52.228-1 Bid Guarantee. (Sept 1996) As prescribed in 28.101-2
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds-
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The bid guarantee amount shall be at least 20 percent of the bid price but shall not exceed $3 million.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Note: Executive Order 13658 generally applies to contracts subject to the Davis-Bacon Act that were awarded on or between January 1, 2015 and January 29, 2022, and that have not been renewed or extended on or after January 30, 2022. Executive Order 13658 does not apply to contracts subject only to the Davis-Bacon Related Acts regardless of when they were awarded.
If a contract is subject to Executive Order 13658, the contractor must pay all covered workers at least $13.30 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing https://sam.gov/wage-determination/MT20260080/1 3/6 on the contract in 2025. The applicable Executive Order minimum wage rate will be adjusted annually. Additional information on contractor requirements and worker protections under Executive Order 13658 is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).
The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.
Union Rate Identifiers
A four-letter identifier beginning with characters other than ""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.
Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.
Union Average Rate Identifiers
The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:
UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.
The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.
A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.
Survey Rate Identifiers
The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates https://sam.gov/wage-determination/MT20260080/1 4/6 reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.
?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).
State Adopted Rate Identifiers
The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.
WAGE DETERMINATION APPEALS PROCESS
1) Has there been an initial decision in the matter? This can be:
a) a survey underlying a wage determination
b) an existing published wage determination
c) an initial WHD letter setting forth a position on a wage determination matter
d) an initial conformance (additional classification and rate) determination

Questions and answers:
1. Question: The drawings have some details related to a stepped trail and floating dock with gangway. Are the dock, gangway and stepped trail part of this job and if so what bid items should they be a part of?
Answer: The dock, gangway and stepped trail are not part of this project.
2. Question: There appears to be some asphalt patching related to the concrete placement(Typical Section C). What bid item should we use for the asphalt patching or is it required?
Answer: Asphalt patching is required, please utilize bid item Asphalt Removal for asphalt patching. See section 32 12 22 of the specifications.
3. Question: Wage Rates- Are there wage rates for the Concrete Finishers or Construction Laborers – Group 2? –
Answer: Added Wage Determination MT20260075 – Highway Construction Determination, with this amendment in order to include Cement Mason / Concrete Finisher. Yes, Construction Laborers would be Group 2.
4. Question: What Traffic Control and Safety measures are anticipated?
Answer: The Government will allow the Contractor to close Riverside Campground during construction activities starting 6 days after Labor Day and will be complete 4 days before Memorial Day. The Contractor shall maintain public access to the Riverside Campground Boat Ramp and Parking area throughout the construction duration. The Contractor shall provide all signs, delineators, barriers, barricades, flasher lights to achieve a safe closure. See section 01 55 20 of the specifications.
5. Question: Do we need to illuminate Traffic Control in the campground? (Traffic Control – F.) sheet 67 of solicitation
Answer: Yes, illuminate traffic control barricades from sunset to sunrise for MUTCD Type 3 Barricades. See section 01 55 20 of the specifications.
6. Question: Is there any incidental landscaping?
Answer: Yes, grade crushed base course from the edge of concrete to the existing surface. See Typical Section E on Sheet 296-600-60191. Also see, Vehicular Access and Parking, section 01 55 00 of the specifications, Repair ruts, broken pavement, potholes, low areas with standing water and other deficiencies to maintain road surfacing and drainage in original specified condition.
7. Question: The fire ring (by others) in the concrete camping detail appears to have some sort of anchor that looks like it is in the 4 inch concrete and base. If this is the case, can we get more detail on this and is the anchor provided by others?
Answer: The anchors for the fire ring exist, however they are placed in the subgrade and not in concrete. Salvage anchors and place them in Subgrade, not in new concrete. Refer to the 296-600-60190 Rev. No. 1 drawing that has been added with this amendment.
8. Question: Are there any anchors for the picnic tables that we should be aware of?
Answer: No, the picnic tables are concrete and don’t require an anchor.
9. Question: Is there a bond requirement?
Answer: Yes, the form 1442 field 12a. identifies the requirement of Performance and Payment bonds. This amended updates the 1442, field 13b. to update an offer guarantee (aka Bid Bond) is required. Section J has each of the template forms included.
10. Question: Are there outhouse facilities on site available for use or should the contractor provide temporary outhouses(portapotties)?
Answer: Contractor to provide temporary outhouses. See section 01 51 00 of the specifications.
11. Question: Many of the details say colored concrete. What color is required?
Answer: There is no colored concrete, the drawings where it calls for colored concrete are for information only.
12. Question: The concrete sidewalk/walkway details do not appear to call for colored concrete. Is colored concrete required? If so what color?
Answer: There is no colored concrete, the drawings where it calls for colored concrete are for information only
13. Question: A schedule is required as part of the proposal- what format is required?
Answer: Microsoft Project or excel are both programs that we frequently use.
However, the program doesn’t matter as long as the schedule is provided to us in PDF format and is clear and concise.
14. Question: Is it acceptable to hire a non-small business as a subcontractor for some of the work?
Answer: Yes, subcontracting with a large business is allowed as long it stays withing the requirements of FAR Clause 52.219-14.
15. Question: Are we supposed to hire an onsite safety personnel? In the list of submittals, it appears that we are required to submit a resume prior to hiring contractors onsite safety personnel.
Answer: Section 01 35 30, 1.04-A-1 requires a competent supervisory employee with current safety and health-related training. This employee could be an existing supervisor or manager that meets the listed requirements.
16. Question: Sheet 296-600-60189-(possible locations) and sheet 296-D-1235-(detail) show a Speed Control Dip- How many of these are required and where?
Answer: Sheet 296-D-1235 is for information only. This project doesn’t involve speed control dips. Please only replace the concrete indicated on page 296-600- 60189.
17. Question: The Price Schedule (B-2) for Concrete has a quantity of 190 CY – my take-off of sheet 296-600-60189 has 14,525 SF of New Concrete Trails – at 4” that is 179 CY/ the take-off from sheet 296-D-1234 has the 4” and 6” colored concrete at 3,040
SF that is 47 CY plus the addition of any Speed Control Dips. Rough total of 235 CY (without speed control dips) - Am I in error on my quantities?

18. Question: Sheet 296-D-1234 Shows details for a 44’X30’ and a 20’X16’ colored concrete Shelter Slab- where on the property are these located?

Answer: The existing fire ring is to be reused in the new concrete camping area.
