periods of performance of the resulting contract shall be as follows:

Base Year – October 1, 2020 through September 30, 2021 Option Year 1 – October 1, 2021 through September 30, 2022 Option Year 2 – October 1, 2022 through September 30, 2023 Option Year 3 – October 1, 2023 through September 30, 2024 Option Year 4 – October 1, 2024 through September 30, 2025 6 Month Option Period

Point of Acceptance:

The point of acceptance destination is USMCFP Springfield located at 1900 West Sunshine Street, Springfield, MO 65807.

Non-Personal Services Information (BPAP 37.103(g):

Award of this contract shall not be construed as a personnel appointment, but the result of a contractual arrang ement only. The services shall not constitute an employer/employee relationship. Payments to the Contractor shall be based on the provision of an end product or the accomplishment of a specific task. Results to be obta ined are within the Contractor's own unsupervised determination. The Contractor will not be subject to Gover nment supervision but its efforts will be monitored for quality assurance.

Contracting Officer’s Representative (COR):

The Contracting Officer will designate in writing a COR who shall be responsible for:

a) Monitoring technical progress, including surveillance and assessment of performance and issuing technical changes;

b) Interpreting the scope of work;

c) Technical evaluation as required;

d) Technical inspection and acceptance;

e) Assisting in the resolution of technical problems encountered by the service provider during contract perform ance;

f) Monitoring funds available for obligation;

g) Ensuring that task orders are issued in accordance with appropriate terms;

h) Ensuring that invoices and payments are processed in a timely manner;

i) Assisting in the resolution of administrative problems encountered by the service provider during the contract performance.

The Contracting Officer’s Representative (COR) will periodically evaluate the contractor’s performance of th e contract. In this evaluation, the performance of individual contractor will be evaluated by the COR and/or th e Unit Team. If the performance of an individual contractor is deemed unacceptable based on the COR and/or Unit Team, that contractor will no longer perform those Physician duties. In this event, the company will be re sponsible for replacing that contractor. All duties outlined in this Statement of Work shall be performed in ac cordance with standards and methods generally accepted within the Contractor’s own field of expertise.

Reviews:

The Contracting Officer or designee is authorized to review by on-site survey, review of records, or by any othe r reasonable manner, the quality of supplies rendered under this contract. All records shall be subject to review by the Contracting Officer or other representative of the BOP.

Payment Terms:

Payments will be denied when such service does not support the charges or if the service is deemed not neces sary or appropriate. Such determinations may be made by the Contracting Officer or COR, whichever is appropr iate. All records shall be subject to review by the Contracting Officer or other delegated representatives of the

BOP.

Contracting Officer Responsibility:

Authority to negotiate changes in the terms, conditions, or amounts cited in this resulting contract is reserved to the Contracting Officer. This responsibility may be delegated to an Administrative Contracting Officer by the Con tracting Officer.

Contract Administration Office (CAO):

The Contracting Office at USMCFP Springfield is assigned to be the CAO for a resultant contract. This assign ment carries with it the authority to perform all normal contract administration functions as listed in FAR 42.3 02(a), items 1 through 70; to the extent those functions apply to this contract. This assignment also includes delegation of authority to perform functions specified in FAR 42.302(b), items 1 through 11.

Task orders may be issued only by the Contracting Officer, Administrative Contracting Officer, or an ordering official for USMCFP Springfield with an appropriate certificate of appointment. Each task order will identify the supply schedule for that period. Orders can be issued orally or electronic commerce methods.
