Market research found GeoTAC to be the only available source for the required equipment.

RMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

2. Name and Address of Single Source.

MMH Enterprises, LLC d.b.a. GeoTAC 11777 S Sam Houston PKWY W STE B Houston, Texas 77031-2341

3. Description of Supplies/Services and Estimated Cost.

Sigma-1 Automated Loading System containing the following:

• Sigma-1 5K lbs load frame,

• 5,000 lb load cell,

• 3" deformation sensor,

• two pressure sensors,

• GeoTac TruePath and DigiFlow software packages for automated triaxial testing.

4. Description of Circumstances, including why only one source is reasonably available.

Reclamation currently owns and operates exclusively from five (5) Sigma-1 Automated

Loading Systems and GeoTac TruePath and DigiFlow software packages to which GeoTAC is the exclusive owner and distributer. To incorporate an additional triaxial compression system from a supplier other than GeoTAC into Reclamation’s current group of Geotechnical

Testing Equipment would result in several issues to include system compatibility, functionality, and data reporting. It is imperative in the completion of Reclamation’s mission to gather and report data in the most effective and consistent manner. Therebefore it is in the

Governments best interest to sole source this requirement though GeoTAC.

5. Determination of Fair and Reasonable Price.

The Contracting Officer will perform necessary price analysis techniques such as a

(11/2020) comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13.106-3 (a)(2)(ii)), and/or review of current price lists or catalogs (FAR

13.106-3(a)(2)(iii)). Finally, pricing within the Independent Government Estimate may also be used (FAR 13.106-3(a)(2)(vi)).

6. Description of Market Research.

Market research was conducted through the world wide web, current customers/users of the equipment, and GSA Advantage revealing GeoTAC is the only one source available for the purchase of the required equipment.
