About this file
This document is a Determination to Solicit from a Single Source under the Simplified Acquisition Threshold (SAT) for the purchase of DIANA Finite Element Analysis (FEA) software licenses and technical support services.
The Bureau of Reclamation requires five licenses of the DIANA FEA software, which is developed and distributed solely by TNO DIANA BV. The DIANA FEA software provides unique analytical capabilities critical for structural analysis of concrete dams that are not available in other commercial FE software. The total estimated value of the contract is $67,978. Due to the proprietary nature of the software, only TNO DIANA BV can provide the required licenses and services. The Contracting Officer has determined the pricing to be fair and reasonable based on comparison to previous purchases and market research.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity.
U.S. Department of the Interior, Bureau of Reclamation, Acquisition and Assistance Operation Branch, Denver, Colorado.
2. Name and Address of Single Source.
DIANA FEA B.V.
Thijsseweg 11 Delft, Zuid-holland 2629 JA, Netherlands
3. Description of Supplies/Services and Estimated Cost.
The Waterways and Concrete Dams Group 1 uses DIANA FEA software to perform non-linear structural analyses. This contract will be to provide licenses of the most recent version of DIANA FEA on a yearly basis, with options to renew yearly at the discretion of the government. The current number of licenses required is five. This may change in future years, and the contract will be modified to reflect any change in need of the number of licenses.
The requested license renewal of DIANA Finite Element Analysis (FEA) software includes a five licenses for TNO-DIANA A+B+C+ modules and the FX+ Pre-Post Processor. The required service includes technical support and the software upgrades and assistance towards implementation of the software at specific Reclamation projects.
Estimated total value $67,978.00
4. Description of Circumstances, including why only one source is reasonably available.
IAW FAR 13.106-1(b)(1)(ii) TNO DIANA BV is the sole developer and distributor of DIANA Finite Element (FE) Software developed for advances analysis of civil structures (see attached). DIANA FEA software program includes key analytical features that are not available in other commercial FE software programs. The procurement proposes purchasing one DIANA FEA license renewal.

TSC (Waterways & Concrete Dams Group1) structural engineers have been performing advanced non-linear seismic simulations of Reclamations concrete dams as a part of the Dams Safety Office (DSO) investigation program and are involved in the design of new concrete dams and the dam appurtenant structures. The DIANA FEA software uniquely addresses all features that are critical in the structural analysis of concrete dams.
The software will provide independent analytical solutions that will allow validation of the analysis process currently used in the seismic evaluation of Reclamations dams. The results of the FE non-linear analysis, presently performed by using LS-DYNA program, are compared for accuracy and efficiency of the solutions with the results obtained by DIANA for validation of analysis results.
Several unique analytical features included in the DIANA FEA software that allow the TSC to provide technical services to the DSO include simulation Alkai Aggregate Reaction (AAR) process in concrete dams and simulation of the hydration process of young concrete during construction of new dams.
The modern pre and post processor implemented in DIANA FEA results in more efficient modeling of concrete dams when compared with existing approaches.
5. Determination of Fair and Reasonable Price.
Fair and reasonable price will be determined prior to award and made by comparing the quoted price with prices found reasonable on previous purchases and through additional market research in comparison to the independent Governments estimate.
6. Description of Market Research.
Market research was conducted via online searches. A notice of intent to sole source was also posted on SAM for a period of seven days. There were no responses from a firm who believed they had the technical capability to meet this need. Due to the proprietary nature of this requirement, no other vendor would be able to provide the required software. Reclamation will continue to monitor this industry and keep abreast of new technology for future requirements.
