DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

U.S. Department of the Interior, Bureau of Reclamation, Acquisition and Assistance Operation Branch, Denver, Colorado.

2. Name and Address of Single Source.

DIANA FEA BV

Delftechpark 19a Delft 2628XJ The Netherlands

3. Description of Supplies/Services and Estimated Cost.

This requirement is for two DIANA Finite Element Analysis (FEA) software licenses. The requirement includes two licenses for DIANA FEA A+B+ C+ modules and the FX+ Pre-Post Processor, plus four optional years of annual maintenance and upgrades. The requirement includes one-year technical support and the software upgrades and assistance towards implementation of the software at specific Reclamation projects.

The estimated value of this requirement to include four optional years of software maintenance is $100,735.00.

4. Description of Circumstances, including why only one source is reasonably available.

The Technical Service Center’s (TSC) Waterways and Concrete Dams Group’s structural engineers have been performing advanced non-linear seismic simulations of Reclamation's concrete dams as a part of the Dams Safety Office (DSO) investigation program and are involved in the design of new concrete dams and the dam appurtenant structures. The DIANA FEA software uniquely addresses all features that are critical in the structural analysis of concrete dams.

The software will provide independent analytical solutions that will allow validation of the analysis process currently used in the seismic evaluation of Reclamation's dams. The results of the FE non-linear analysis, presently performed by using LS-DYNA program, are compared for accuracy and efficiency of the solutions with the results obtained by DIANA for validation of analysis results.

Two additional analytical features included in the DIANA FEA software allow the TSC to provide technical services to the DSO include the simulated Alkali Aggregate Reaction (AAR) process in concrete dams and the simulation of the hydration process of young concrete during construction of new dams.

DIANA FEA BV is the sole developer and distributor of DIANA FEA Software developed for advances analysis of civil structures. The DIANA FEA software program includes key analytical features that are not available in other commercial FEA software programs. The procurement proposes purchasing two DIANA FEA licenses. There are no known value-added re-sellers authorized to distribute this software.

5. Determination of Fair and Reasonable Price.

Fair and reasonable price will be determined by comparison with current price lists, catalogs, or advertisements, comparison to an independent Governments estimate.

6. Description of Market Research.

Market research was conducted via online searches. A notice of intent to sole source was also posted on FBO for a period of seven days. There were no responses from a firm who believed they had the technical capability to meet this need. Due to the proprietary nature of this requirement, no other vendor would be able to provide the required software. Reclamation will continue to monitor this industry and keep abreast of new technology for future requirements.
