INFECTIOUS WASTE DISPOSAL SERVICES

FEDERAL MEDICAL CENTER (FMC) DEVENS

AYER, MASSACHUSETTS

The Federal Bureau of Prisons (FBOP) is conducting market research in compliance with the Federal Acquisition Regulation, Part 10. The service is for the provision of Infectious Waste Disposal services.

The services will be provided at the Federal Medical Center (hereinafter referred to as FMC) Devens located in Ayer, Massachusetts. The physical address is 42 Patton Road, Ayer, MA 01432. The contract year shall consist of one 12-month base year with four 12-month option years for renewal. The NAICS Code is 562211 (Hazardous Waste Treatment and Disposal) with the size standard of $47 million.

A draft copy of the Statement of Work is attached to this questionnaire. Additional details are forthcoming in the solicitation. A Government solicitation document to provide these services is being developed, and a contract may or may not result. Market research is being conducted to determine interest and capability of potential sources for this requirement. All information submitted in response to this announcement is voluntary the Government will not pay for information requested nor will it compensate any respondent for any cost incurred in developing information provided to the Government.

Disposal of Infectious Waste Services

STATEMENT OF WORK

1.1 Introduction:

The Federal Bureau of Prisons intends to make a single firm fixed price contract award to a responsible entity for the provision of infectious medical waste removal services. These services will include the collection, removal, and disposal of infectious medical waste from the Federal Medical Center Devens (FMC) located at 42 Patton Road, Ayer, Massachusetts, 01432. The services as outlined in the solicitation will be required to begin at the effective contract award date and continue through a base year and four (4) one year option period renewals.

FMC Devens is an administrative prison which is responsible for housing male offenders who require specialized, long-term medical or mental healthcare. The Bureau of Prisons is seeking a qualified contractor in order to properly remove infectious medical waste from FMC Devens.

The services to be performed must be in accordance with the Environmental Protection Agency, Federal, State, and local laws which govern the regulations pertaining to infectious medical waste removal.

1.2 Schedule:

The schedule of work will consist of performing a minimum of two (2) hauls every week. Hauls will be completed during the work week, which is determined to be Monday through Friday, between the hours of 8:00 a.m. to 4:00 p.m., excluding federal holidays. The performance times will be mutually agreed upon between the contractor and the Health Services Administrator.

Additional hauls may be required on an as needed basis. If required, the institution will provide the contractor 24 hour advance notice in order to arrange for an additional haul to be scheduled.

The estimated total number of hauls for each 12 month period is 104 (52 weeks x 2 hauls per week).

1.3 Supplies:

The contractor will be responsible for furnishing all labor, equipment, vehicles, containers, and materials unless otherwise specified herein; necessary for and incidental to the collection, removal, and disposal of infectious medical waste services as specified within the solicitation.

The contractor shall furnish all supplies for the safe disposal of infectious medical waste to include but not limited to receptacles, plastic bags, puncture resistant, and leak proof sharp containers. The manner and method of performance under the resulting contract are the sole responsibility of the contractor. However, the contractor shall perform the services in accordance with standard industry practices.

In addition, the drivers will provide the facility boxes and one (1) liner per box for their waste.

Sharps containers are not included with service. If needed, cases of red bags and sharps containers may be purchased through our Products Team. Sizes, availability and pricing of red bags and sharps containers will be provided upon request.

1.4 Scope of Services and Method of Performance:

The services will be provided in a method that is consistent with the community standard.

Although the contract will not be directly supervised, the performance will be monitored by the Health Services Administrator or his/her assigned designee. The performance of the contracted services will also be verified by the Contracting Officer's Representative (FAC-COR). The contractor shall be responsible for the collection, removal, and disposal of infectious medical waste. This service will also include providing FMC Devens with the necessary certified disposal documentation for each completed removal.

The contractor shall utilize a disposal facility for infectious medical waste removal that is in accordance with all Federal, State, City ordinances, laws, and regulations. The contractor will be responsible for adhering to all State and Federal requirements pertaining to the transportation, storage, and disposal of infectious medical waste material. This will include but not be limited to the infectious medical waste removal requirements identified within regulation 105 Code of Massachusetts Regulations (CMR) 480.001 to 480.700. Further, the contractor will be responsible for complying with the minimum requirements as defined within the following directive: 105 CMR 480.200, Disposal of Medical or Biological Waste. The contractor will assume full responsibility for compliance with all applicable Federal, State, Country, and City laws which govern the removal of infectious medical waste, hazardous, and non-hazardous pharmaceutical waste.

