About this file

This is a Determination to Solicit from a Single Source document issued by the Department of the Interior, Bureau of Reclamation's Upper Colorado Regional Office for solicitation number 140R6025P0011. The document justifies sole-source procurement from Armstrong Construction One LLC (Babb, MT) for emergency bulldozing, loading, and hauling of pit run aggregate material needed to repair a private access road.

The sole-source justification stems from an urgent requirement following a catastrophic siphon line failure on June 18, 2024, which washed away access to a private hospitality business. The materials needed to be delivered between June 20-27, 2024. Armstrong Construction was selected as they were a TERO-approved local contractor with immediately available equipment and operators, while other area contractors lacked this capability. Price reasonableness will be determined by comparing similar items in related industries. The document was signed by Contracting Officer Kent R. Munro on February 10, 2025.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Upper Colorado Regional Office, Acquisition Management Division, Salt Lake City, UT 84138.

2. Name and Address of Single Source. Armstrong Construction One LLC, 301 Redrock Road, Babb, MT 59411.

3. Description of Supplies/Services and Estimated Cost. Bulldozing, loading and hauling of pit run aggregate material from the pit location to stockpile at the required location for government forces to use to repair a road.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(i), only one source was solicited because of the urgency of this requirement. The pit aggregate supplies had to be delivered between 6/20/2024 through 6/27/2024 for emergency repair of a private access road by government forces. This office became aware of the requirement on 6/19/2024 after a siphon line catastrophically failed the day before. If the required delivery date was not met, there would be an adverse financial impact to a private business (hospitality/hoteling) due to their access road having been suddenly washed away by a catastrophic siphon water line failure, preventing them from being able to recover from the property damage and having the necessary access for their customers. The Government has a responsibility to rectify the damage to private property caused by failure of a Government-owned infrastructure.

5. Determination of Fair and Reasonable Price. The FAR price analysis technique at FAR

13.106-3(a)(2)(vi) “A comparison with similar items in a related industry,” will be used to determine the fairness and reasonableness of the resulting price.

6. Description of Market Research. Market research by a Reclamation engineer who was on-site for siphon inspections indicated a Tribal Employment Rights Office (TERO)-approved construction firm from the local area that had trucks and operators available to immediately start the construction. They had performed quite a bit of work for other governmental entities in the area and had a good reputation for producing quality work. Similar contractors
