PRICE SCHEDULE
1. Contractor/quoter shall provide the quotation in accordance with the price schedule below.
2. All quotations should be valid for a minimum of 90 days.
3. The Government reserves the right to not make award.
4. The Government reserves the right to incorporate additional changes in quantity of similar or like goods.
5. Quantities required/delivered may be varied 15% plus or minus by the Contracting Officer based on project requirements.
6. Quotations and Delivery shall be F.O.B. Destination.
6. Payment will be made by the Invoice Processing Platform (IPP) only.
7. Contract type is a firm-fixed price.
8. Schedule of Work/Submittals:
Specification sheets documenting the required specifications shall be provided with quotation. If not provided with the quotation, the quotation will be determined non-responsive.

Specifications
A. The limestone gravel material will be from a quarry that is an approved commercial pit permitted by the State of South Dakota in compliance with SDCL 45-6 that has met the state requirements for archaeological, cultural and SHPO clearances.
B. Materials shall be weighed at a state certified scale. Weight of gravel material shall be to the nearest 0.1 ton, and load weight tickets shall be provided to the Contracting Officer’s Representative within 5-days of delivery. Material shall be furnished, delivered, and neatly stockpiled in a single pile with any equipment needed provided by the contractor to the Fruitdale area at Belle Fourche Reservoir. Locations are shown on the attached maps (Attachment A) and the final location shall be determined by Reclamation.
C. Gravel surfacing shall meet the following requirements.
1. The gravel material shall consist of a crushed limestone.
2. The gravel shall meet the following gradation requirements by dry weight:

3. Crushed: Granular material of which 30% of the particles on the No. 4 sieve shall contain one or more fractured faces.
4. The P. I. of the filter material shall not exceed twelve (12).
Delivery
The contractor will deliver the limestone gravel to the Fruitdale Area at Belle Fourche Reservoir where an existing gravel pile is in place. The material will be neatly stockpiled with the existing gravel in a single pile.
See Attached map for specific location. Coordinates 44.68872° N, 103.69981° W.
Location
The gravel material shall be delivered and stockpiled as shown on the attached map. The location is at the Belle Fourche Reservoir located at Township 9 North, Range 3 East of the Black Hills Meridian. Belle Fourche Reservoir is located approximately 10 miles east of Belle Fourche. The reservoir is accessible from Belle Fourche by traveling east on U.S. Highway 212 for approximately 10 miles. The Fruitdale Area can be accessed directly from 212 onto an existing road.
Site Visits
Site is open to the public; prospective suppliers of limestone gravel are encouraged to visit the delivery site or otherwise familiarize themselves with the delivery site to determine access and truck size required for delivery.

The Contractor shall submit a soft copy of their invoice via IPP. Failure to upload a copy of the invoice may cause significant delay or possible rejection of your payment request.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 – 5 business days of the contract award date. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.229-3 FEDERAL, STATE, AND LOCAL TAXES (FEB 2013)
(a)As used in this clause-
After-imposed Federal tax means any new or increased Federal excise tax or duty, or tax that was exempted or excluded on the contract date but whose exemption was later revoked or reduced during the contract period, on the transactions or property covered by this contract that the Contractor is required to pay or bear as the result of legislative, judicial, or administrative action taking effect after the contract date.
It does not include social security tax or other employment taxes.
After-relieved Federal tax means any amount of Federal excise tax or duty, except social security or other employment taxes, that would otherwise have been payable on the transactions or property covered by this contract, but which the Contractor is not required to pay or bear, or for which the Contractor obtains a refund or drawback, as the result of legislative, judicial, or administrative action taking effect after the contract date.

All applicable Federal, State, and local taxes and duties means all taxes and duties, in effect on the contract date, that the taxing authority is imposing and collecting on the transactions or property covered by this contract.
Contract date means the date set for bid opening or, if this is a negotiated contract or a modification, the effective date of this contract or modification.
Local taxes includes taxes imposed by a possession or territory of the United States, Puerto Rico, or the Northern Mariana Islands, if the contract is performed wholly or partly in any of those areas.
(b)
(1)The contract price includes all applicable Federal, State, and local taxes and duties, except as provided in subparagraph (b)(2)(i) of this clause.
(2)Taxes imposed under 26 U.S.C. 5000 C may not be-
(i)Included in the contract price; nor
(ii)Reimbursed.
(c)The contract price shall be increased by the amount of any after-imposed Federal tax, provided the Contractor warrants in writing that no amount for such newly imposed Federal excise tax or duty or rate increase was included in the contract price, as a contingency reserve or otherwise.
(d)The contract price shall be decreased by the amount of any after-relieved Federal tax.
(e)The contract price shall be decreased by the amount of any Federal excise tax or duty, except social security or other employment taxes, that the Contractor is required to pay or bear, or does not obtain a refund of, through the Contractor’s fault, negligence, or failure to follow instructions of the Contracting Officer.
(f)No adjustment shall be made in the contract price under this clause unless the amount of the adjustment exceeds $250.
(g)The Contractor shall promptly notify the Contracting Officer of all matters relating to any Federal excise tax or duty that reasonably may be expected to result in either an increase or decrease in the contract price and shall take appropriate action as the Contracting Officer directs.
(h)The Government shall, without liability, furnish evidence appropriate to establish exemption from any Federal, State, or local tax when the Contractor requests such evidence and a reasonable basis exists to sustain the exemption.

52.247-21 Contractor Liability for Personal Injury and/or Property Damage (APR 1984)
(a) The Contractor assumes responsibility for all damage or injury to persons or property occasioned through the use, maintenance, and operation of the Contractor’s vehicles or other equipment by, or the
Bureau of Reclamation DK-BF Gravel Purchase action of, the Contractor or the Contractor’s employees and agents.
(b) The Contractor, at the Contractor’s expense, shall maintain adequate public liability and property damage insurance during the continuance of this contract, insuring the Contractor against all claims for injury or damage.
(c) The Contractor shall maintain Workers’ Compensation and other legally required insurance with respect to the Contractor’s own employees and agents.
(d) The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents in performing under this contract, and the Government shall be indemnified and saved harmless against claims for damage or injury in such cases.
52.246-16 Responsibility for Supplies (APR 1984)
(a) Title to supplies furnished under this contract shall pass to the Government upon formal acceptance, regardless of when or where the Government takes physical possession, unless the contract specifically provides for earlier passage of title.
(b) Unless the contract specifically provides otherwise, risk of loss of or damage to supplies shall remain with the Contractor until, and shall pass to the Government upon-
(1) Delivery of the supplies to a carrier, if transportation is f.o.b. origin; or
(2) Acceptance by the Government or delivery of the supplies to the Government at the destination specified in the contract, whichever is later, if transportation is f.o.b. destination.
(c) Paragraph (b) of this clause shall not apply to supplies that so fail to conform to contract requirements as to give a right of rejection. The risk of loss of or damage to such nonconforming supplies remains with the Contractor until cure or acceptance. After cure or acceptance, paragraph (b) of this clause shall apply.
(d) Under paragraph (b) of this clause, the Contractor shall not be liable for loss of or damage to supplies caused by the negligence of officers, agents, or employees of the Government acting within the scope…
