About this file
This document is a Questions and Responses (Q&R) template related to a federal Request for Quote (RFQ) for Court Reporter and Transcription Services issued by the Department of Justice Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The key details are: ATF is seeking nationwide in-person court reporter services, with an unknown percentage of virtual services. The required services have steadily increased over the past few years, with 256 proceedings estimated for FY2023. ATF initially posted this requirement as unrestricted, but is open to considering a small business set-aside based on the responses. The contractor is not anticipated to require access to classified national security information. ATF has provided a pricing template for offerors to submit their pricing, which was updated via an amendment to remove duplicate columns and clarify the pricing structure. The due date for proposals was extended by one week to May 10, 2024 to allow contractors adequate time to respond to the Q&R.

OFFERORS' QUESTION(S) ATF's RESPONSE
1 General - Data Do you have historical volume on the number of hearings per state, DC, or US territories?
Amendment #0001, issued on 5/3/2024, updated Section 1 of the PWS, from "170" to "256" & added a table of the below information.
FY19 - 30
FY20 - 37
FY21 - 37
FY22 - 170
FY23 - 256
2 SF1449, PG 1, BOX 10
There are a large number of small businesses that can provide these services so please make this solicitation a small business set-aside?
ATF issued this requirment for in-person, nationwide services as "Unrestricted" based on the market research conducted, responses to Sources Sought Notices, and past experience.
Section 7. Place of
Performance, PG 9
"The solicitation states: ""The BPAH shall provide an in-person, court reporter for all hearings unless ATF otherwise identifies a deviation (i.e., virtual appearance). Similarly, the BPAH shall request advance approval from the ATF POC for the hearing(s), in conjunction with the COR, for any deviation from in-person court reporting (i.e., virtual)."" -- What percentage of all the work do you estimate will be held virtually?"
The percentage is unknown since: 1) the requirement for virtual vs. in-person is based on the need; 2) it's not the same each year; and 3) the locations vary.
Section 7. Place of
Performance, PG 10 What is the total estimated number of days of proceedings per year? The number of proceedings has steadily increased over the past few years.
Section 7. Place of
Performance, PG 11 What is the estimated geographic breakdown on this estimated volume of days? The geographic breakdown is not the same each year.
PERSONNEL SCURITY
REQUIREMENTS - PG 20
"Since the court reporter will not need access to ATF information, IT systems, and/or unescorted access to ATF facilities please clarify what the security requirements are for vendor's personnel who will be going onsite to cover proceedings?"
The security requirement varies - Depending on the location of the hearing, the court reporter may need to be escorted in the facility. If so, then the POC handling the logistics will notify the court reporter of any security requirements at the time of booking.
Eligibility to Access Classified
National Security Information (NSI) - PG 2
"Will the contractor be required to get/have personnel cleared for NSI?
-- If so, to what level?
-- Will the contractor need a facility clearance?
-- If so, to what level?"
NSI is not anticipated. If the contractor will need to access NSI, then the necessary requirements will be coordinated through ATF's office of Professional Responsibility and Security Operations.
8 Att.A_Pricing Matrix "Court reporting prices vary throughout the country. Would ATF consider letting contractors price for various established regions?
-- If so, please set the regions?"
The offeror is responsible for pricing out its solution. The solicitation states the itemized items ATF needs. If there are other fees ATF should be aware of, offerors shall include such in its pricing quotation and on the Pricing Matrix .
9 Att.A_Pricing Matrix What is the difference between Column B "Appearance Fee (full day)" and Column E "Appearance Fee (full day)"?
That was an older version of the attachment - Amendment #0001, issued on 5/3/2024, updated the Pricing Matrix to remove this duplicate column.
10 Att.A_Pricing Matrix Is the contractor supposed to fill in the unit price in Column C and Column D or their unit price times the quantities in parentheses (e.g. in Column C should we put $X or
$XXX)?
Yes, offerors shall enter the price per page - Amendment #0001, issued on 5/3/2024, updated the Pricing Matrix to remove the "(350 pages)" from Column C and the "(8 hrs.
per day)" from Column D.
11 Att.A_Pricing Matrix What is the contractor supposed to put in Column F, Miscellaneous Fees/Costs?
Given that this could be a page rate for a copy or an estimated cost for travel, etc.
the units and estimated volumes are all very different.
Amendment #0001, issued on 5/3/2024, updated the Pricing Matrix to remove that column, yet capture the information below in in said file.
12 General - Due Date Please consider extending the due date for proposals to allow contractors adequate time to process the Q&A?
Amendment #0001, issued on 5/3/2024, extended this buy for one (1) week, from 5/3/2024 to 5/10/2024. The due time remains 3:00pm Eastern Standard Time.
