About this file

This is Addendum 1 to a Request for Qualifications issued by the City of Madison, Wisconsin Finance Department Purchasing Services for Corridor Safety Studies and Demonstration Activities (RFQ 15003-0-2026-BP). The addendum clarifies key project parameters and addresses 20 questions submitted by potential bidders. The project deadline has been corrected from February 2027 to February 2028, which includes installation and evaluation of demonstration projects and completion of a final summary report. The City requests that community engagement materials be translated into Spanish, Hmong, and Chinese. Demonstration project concept sketches must be understandable by both City staff and the general public, though no specific format is mandated. The City has standard demonstration materials (barricades, barrels, cones, delineators, and Qwick Kurb) readily available and can procure additional items on short notice. Signal retiming capability is available through the City, and artistic treatments such as asphalt art are welcome but not required. NEPA and Section 106 documentation and approvals are not required.

The contract will be fixed-price, with cost of services addressed during contract negotiations rather than evaluated during the proposal review stage. Local preference points require that the prime vendor be registered as a local vendor with the City; subconsultant local registration does not qualify. SBE credit may be available for firms in the process of SBE certification, with point determination pending review by the City of Madison Department of Civil Rights. The City is open to consulting teams proposing different methodologies that meet project goals and requests that scope modifications include justification. In the event of contract termination or significant changes in available federal funds, payment will be governed by contract sections 25B and 23B, with the City obligated to pay for work performed and reimburse non-cancelable obligations, while both parties must confer in good faith regarding fund reductions. Stakeholder identification and recruitment is a joint responsibility between the City and consultant team.

RE: ADDENDUM 1

15003-0-2026-BP

Corridor Safety Studies and Demonstration Activities

Notice to All Bidders:

Please note the following responses to the questions received:

Question 1 Does the project deadline of Feb 2027 include installation and evaluation of demonstration projects?

Answer 1 There was a typo in the project deadline included in the RFQ. The correct project deadline is February 2028. This includes installation and evaluation of the demonstration projects, as well as the completion of the final summary report.

Question 2 Are local preference points applied if subconsultants are local and registered with the City?

Answer 2 No, the prime/lead vendor must be registered as a local vendor to receive the points.

Question 3 Please confirm there is zero negotiation of contract available

Answer 3 The scope of work in Section 5.2 of the RFQU represents the City’s expectations for the project and minimum requirements based on the federal grant agreement partially funding this project; however, the City is open to consulting team’s proposing a different methodology that would still meet the project’s goals. Cost of services is not considered during the evaluation of submitted qualifications/proposals; cost of services will be addressed in contract negotiations.

Question 4 Please clarify procedure for notices/suspending work if funds are withdrawn

Answer 4 Generally, in the event of a termination, payment will operate as set forth in section 25B of the contract.

Typically, the City will pay or reimburse contractor for work performed as of the effective date of termination, including non-cancelable obligations properly incurred by the contractor prior to such termination. However, in the case of a significant change in available federal funds for this project, section 23B of the contract would apply, which could potentially result in a reduction of available (appropriated) funds. That section also obligates the City and contractor to “confer in good faith” to resolve such a situation.

Question 5 Please confirm contractor will be paid for any work completed through said notice of suspension/withdraw of funds

Answer 5 Generally, in the event of a termination, payment will operate as set forth in section 25B of the contract.

Question 6 Is the City able to share the contract basis options (i.e. time & materials, cost plus fixed fee, etc.) and any limits to overhead rates?

Answer 6 The contract will be fixed price. Cost of services is not considered during the evaluation of submitted qualifications/proposals; cost of services will be addressed in contract negotiations.

Question 7 Will the City be using WisDOT fee computation worksheets?

Answer 7 No. Cost of services will be addressed in contract negotiations.

Question 8 Will SBE credit be granted if an SBE certification with the City is pending, and certification is approved by the contracting stage?

Answer 8 Please state whether the proposing business(es) has SBE certification and/or is in the process of SBE certification at the time of proposal. The full number of points awarded for being in the process of SBE certification at the time of scoring is yet to be determined by the City of Madison Department of Civil Rights. Proposing firms may contact the City of Madison Department of Civil Rights directly for further information. dcr@cityofmadison.com or (608) 266-4910.

Question 9 May we propose a scope language modification (under Task 4) in an effort to provide a level of rigor that we feel is appropriate for the development of the potential improvements? We would like to enhance the scope to provide for more technical rigor based on our experience with permanent and demonstration concept development; we feel that this would be appropriate for our own, as well as the City's, risk protection.

Answer 9 The scope of work in Section 5.2 of the RFQU represents the City’s expectations for the project and minimum requirements based on the federal grant agreement partially funding this project; however, the City is open to consulting team’s proposing a different methodology that would still meet the project’s goals. Consulting team’s should indicate the reason for a scope modification.

Question 10 Are multi-lingual engagement/materials expected as part of community engagement? If so, what languages should be expected?

Answer 10 The City requests that community engagement materials are translated into Spanish, Hmong, and Chinese.

Question 11 Does the City of Madison have a current stock of typical demonstration project materials? If not, what is the City’s expected lead time to procure these materials?

Answer 11 The City has barricades, barrels, cones, tall delineators/grabber cones, and other typical demonstration project materials readily available for this project. The City is also able to acquire more than our current stock of these items on short notice. Some Qwick Kurb is also likely to be available. Additional materials can be ordered within a brief lead time.

Question 12 Does the City of Madison have the ability to implement signal retiming as part of anticipated demonstration project implementation?

Answer 12 Yes.

Question 13 Does the City of Madison desire any artistic treatments to be incorporated as part of demonstration projects?

Answer 13 While there is no requirement that the demonstration projects include artistic treatments, the City is open to artistic treatments including, but not limited to asphalt art.

Question 14 Does the City of Madison expect quantitative “post” period data to be collected before February 2027?

Answer 14 There was a typo in the project deadline included in the RFQ. The correct project deadline is February 2028. This includes installation and evaluation of the demonstration projects, as well as the completion of the final summary report.

Question 15 Will the City of Madison require demonstration project concept sketches in a particular format (e.g., CAD or otherwise)?

Answer 15 No. Demonstration project sketches must be sufficient to instruct City staff how to install the materials and should be understandable by the general public for the purposes of public engagement.

Question 16 Can the City of Madison confirm that NEPA and Section 106 documentation and approvals are not required as part of this project?

Answer 16 NEPA and Section 106 documentation and approvals are not required as part of this project.

Question 17 Will the City of Madison identify stakeholders to participate in field visits, or is the consultant team expected to identify and recruit participants?

Answer 17 The identification and recruitment of stakeholders is expected to be a joint effort between the City and the consultant team. The City can recommend potential stakeholders and facilitate mailings, as needed. The consultant team will be responsible for developing a sufficient recruitment plan to ensure participation sufficient to achieve project goals.

Question 18 Will the City of Madison consider an alteration to contract language to include a defined professional standard of care in keeping with typical industry practice?

Answer 18 All contract negotiations will take place after proposal review is complete and the preferred firm has been notified of intent to award.

Question 19 Will the City of Madison consider an alteration to contract language to place a cap on liability?

Answer 19 All contract negotiations will take place after proposal review is complete and the preferred firm has been notified of intent to award.

Question 20 Will the City of Madison consider an alteration to contract language to tie indemnity to negligent acts or omissions in the performance of the Agreement?

Answer 20 All contract negotiations will take place after proposal review is complete and the preferred firm has been notified of intent to award.
