1.03 WORK RESTRICTIONS

A. Potomac Dam No. 5 is a run-of-the river structure. The facility is owned by the National Park Service (NPS), Chesapeake & Ohio Canal National Historical Park (CHOH). The dam is operated and maintained by CHOH. The hydroelectric plant on the West Virginia side of the Potomac River is operated by Eagle Creek Renewable Energy. NPS is responsible for maintenance, routine dam safety monitoring, and implementation of dam safety decisions.

B. Maintain access for Government personnel to Potomac Dam No. 5 at all times throughout construction. Do not impede access to any facilities on the West Virginia side of the Potomac River operated by Eagle Creek Renewable Energy.

C. In-stream work on the Potomac River is not allowed from March 1 to June 15 inclusive, each year due to fish spawning unless a Time of Year (TOY) waiver is granted from Maryland Department of the Environment (MDE). A TOY waiver is being pursued as part of the MDE waterway and wetland authorization.

D. Eel migration occurs in the river each year between September 15 and December 15.

Operation of the turbines, and associated flows through the powerplant are restricted at night by Federal Energy Regulatory Commission (FERC) due to the migration. The flow difference is approximately 1,000 cubic feet per second (cfs), which may not be noticeable at high flow times. However, it may have minor effects to construction during low flow times.

01 14 12 - 2

E. Public access along the canal towpath in the work site area will remain closed to the public throughout construction operations. A canal towpath detour shall be provided.

Refer to Section 02 04 10 – Towpath Detour.

F. The Contractor shall maintain public use of roadways throughout the area.

G. Tree clearing of trees greater than 3 inches in diameter, both live and dead trees, is not allowed between June 1 and July 31 due to the trees providing northern long-eared bat habitat.
