FOREWORD

The work consists of, but is not limited to, the following elements: 1) Vacuum removal of all existing media and support gravel in gravity filter tanks, 2) Removal, cleaning, repair and replacement of air wash laterals and replacement of air wash nozzles.3) Material handling by conveyors, eductor equipment, skid steer, or other heavy equipment to enable moving approximately 105 tons of gravel and sand material, packaged in 100-lb bags, from plant floor into four (4) separate fiberglass tanks and placing all material in exact order and quantities into each tank per manufacturer’s installation criteria.

The work under this solicitation is located at Leadville Mine Drainage Tunnel Water

Treatment Plant and is located in Lake County at 749 Hwy 91, Leadville, Colorado.

Leadville is situated at 10,200 feet in the mountains of central Colorado

STATEMENT OF WORK

Leadville Gravity Filter Filtration System Component Rebuild

1. BACKGROUND

Reclamation anticipates award of a contract to provide labor, supplies and equipment necessary to rebuild AquaTech Gravity Filtration system components, including underdrain and support gravel, and silica sand and anthracite filtration media for water treatment at the Leadville Mine

Drainage Tunnel Water Treatment Plant. The Leadville Plant is located in Lake County at 749

Hwy 91, Leadville, Colorado. Leadville is situated at 10,200 feet in the mountains of central

Colorado. Severe winter weather may exist, including snow, ice, winter driving conditions, and freezing temperatures.

PRE-PROPOSAL SITE VISIT: AN ORGANIZED SITE VISIT IS SCHEDULED FOR

December 12th, 2018 at 1:00 pm MST . CONTRACTORS SHOULD MEET AT:

Interested contractors shall make arrangements to attend the pre-proposal site visit by contacting

Jenelle Stefanic at 719-486-2035, no later than 5:00 pm on December 05, 2018. All visitors must provide a scanned copy of valid identification, driver’s license or other approved identification no later 5 pm, One week prior to site visit date.

2. SCOPE OF WORK

The contractor shall furnish transportation, supplies, equipment, labor and supervision for the purpose of rebuilding the sand filtration system at the Leadville Plant as specified in Section C.

PERIOD OF PERFORMANCE

It is anticipated that work shall take place between February 25 through April 5, 2019, contingent on coordination with materials delivery and project schedule, during normal business hours of 6:30 am to 5:00 pm. Extended hours and weekend work may be allowed with prior approval of the Contracting Officer’s Representative (COR) and

Leadville Water Treatment Plant Supervisor.

NORMAL HOURS. Deliveries shall be made during normal business hours, 6:30 am

– 5:00 pm, Monday through Thursday, holidays excepted. However, the above hours may be flexible at the discretion of the Contracting Officer (CO) or Leadville staff.

RECOGNIZED HOLIDAYS. The contractor is not required to provide service on recognized Federal holidays established by Federal law (5 U.S.C. 6103). A schedule of the recognized holidays can be found at the following website:

3. Project Scope/Objectives

Contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and incidental services necessary to accomplish the following tasks:

1. Vacuum removal of all existing media and support gravel in gravity filter tanks.

2. Removal, cleaning, repair and replacement of air wash laterals and replacement of air wash nozzles.

3. Material handling by conveyors, eductor equipment, skid steer, or other heavy equipment to enable moving approximately 105 tons of gravel and sand material, packaged in 100-lb bags, from plant floor into four (4) separate fiberglass tanks and placing all material in exact order and quantities into each tank per manufacturer’s installation criteria as presented in Attachment A.

4. Access to tanks is via 24-inch manway doors located 6 feet from filtration bay floor.

Material may be placed into tanks from top access as well, if it can be accomplished without damage to fiberglass floor and walls, and internal components of tank including schedule 40 PVC piping, laterals, and aluminum collars on water distribution piping.

