JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION

In accordance with FAR 6.302, the proposed contractual action is pursuant to the statutory authority identified in paragraph 4. This template is required for actions over the Simplified Acquisition Threshold (unless the procurement is acquired as a limited source lAW FAR 8.405-6 or is an Exception to fair Opportunity lAW FAR 16.505(b)(2)).

1. Agency and Contracting Activity (FAR 6.303-2(b)(I)). U.S. Department of the Interior, Bureau of Reclamation, Acquisitions and Assistance Operations Branch, Denver, Colorado.

2. Nature/Description of Action (FAR 6.303-2(b)(2)). This requirement is to enter into a sole-source, Firm-Fixed Price contract for the lease of insulation test equipment and associated services from Doble Engineering, a small business under NAICS 334515.

3. Description of Supplies/Services (FAR 6.303-2(b)(3)). Reclamation maintains various programs for maintenance testing of power system components to ensure reliability of power systems. Specific services required include:

a. Use of the appropriate instruction books.

b. Right of Government personnel to participate in “Client Conferences”

c. Access to electronic copies of minutes of each “Client Conference” held during the duration of this contract.

d. A review and complete report of the Government’s test data upon request in accordance with the standard practice of the Contractor.

e. General consultation on the Government’s insulation problems in accordance with the standard commercial practice of the Contractor.

f. Methods for using test equipment and data for interpreting tests made therewith in accordance with the standard commercial practice of the Contractor.

g. Instruction and training on use of the test equipment and interpretation of results.

This testing is a required component of the Reclamation Electrical Apparatus Insulation Testing Program for maintaining integrity of electric power generation insulation systems. It also meets Government Performance and Results Act goals in managing resources and the associated outcome of operating and maintaining reliable, safe, and secure power facilities. Lastly, it is a key element for staying in compliance with Federal Energy Regulatory Commission guidelines.

Due to the unique characteristics of the insulation test equipment there are very few vendors capable of providing the equipment as well as maintaining and responding to equipment outages within a 24-hour period. In addition, no other company has the equipment that will meet Reclamation’s requirements as similar pieces will ultimately require pairing with a piece of Doble equipment to meet Reclamation’s mission critical needs. furthermore, due to the unique nature of the requirement, if Reclamation were able to change to another vendor, much of the existing performance data would be

Solicitation or Award Number: 140R$1 19Q0325 Page 2 of 5 incompatible with the new equipment in place.

The following equipment is currently in use under contract RI4PC00034 and use will continue to be used for this new requirement:

a. Doble Type T-4000 10-ky Automated Insulation Analyzers

b. M4000 Automated Insulation Analyzer

c. Doble Universal Controller (DUC - Laptop style)

d. Type M4300 Transport Cart

e. TTR Capacitor

f. Type M5400 Sweep frequency Response Analyzer

Doble provides all the test equipment under lease with a perpetual warranty and 24-hour call-in support for equipment and test results.

Reclamation spent a significant amount of funding and time assessing potential vendors in the marketplace and found that no competitor has the capability to supply the needed test equipment and associated services to maintain the historical database and provide 24-hour support. Based on this testing research compared to the equipment and service achievable through Doble, the government has determined that Doble Engineering is the only source capable to meet the Government’s requirement.

6. Description of efforts made to maximize competition (FAR 6.303-2(b)(6)). Market research was conducted to determine whether there is competition in the marketplace.

Numerous contractors were identified through SAM, SBA Dynamic search, GSA, fPDS- NG, and an Internet search. A notice of intent to sole source was also posted to FedBizOpps and GSA eBuy on May 20, 2019. to determine whether those sources are capable of meeting this requirement need. The government determined no other vendor was capable of meeting the requirement.

7. Determination of Fair and Reasonable Cost. The IGCE value for this requirement is lAW FAR 13.l06-3(a)(2), the Contracting Officer anticipates that the cost will be fair and reasonable based upon personal knowledge and historical awards made to Doble Engineering. To determine fair and reasonable cost will compare this requirement to similar historical actions and the IGCE.

8. Description of Market Research Conducted (FAR 6.303-2(b)(8)).

A Sources Sought was posted to FBO and GSA e-Buy on May 20, 2019, and no responses were received. Market Research was conducted on May 15, 2019, through the GSA e-Library, under SIN 873 3 Electric Testing and Analysis Services. Two vendors were identified on GSA eBuy, as well as other multiple vendors through Small Business Dynamic Search and an Internet search as being capable of providing this similar product and service under the NAICS code; however, these vendors were determined as not being capable of meeting the full requirement. Based on this determination the government issued a Sources Sought in hopes of finding additional vendors however, it received no responses to the Sources Sought. Therefore, the government has determined that Doble Engineering, which is a small business under NAICS 334515, is the only vendor capable of meeting this requirement.

9. Any Other Supporting Facts (FAR 6.303-2(b)(9)). This requirement is for the lease of equipment and training associated with the use of the equipment. lAW DOl AAAP-0057, a Purchase vs. Lease assessment was conducted, and it was found that the cost to purchase the equipment wilt be approximately $3.lM which significantly exceeds the lease price.

Through establishing this lease, Reclamation will gain the following benefits included in the cost of lease:

a. Extended warranties

b. Service and maintenance of the equipment

c. Minor repairs, calibration, and test lead replacements

d. Training for new/upgraded equipment

e. Consulting engineering services

f. 24 hr/7-day support for results, equipment troubleshooting, and step-by-step test procedures

10. Listing of Interested Sources (FAR 6.303-2(b)(lO)). Doble Engineering is the only interested source. A Sources Sought was posted and no responses were received.

11. Actions Taken to Remove Barriers to Competition (FAR 6.303-2(b)(lJ)).

Reclamation will continue to evaluate and assess equipment to ensure the most stable equipment in the marketplace. Finally, Reclamation will continually examine the market for other potential, viable solutions as the options are exercised.
