JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) Part 6.3, Other Than Full and Open Competition, and the Bureau of Prisons Acquisition Policy 6.304(b), FCC Allenwood is requesting approval of the following sole source acquisition:

Agency and Contracting Activity:

Department of Justice Federal Bureau of Prisons Federal Correctional Complex (FCC) Allenwood, Pennsylvania

Nature and/or Description of Action:

Inmate related high trauma and specialty medical services not available through FCC Allenwood’s Comprehensive Medical Contract, DJBP020100000027, through Seven Corners.

Description of Services and Estimated Value:

To provide high trauma and specialty care requirements referred to Geisinger Medical Center, Danville, PA via local area 911 services or by a contracted network hospital or provider.

Estimated value: $98,000.00 Statutory Authority Permitting Other Than Full and Open Competition:

Statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(2). The exception which permits use of the cited statutory authority is stated at FAR 6.302-2, “Unusual and compelling urgency.”

Demonstration of Statutory Validity:

The vendor, Geisinger Medical Center, is the local provider for high trauma and specialty services.

Efforts Made to Solicit From As Many Potential Sources As Is Practicable:

FCC Allenwood and Seven Corners have attempted to contract with the Geisinger Medical Center but have been unsuccessful despite frequent attempts. Geisinger Medical Center is not willing to enter into a stand-alone or third party contracting agreement. The Government is left with no recourse other than to procure open market medical requirements through the Geisinger Medical Center when required.

Contracting Officer’s Determination That the Costs to the Government Will Be Fair and Reasonable:

At this time, the Contracting Officer anticipates the cost to the Government will be fair and reasonable, based on prices paid for services in previous years. This provider has been determined to be responsible in accordance with FAR 9.104-1.

Description of the Market Survey:

Geisinger Medical Center, Danville, PA has been determined to be the only high trauma and specialty service provider within a reasonable distance able to provide these particular requirements. Inmate ambulance referral for high trauma is at the discretion of local 911 services. Certain specialty services are referred to Geisinger Medical Center by contracted hospitals and providers within the Seven Corner’s network.