5. Skills required:

a. At least one person must be qualified to supervise installation to ensure quality meets manufacturer’s specifications for support and media placement, including replacing underdrain laterals and air wash piping per filter design specifications.

b. All personnel must be capable of operating required machinery and hand tools safely and efficiently.

c. At least three people must be trained confined space entry authorized personnel.

d. Fall arrest system and fall protection equipment will be required when working from catwalk.

6. Company Experience/ Key Personnel:

a. Any company wishing to propose for this project must have experience working in construction of water or wastewater treatment field, particularly related to the construction/ installation of gravity filtration systems

b. The Government has separately contracted with the filtration system designer

Filter Tech Systems (manufacturer) to provide at least one technical representative onsite to oversee and provide technical support, to include PVC welding, for rebuilding the four filter tanks at the Leadville Plant http://www.opm.gov/Operating_Status_Schedules/fedhol/2012.asp

4. Supply Specifications

Contractor shall furnish and deliver sand filter media, and underdrain and support gravel, and replace air wash nozzles as described below, to meet the following specifications:

Underdrain and Support Gravel, and Silica Sand Filtration Media:

• Please see attached spreadsheet listing sizes and quantities of material required

• All Gravel and filtration media shall meet or exceed the most recent AWWA B100-09

Standard for Granular Filter Material and shall be NSF/ANSI Standard 61 (Drinking

Water System components- Health Effects) certified for quality and purity.

• Underdrain media shall:

o Consist of hard, uncoated, rounded stones.

o Be free of shale, mica, clay, sand, loam and organic impurities of any kind.

o Have an average specific gravity of not less than 2.6. Not more than 1% of the material shall have a specific gravity of 2.25 or less.

o The gravel shall contain not more than 3% by weight of thin, flat, elongated.

pieces (pieces in which the largest dimension exceeds five (5) times the smallest dimension determined by hand picking.

o Solubility in hydrochloric acid for gravel sizes 3/8” or larger shall not exceed

15%; for sizes smaller than 3/8”, solubility shall not exceed 5%.

o Gravel shall have a hardness of 7-8 on the MOH Scale.

o Porosity of the gravel in each layer shall not be less than 35% or more than 45%.

o The media gradation from top to bottom shall consist of:

▪ 4” of 2-3 mm silica gravel

▪ 4” of 3/16” x 3/32” silica gravel

▪ 4” of 3/8” x 3/16” silica gravel

▪ 7” of 3/4” x 3/8” silica gravel

▪ 11” of 1-1/2” x 3/4” silica gravel

• Filtration sand and anthracite shall be:

o Verified for correct ES, and UC. Sieve dimensions shall conform to ASTM E11.

Media with a particle size distribution not meeting the specified size and quality values will be subject to rejection.

o Free from contamination which could negatively impact NPDES permit requirements for metals, pH, TSS, and other water quality parameters (see attached permit limitation table).

o Service flow rate 5 gpm/sq. ft.; Backwash flow rate 15 gpm/sq.ft

• Silica sand filtration media shall:

o Be washed no less than twice, kiln dried, and screened.

o Be minimum 85% silica sand with consistent uniformity.

o Hardness of 6.5 to 7 on the MOH Scale o Specific Gravity 2.65 avg o Sphericity of ≥ 0.7, and Roundness of ≥ 0.7 o Effective Size 0.9-1.0 mm; Uniformity Coefficient of ≤ 1.4

• Anthracite Media shall be 1.00-1.10 mm in size with a Uniformity Coefficient of ≤1.5.

o Be washed and screened to ensure removal of impurities and reduce ash.

o Hardness of ≥ 3 on the MOH Scale o Specific Gravity ≥ 1.6 o Effective Size 1.3-1.5 mm; Uniformity Coefficient of ≤ 1.5

IMPORTANT NOTE: Filtration media must be stored indoors and cannot be installed if frozen. The Government will provide storage in a metal building which is NOT heated, contractor will be required to provide heat source to prevent freezing of media prior to installation.

