(VIII) FAR 52.212-1, Instructions to Offerors—Commercial Products and Commercial Services (DEVIATION DATE) applies to this acquisition. (see 12.205(a)).

(IX) FAR 52.212-2, Evaluation—Commercial Products and Commercial Services (DEVIATION

DATE)

https://www.acquisition.gov/far-overhaul/far-part-deviation-guide/far-overhaul-part-52#FAR_52_212_1 https://www.acquisition.gov/far-overhaul/far-part-deviation-guide/far-overhaul-part-52#FAR_52_212_2

a. The government anticipates making ONE award based on the presented evaluation criteria on an all or nothing basis for all line items. Quoters must submit quotes for ALL line items presented.

i. Awards will be made to the responsible Quoter(s) whose quote conforms to the requirements and is determined to provide the best value to the Government, considering the evaluation factors outlined below.

b. Evaluation criteria.

i. (1) Price

1. The government will evaluation the Quoter(s) proposed price to ensure it is fair and reasonable. Pricing information must also be clear and easily discernable for evaluation. In the event a quoted price does not match the total unit price, the proposed unit price will be used for evaluation. Quoted pricing must also specify the quantity or size of the product per pricing if there is a range available to quote from. Any discrepancies in package size to requested quantities and respective pricing must also be noted on quotes.

ii. (2) Past Performance.

1. The evaluation for past performance will primarily be based on a Go/No-Go basis. The assessment will be based on the following criteria.

a. Timeliness of deliveries: The Quoter must demonstrate a consistent record of on-time deliveries. Documented instances of late deliveries, including Contractor Performance Assessment Reporting System (CPARS) evaluations and communications with other Contracting Officers, will be reviewed. A history of substantial delivery delays will result in a "No-Go" determination.

b. Order accuracy and completeness: The Quoter must show a track record of delivering complete and accurate orders. Evidence of recurring issues such as missing or incorrect items—supported by customer complaints, returns, or input from other Contracting Officers—will be considered. A pattern of incomplete or inaccurate deliveries will result in a "No-Go" determination.

2. Only Quoters who receive a “Go” rating under this factor will be considered eligible for award.

iii. (3) Technical Excellence.

1. All proposed quotes must adhere to the proposed specifications listed on each line item. Any non-conforming products may not be acceptable or denied upon shipping.

2. All products quotes must meet product dating requirements. Please note that all freshness dates, use by dates, best by dates, freeze by dates, expiration dates, and similar must be dated past the entire subsistence period of July 1, 2026, to September 30, 2026. Therefore, all products must be dated for use on, or after October 1, 2026.

3. Quoters must be able to provide the product they are quoting. If a quoter is requested for information regarding product specifications, product dating, and shipping ability and cannot provide confirmations for any of these factors, they do not meet evaluation criteria for that product.

4. Quotes must also be utilized for a minimum of 30 calendar days after the closing date for the combined synopsis/solicitation.

5. All quotes must be sent by PDF format. No other file types will be accepted for submission.
