QUESTIONS AND ANSWERS
1. Has an SBA class waiver or individual waiver of the nonmanufacturer rule been issued for this acquisition?
a. Yes, a class waiver to the Non-Manufacturer Rule has been issued for this solicitations determined NAICS: 334118.
2. May a qualifying small-business nonmanufacturer offer the 3D Systems SLA 825 Dual and related OEM products under this solicitation?
a. Yes, because the NAICS for this opportunity has been granted an SBA class waiver, and the solicitation has been set aside for small businesses, a non-manufacturer small business may offer products from other than small business manufacturers.
3. May the OEM or an authorized installation subcontractor perform the required delivery, installation, calibration, maintenance and onsite training?
a. See the answer to Question 4 below.
4. The submission requirements request two past-performance examples showing that the “offeror” previously delivered, installed and provided training for the same equipment. May a small-business offeror rely upon and submit the relevant past performance of its proposed OEM, authorized dealer or key subcontractor?
a. The small‑business offeror must demonstrate relevant past performance. This past performance may be based on the offeror’s own prior delivery, installation, or training experience with the same or similar equipment, OR from documented past performance performed in direct partnership with the OEM for the same manufacturer of the products being offered. If the offeror has relevant past performance with the OEM—whether involving the brand name model or a closely related model—the Government will consider that information. Additionally, past performance may be demonstrated through the use of a partnership or subcontract method, where the partner/subcontractor possesses relevant past performance. See the revised Salient Characteristics, section 4.c, Past Performance, for more details.
5. If supplier or key-subcontractor past performance is permitted, should the quotation include a teaming letter or letter of commitment identifying the proposed installation and training provider?
a. Quotes should include enough information to show the offeror meets all technical requirements as stated in; the Submission Requirements section of the Salient Characteristics, and clause FAR 52.212-2, Evaluation.
6. The solicitation requests two relevant past-performance examples involving delivery, installation, and training on the same equipment. Please confirm whether an offeror may satisfy
Solicitation Number: 140R4026Q0034 / 0001 Page 5 of 20 this requirement using the documented past performance of the OEM or authorized installation/training partner that will perform those portions of the order, provided the relationship and responsibilities are clearly identified in the quotation.
a. See the answer to Question 4 above.
7. Please also confirm whether an OEM authorization letter is required and whether a reseller may propose OEM-direct delivery, installation, calibration, training, and warranty support.
a. Yes, an OEM authorization letter is required, see the revised Salient Characteristics section 4.b below. OEM-direct delivery, installation, calibration, training, and warranty support is acceptable.

For each CLIN quoted, the offeror shall submit existing commercial product documentation—such as technical data sheets, cut sheets, or brochures—demonstrating that the offered item meets the salient characteristics listed in this solicitation. Offerors are encouraged, but not required, to annotate or highlight the submitted documentation to identify where each salient characteristic is addressed.
For any item offered as an "equal" product, it is the offeror's responsibility to demonstrate that the offered product meets or exceeds the applicable salient characteristics. Quotes that do not clearly support an equivalency claim may be found technically unacceptable for that item.
All offered accessories, equipment, and software (CLINs 0020–0050, 0090,0100, and 0120-0140) shall be fully compatible with, and capable of operating with, the offered 3D printer. Solicitation Number: 140R4026Q0034 / 0001 Page 16 of 20
(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.
(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.
(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.
(e) Debriefings. If a post award debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

FAR 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL
SERVICES (RFO DEVIATION MAR 2026).
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers in this order:
All evaluation factors are considered equally important, and none carry more weight than the others. In accordance with FAR part 12.203(c)(2), the Government will make an award based on a comparative analysis of –
- Technical Capability —such as technical data sheets, brochures, or other substantiating materials—that clearly demonstrate the offered items meet all required salient characteristics such as technical data sheets, cut sheets, or brochures—demonstrating that the offered item meets the salient characteristics listed in this solicitation.
- Manufacturer Authorization - current and valid letter from the Original Equipment Manufacturer (OEM) confirming the contractor's authorization to sell, distribute, and/or provide warranty and maintenance support for that printer.
- Past Performance – The offeror’s record of relevant, recent performance.
- Delivery – The offeror’s ability to meet delivery schedules and any associated logistics requirements.
- Price.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(1) A citizen or resident of the United States;
(2) A domestic partnership;
(3) A domestic corporation;

Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C.
5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.

(f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229- 12, Tax on Certain Foreign Procurements, in any resulting contract.
(g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction.
This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts.
