About this file

This is a Justification for Other Than Full and Open Competition document submitted by the Federal Bureau of Prisons for a non-competitive contract award.

The Federal Bureau of Prisons at FCI Pekin, Illinois seeks to award a contract to Thermal Mechanical Services Inc. for Project 25Z4AA8 to replace failed coolers and freezers in the Food Service area without conducting full and open competition, citing unusual and compelling urgency under 41 U.S.C. 3304(a)(2) and FAR Part 6.103-2(b). The coolers and freezers have experienced catastrophic failure due to age and condition, making repairs impossible and resulting in loss of perishable food and the need to store food in unsuitable alternate locations. Thermal Mechanical Services Inc. will provide all materials, labor, and equipment as specified in the Statement of Work for contract number 15B41126C00000145 at a bid price of $282,604.00. The Contracting Officer determined this price to be fair and reasonable based on a revised Independent Government Estimate of $365,049.87 from FCI Pekin Facilities Department.

Prior solicitation efforts were made through Solicitation 15B41125B00000001, issued October 7, 2025, which resulted in two responsive offers significantly exceeding the original estimate of $117,695.28: Brown Point Facility Management at $487,323.00 and Accord Federal Services at $1,277,895.50. A Notice of No Award was posted January 29, 2026, followed by a pre-solicitation notice for the current action on June 24, 2026. Market research determined that due to the proprietary nature of the software and monitoring system updates required, Thermal Mechanical Services Inc. is the only responsible vendor capable of providing this service. No other vendors in the area expressed interest in the requirement. The Contracting Officer certification was signed August 20, 2026.

The coolers and freezers installed in FPC Food Service have experienced catastrophic failure. Due to the age and condition of the equipment, repairs are not possible. This has resulted in the loss of perishable food and the need to store food in alternate locations outside of FPC Food Service not intended for that purpose.

A pre-solicitation notice for 15B41126B0000001 was posted on 06/24/2026 before the decision was made to pursue an award without providing for full and open competition.

Contracting Officer Determination that the cost to the Government will be fair and reasonable:
