About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for the sole-source procurement of VeritiPro Thermal Cyclers from Thermo Fisher Scientific. The ATF Forensic Science Laboratory currently uses six Thermo Fisher thermal cyclers, two of which are end-of-life models no longer manufactured. The JOFOC states that the VeritiPro model is the only product that meets the laboratory's requirements and is integral to their DNA processing system. A market research notice was posted on SAM.gov, but no other suitable products were identified. Thermo Fisher is the sole manufacturer and distributor of the VeritiPro, and the only source capable of offering a trade-in program. The JOFOC concludes that using multiple brands of equipment would introduce additional error factors, and maintaining the Thermo Fisher products is necessary to ensure evidence viability in legal proceedings. The related federal contract opportunity is the award of contract 15A00024PAQA00118 to Life Technologies Corporation for the VeritiPro Thermal Cyclers on April 5, 2024 for $15,855.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.
Notice ID: DJA-24-ALAB-PR-0233 was posted on SAM.GOV from 03/13/2024 – 03/22/2024 as an intent to sole source. No responses were received. Therefore, there is no additional market proof that there are other products or sources available.
Thermo Fisher provided a sole source letter on January 12, 2024, stating Part Number: A52127 (HID VeritiPro Thermal Cycler) is solely manufactured and distributed by Thermo Fisher.
The FSL-W currently has six (6) Thermal Cyclers (Thermo Fisher).
two (2) 9700 GeneAmp PCR System thermal cyclers four (4) Veriti Thermal Cyclers.
The two GeneAmp models are end of life and no longer manufactured. Part: A52127 is the newest version.
There are no other known products that meet or exceed Thermo Fisher’s products. The Intent to Sole Source has verified this information. If a new brand could be discovered, it would need ATF Laboratory accreditation. These accreditations are extensive and could lead to months of downtime before they are validated. This is not acceptable when evidence is needed for legal proceedings.
The Veriti line of thermal cyclers are currently used as one step in an extensive process undertaken during DNA processing by the ATF Forensic Science Laboratory DNA section and are known to perform well as an integral part of this system. Using multiple brands of equipment would introduce additional factors of error. Maintaining the Veriti products strengthens evidence viability in legal proceedings.
Additionally, Life Technologies is the only source capable of offering trade in. This is where they sell new equipment at a discount when they can obtain the old equipment from the end user.