Air Wash Nozzles:

Custom Screened Orifice, must be identical to the following:

O’Keefe Controls Co. Screened Metal Orifice with Integral Wire Screen (640 each):

• Part number ES-76-BR

• Materials or Construction - Body: ¼” NPT Brass Pipe Nipple (see drawing for detail)

• Orifice size number 76

• 0.076 inch diameter Orifice with diameter accuracy of +/-.0005”

• 100 micron stainless steel screen

Description:

Stainless steel wire screens are mounted within the precision orifice assembly to protect the orifice from contamination that could be introduced during operation or installation. The fine screens are not intended to replace normal filtration equipment, but rather to augment the protection of small orifices.

5. Safety Considerations

1. Confined Space – tank entry.

2. Fall Protection – working at 20’ height on platform.

3. Moving equipment.

4. Eye, hearing, foot, hand protection.

5. Work in and around tanks in tight fit areas occupied by pipes, valves, and pipe/catwalk supports.

6. Respiratory protection – placing silica media.

6. Procedures

1. Vacuum removal of media:

a. Vacuum trucks will remove approximately 1350 cubic feet of media, including sand media (1.2-1.6 mm), and gravel ranging in size from 3 mm to 1-1/2” x 3/4”. Material total is 60 inches inside three tanks, 11 ft diameter x 18 ft tall, with 24” manway access approximately 6 feet above floor.

b. Each tank contains an air wash system composed of ¾” PVC piping, and underdrain lateral piping which must be carefully avoided during vacuum material removal to prevent any breakage of these internal components.

c. Additional Requirements of this contract include:

• Vendor will provide a heavy-duty vacuum loader truck; vacuum truck must be capable of operation at 10,200 feet above sea level.

• Vendor will provide 80 feet of hard piping and flexible hose to reach 80 feet from truck to filtration cells.

• Vendor personnel must be confined space entry certified and equipped.

8. Government Furnished Materials and Services

1. The Government will move the sludge dewatering press prior to project commencement.

2. The storage building near the treatment plant will be used to store materials. Building has lighting but no heat source.

9. Delivery Requirements

The contractor shall recognize the timely and accurate performance of these services is a vital and mandatory requirement of the resultant contract. The Contractor shall furnish all items required to successfully complete the tasks identified in the contract. All equipment furnished and used in the performance of the purchase order shall be of the type and durability used by professional construction firms performing water treatment filtration system construction work.

AquaFloc Filters Media Installation Instructions

General Media Installation Information:

Do not let the bags of media be exposed to direct sunlight, as the bags will rot. Outside storage is generally acceptable. Try not to let the media get frozen by storing it outside.

If it does become frozen, it will not become damaged, but it MUST be thawed before it is installed.

Backwash water must be available to clean the media once you complete the installation of the silica sand layer. Installation of all of the gravel layers and the air wash grid can be completed before any backwash water is available. Installation of the sand and anthracite cannot be completed without full backwash flow.

To complete the installation of the media the following water will be required:

1500 gpm Max for 10 - 12 minutes up to 5 backwash cycles for each of the four filters.

To avoid bed upset maximum backwash rate without air scour is 15 gpm/ft2 or 1500 gpm.

All layers except the gravel will need to be skimmed to remove the very fine material.

Operators can choose to backwash at faster rates and longer times as opposed to doing multiple skimmings, but every layer (except gravel) must be skimmed at least once.

There are many ways to get media into the filter safely and effectively. It can be lowered in bags, dropped down a chute, dropped down a pipe, etc. One method that has worked effectively on large filters is to attach a length of hose to the bottom of a drum or basin.

The media is then dumped in the basin and is spread by a person in the filter holding the hose. Otherwise the person in the filter must spread the media with a shovel or rake.

With this technique, the hose must be at least 2-1/2” (fire hose) or larger.

To control dust when placing media in the filter, it is effective to place a garden hose in the chute or pipe that the media pours down. Filter masks must be used to avoid exposure to the silica fines from the sand and gravel.