The contractor shall provide contact information (telephone number(s) and personnel) in which the FMC Devens staff may utilize for inquiries. The contractor shall provide FMC Devens with certified disposal documentation (signed manifest) for all hauls that are conducted. The documentation will be submitted to the facility, in a timely manner, after the infectious medical waste has been successfully destroyed. The waste will be destroyed by incineration or autoclave after it has been properly removed from the institution.

The contractor shall provide at minimum a pick-up that is conducted twice per week. The transportation of medical infectious waste will occur Monday through Friday, between the hours of 8:00 a.m. through 4:00 p.m., Eastern Standard Time, with the exception of Federal holidays.

This service will be performed at the following address: 42 Patton Road, Ayer Massachusetts, 01432.

1.5 Inmate Security:

The provision of services under this contract will ordinarily not require contact with the inmate population. However, if inmate contact does occur, the contractor will not be responsible for administrative management of inmates. The exception of ensuring the inmates involved in activities within the contractor's scope of work are abiding by all rules in effect to ensure their safety and wellbeing are sustained.

1.6 Institution Security

The contractor will agree to adhere to all regulations prescribed by the institution for the safety, custody, and conduct of inmates. Any employee or representative of the contractor who will render services at FMC Devens will be required to undergo security background clearances. All applicable employees will be required to obtain a security clearance prior to entering the institution. The contractor must follow all security procedures as mandated by FMC Devens and the Federal Bureau of Prisons' institutional security policies.

Section 2.3 – Special Contract Conditions Type of Contract: This contract is an indefinite delivery/requirements type contract with firm-fixed unit prices. The contract includes a base year period with four (4) possible 12-month option years for renewal at the unilateral discretion of the Government. Quoters are advised that the Government has the unilateral right to exercise option periods in accordance with FAR 43.103(b) and 52.217-9, "Option to Extend the Term of the Contract.”

Performance Periods:

Base Year: October 1, 2026 to September 30, 2027;

Option Year 1: October 1, 2027 to September 30, 2028;

Option Year 2: October 1, 2028 to September 30, 2029;

Option Year 3: October 1, 2028 to September 30, 2030;

Option Year 4: October 1, 2029 to September 30, 2031

Point of Acceptance: The point of acceptance for services is FMC Devens.

Non-Personal Services Information: This service is a contractual arrangement and not a personnel appointment. Payment is based on the provision of an end product or the accomplishment of a specific task. The service does not constitute an employer/employee relationship. The contractor will not be subject to Government supervision, except for security related matters. However, contractor performance shall be monitored.

Reviews: The Contracting Officer or designee is authorized to review by on-site survey, review of records, or by any other reasonable manner, the quality of supplies rendered under this contract. All records shall be subject to review by the Contracting Officer or other representative of the BOP. Payments will be denied when such service does not support the charges or if the service is deemed not necessary or appropriate. Such determinations may be made by the Contracting Officer or COR, whichever is appropriate. All records shall be subject to review by the Contracting Officer or other delegated representatives of the BOP.

Contracting Officer Responsibility: Authority to negotiate changes in the terms, conditions, or amounts cited in this contract is reserved to the Contracting Officer. This responsibility may be delegated to an Administrative Contracting Officer by the Contracting Officer.

Contract Security/Investigative Requirements: The Contractor will not be subject to Government supervision, except for security related matters and monitoring of contract performance.

The following investigative procedures may be applied and appropriate forms completed before any Contractor employees are permitted inside an institution:

(1) National Crime Information Center (NCIC) check;

(2) Declaration of Federal Employment (OF-306);

(3) FD-258 (fingerprint check);

(4) Law Enforcement Agency checks;

(5) Vouchering of Employers;

(6) Employment Resume;

(7) Completed Contractor Pre-employment Questionnaire;

(8) Release of Information;

(9) Questionnaire for Sensitive Positions (SF-85 for Low Risk, SF-85P for above low risk);

(10) Credit Check, if applicable;

(11) Urinalysis, if applicable.

Department of Labor Wage Determination: The applicable DOL Wage Determination for this procurement has been determined to be Wage Determination No. 2015-4035. The current revision of the determination is attached for informational purposes.