Normally more media is shipped than is required for the layer depth required. Add only the media required for the proper layer depth of the gravel regardless of quantity shipped. Load all of the sand.

Filter Preparation:

1. With the filter empty, mark the media layers on the wall of the filter in a visible location.

Put Marks at 10-3/4”, 17-3/4” 21-3/4”, 25-3/4”, 29-3/4” from the bottom.

Record the depth of the media (measurement from the top of the filter) for each layer after it has been installed.

2. Check that the filter floor and the laterals are all level. If the floor is not level, level the header and laterals, do not make them parallel to the floor.

3. Install the PVC laterals by screwing the male threaded end into the integral underdrain ports. Hand tighten only. Install with drilled orifices facing the bottom.

Support the end of the lateral at all times. Be careful to avoid cross threading. Use Teflon tape or paste on the threads of the laterals.

Gravel Installation:

All gravel layers can be installed dry.

Procedure

1. After the filter has been prepped, the first layer to be added is the gravel, 1-1/2” x

3/4”. Be very careful not to slip and fall on the underdrain laterals. When slightly less than the calculated amount of gravel has been added, grade the gravel gently to the level of the markings on the wall, adding more media if necessary. Stand on the plywood to avoid upsetting the graded sections.

2. Repeat step one for the 3/4” x 3/8” layer, 3/8” x 3/16” layer, and the 3/16” x 3/32” layer. This is not going to be a quick process, but it is important that the layers be flat and segregated.

Air Wash Installation:

The airwash must be placed after the 3/16” x 3/32” gravel has been installed and before the 2-3 mm gravel.

Procedure

3. Place the header and the support pipes first, securing them into position. Make sure that the header is securely tightened to the filter wall. If air leaks at this point, the airwash will not work and the leak may upset the filter bed.

4. Once the header and supports are in place, thread in the laterals. Make sure that the slots/holes in the lateral pipe are pointing downwards.

Final Gravel Installation:

Procedure

5. Install the 2-3 mm Gravel after the Air Wash Grid has been installed.

If you use a garden hose to control dust, make sure that it is not allowed to run or drip directly onto the media. Even a dripping hose can create a divot in the fine media. Use a spray nozzle instead of open hose.

Workers may not walk directly on the media any more. After the 2-3 mm gravel has been installed pieces of plywood 2’ - 3’ square must be used to evenly distribute the weight of the workers.

After all of the silica gravel is placed the next layer to be added will be the filter sand.

This will be placed in the same manner as the gravel.

Sand Installation:

6. Now the layer of .45-.55 mm sand is ready to be added. This layer is 12” thick. The media must be poured as gently as possible onto the 2-3 mm gravel. Add 1/4 of the sand that has been shipped to each filter. Spread the fine sand equally and level it with a 2x4.

At this point, water will be required to backwash the silica sand.

Backwash/Initial Bed Cleaning

7. Fill the filter at 500 gpm until the water is above the backwash troughs. NEVER BACKWASH AT 15 gpm/ft2 UNLESS THE SAND IS IN AND THE WATER IS POURING

OVER THE BACKWASH TROUGH.

8. Once water starts pouring over the backwash troughs, increase the backwash rate to 15 gpm/ft2 or 1500 gpm. Hold that rate for 10 - 12 minutes. Drain the filter to about 18” below the top of the sand.

9. There should be a layer of fines on the top of the sand. Remove the top ¼” of the sand by undercutting with a flat trowel or shovel and discard. Do not rake the material, as this will cause the fines to be pushed into the filter bed.

10. Repeat steps 7 through 9.

This should remove the extra 1/2” of media that was added in step 3.

At this point all fines should be removed. If they are not, filter runs will be shortened, and backwashing will be needed more frequently than it would be in a fully cleaned bed.

It may be necessary to backwash a third or even up to five times as determined by Filter Tech Systems’ Technical Representative.

SECTION E -- Inspection and Acceptance

E.1 52.236-05 MATERIAL AND WORKMANSHIP APR 1984

(a) All equipment, material, and articles incorporated into the work covered by this contract shall be new and of the most suitable grade for the purpose intended, unless otherwise specifically provided in this contract.

References in the specifications to equipment, material, articles, or patented processes by trade name, make, or catalog number, shall be regarded as establishing a standard of quality and shall not be construed as limiting competition. The Contractor may, at its option, use any equipment, material, article, or process that, in the judgment of the Contracting Officer, is equal to that named in the specifications, unless otherwise specifically provided in this contract.

(b) The Contractor shall obtain the Contracting Officer's approval of the machinery and mechanical and other equipment to be incorporated into the work. When requesting approval, the Contractor shall furnish to the

Contracting Officer the name of the manufacturer, the model number, and other information concerning the performance, capacity, nature, and rating of the machinery and mechanical and other equipment. When required by this contract or by the Contracting Officer, the Contractor shall also obtain the Contracting Officer's approval of the material or articles which the Contractor contemplates incorporating into the work. When requesting approval, the Contractor shall provide full information concerning the material or articles. When directed to do so, the Contractor shall submit samples for approval at the Contractor's expense, with all shipping charges prepaid. Machinery, equipment, material, and articles that do not have the required approval shall be installed or used at the risk of subsequent rejection.

(c) All work under this contract shall be performed in a skillful and workmanlike manner. The Contracting

Officer may require, in writing, that the Contractor remove from the work any employee the ContractingOfficer deems incompetent, careless, or otherwise objectionable.

E.2 52.246-12 INSPECTION OF CONSTRUCTION AUG 1996

(a) Definition - "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not -

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the

Contracting Officer's written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the

Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may -

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or

(2) Terminate for default the Contractor's right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the

Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

E.3 52.246-21 Warranty of Construction MAR 1994

(a) In addition to any other warranties in this contract, the Contractor warrants, except as provided in paragraph

(i) of this clause, that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier.

(b) This warranty shall continue for a period of 1 year from the date of final acceptance of the work. If the

Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of 1 year from the date the Government takes possession.

(c) The Contractor shall remedy at the Contractor’s expense any failure to conform, or any defect. In addition, the Contractor shall remedy at the Contractor’s expense any damage to Government-owned or controlled real or personal property, when that damage is the result of --

(1) The Contractor’s failure to conform to contract requirements; or

(2) Any defect of equipment, material, workmanship, Eor-d2esign furnished.

(d) The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The

Contractor’s warranty with respect to work repaired or replaced will run for 1 year from the date of repair or replacement.

(e) The Contracting Officer shall notify the Contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage.

(f) If the Contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor’s expense.

(g) With respect to all warranties, express or implied, from subcontractors, manufacturers, or suppliers for work performed and materials furnished under this contract, the Contractor shall --

(1) Obtain all warranties that would be given in normal commercial practice;

(2) Require all warranties to be executed, in writing, for the benefit of the Government, if directed by the Contracting Officer; and

(3) Enforce all warranties for the benefit of the Government, if directed by the Contracting Officer.

(h) In the event the Contractor’s warranty under paragraph (b) of this clause has expired, the

Government may bring suit at its expense to enforce a subcontractor’s, manufacturer’s, or supplier’s warranty.

(i) Unless a defect is caused by the negligence of the Contractor or subcontractor or supplier at any tier, the Contractor shall not be liable for the repair of any defects of material or design furnished by the Government nor for the repair of any damage that results from any defect in Government-furnished material or design.

(j) This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes, or fraud.

F.1 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION

F.2 52.242-14 SUSPENSION OF WORK APR 1984

(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.

(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the

Contracting Officer's failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.

(c) A claim under this clause shall not be allowed -

(1) For any costs incurred more than 20 days before the Contractor shall have notified the Contracting

Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and

(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

G.1 1452.201-70 AUTHORITIES AND DELEGATIONS SEP 2011

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The

COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued underparagraph

(e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the…
