(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(c) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.
(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.
(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.
(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

(4) A summary of the rationale for award.
(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.
(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.
Addendum to
FAR 52.212-1
Instructions to Offerors–Commercial Products and Commercial Services
(RFO DEVIATION)
Mar 2026
This addendum replaces the terms “offer” with “quote” within provision 52.212-1.
In addition to the requirements of the Instructions to Offerors - each offeror shall submit a quote in accordance with the instructions contained in this provision.
1) To assure timely and equitable evaluation of quotations, vendors must submit all data and information in the instructions contained herein. Vendors are required to meet all applicable RFQ requirements for each CLIN quoted, including terms and conditions, and those identified as evaluation factors. Failure to meet a requirement may result in a quote being ineligible for award. Vendors must clearly identify any exceptions to the RFQ’s terms and conditions and provide complete rationale. The Government reserves the right to accept a quote in whole or in part and may award one, multiple, or all CLINs if determined to be in the best interest of the Government. Quotes must be complete, self-sufficient, and respond directly to the requirements of this RFQ, alternate offers will not be accepted. Quotes shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims.
2) Upon examination of the initial responses, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists, no additional data will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists, the contracting officer may use any of the methods listed in FAR 13.106-3(a)(2) to make a price reasonableness determination.
3) If this solicitation is amended, all terms and conditions that are not amended remain unchanged and in full force and effect. Vendors shall acknowledge receipt of any amendment and provide confirmation upon submission of the offeror’s quote.
4) Quote Instructions: Quoters are required to submit the following information with their quote:
(a) Product Identification. For each line item quoted, the quoter shall clearly identify the exact product being offered, including the manufacturer, make, model number, and part number, as applicable. If the quoter’s commercial quote, catalog, price sheet, or supporting documentation uses product numbers, model numbers, or part numbers that differ from the CLIN structure or item identification used in this solicitation, the quoter shall clearly cross reference each quoted product to the applicable CLIN. Any commercial quote or supporting documentation submitted with the quote shall be organized or annotated in a manner that clearly correlates each quoted item to the corresponding CLIN. Failure to clearly identify quoted products to the applicable CLINs may render the quotation unacceptable.
(b) Technical Documentation. The quoter shall submit sufficient descriptive literature, specifications, cut sheets, drawings, or other technical documentation for each item quoted to enable the Government to determine compliance with the solicitation requirements. For any item identified in the solicitation as brand name or equal, the quoter shall submit sufficient documentation to demonstrate that the product offered conforms to the solicitation requirements, including any stated salient physical, functional, or performance characteristics.
(c) Delivery. The quoter shall state its ability to complete delivery of all required items on or before December 31, 2026, to the destination identified in the solicitation. The quoter shall provide a proposed delivery date with the quote. Delivery terms shall be F.O.B. destination.

For each reference, the quoter shall provide the project or contract name, description of work, contract number, period of performance, client name, point of contact, telephone number, and email address.
(e) Small Business Participation. Offerors classified as small business (SB) under NAICS 333310 Commercial and Service Industry Machinery, are not required to submit documentation under this evaluation factor.
Offerors classified as other than small business under NAICS 333310 must submit two separate documents in response to this evaluation factor: Small Business Subcontracting Plan (Attachment #1) and the Small Business Participation Document (SBPD). The SBPD and Small Business Subcontracting Plan are two separate documents. Both will be incorporated into any resulting contract.
Other than small business offerors must submit a SBPD using contractor format that includes the following:
1. Identify the extent of participation of small business prime offerors and small business subcontractors in terms of the total contract value (not as a percentage of the subcontracted contract value). Offerors shall provide documentation to support proposed participation values.
2. Summarize small business participation using the chart below to identify the subcontracting opportunities as a percentage of the total contract value.
Business Category Subcontract ing Goals
Dollar Value (Offeror Fill-in)
% of Total Contr act Va lue (Offer or Fill-in)
Total Proposed Contract Value – Prime Offeror - $ %
Total Small Business 45.87% $ % Small Disadvantaged Business (SDB) 5% $ % Woman-Owned Small Business (WOSB) 5% $ % HUBZone Small Business (HUBZone) 3% $ % Service-Disabled Veteran-Owned Small Business

4. Identify the type and variety of the work the small business subcontractors are to perform (i.e., binding commitments submitted in response to this evaluation factor will become enforceable/contractual requirements). Small business goals submitted in response to this evaluation factor must be consistent with the offeror’s Small Business Subcontracting Plan. If the proposed subcontracting goals do not meet the minimum Department of Interior subcontracting goals, include a detailed explanation describing the actions taken to include small business concerns and arrive at that determination, along with an explanation for the goals proposed.

The Small Business Subcontracting Plan must be tailored to this procurement and should not conflict with the SBPD. Note: Subcontracting Plans will only be reviewed for acceptability for those Offeror(s) deemed to be apparent awardee(s). If the apparent awardee’s Subcontracting Plan is not initially acceptable, the Contracting Officer may engage in clarifications regarding the Subcontracting Plan and this shall not be deemed discussions.
(f) Price Submission. The quoter shall provide a unit price, quantity, and extended total price for each CLIN included in the solicitation. All applicable discounts shall be identified and included in the quote. The quote shall reflect the quoters best and final pricing. Quoted prices shall be inclusive of all costs, including packing, handling, shipping, and delivery to the destination specified in the solicitation. No separate freight, shipping, handling, or delivery charges will be paid by the Government. Delivery terms shall be F.O.B Destination.

FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (RFO
DEVIATION)
(a) The Government will award a firm-fixed price purchase order resulting from this solicitation to the responsive quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate the quotes:
Factor 1- Technical Capability Factor 2- Price Factor 3- Past Performance Factor 4 - Small Business Participation
Factor 1 – Technical Capability: The Government will evaluate the quotes to determine whether the product(s) offered meet the requirements of the solicitation. The evaluation will be based on the information submitted with the quotation, including the manufacturer, make, model number, part number, and supporting descriptive literature or other technical documentation for each line item quoted. For any item identified as brand name or equal, the government will evaluate whether the item offered meets the salient physical, functional, and performance characteristics identified in the solicitation.
The government will evaluate technical capability based on the information submitted in the quote. Failure to provide sufficient supporting documentation may result in the quote being rated unacceptable under this factor.
Factor 2 – Price: The Government will evaluate quoted prices for reasonableness and, if applicable balance. Price may be evaluated using one or more price analysis techniques. The Government may consider the total evaluated price in determining which quote provides the best value to the Government.
Factor 3 – Past Performance: The Government will evaluate the quoter’s past performance to assess the degree of confidence the Government has in the quoter’s ability to successfully provide the required product(s). The Government may consider the quality of performance, timeliness of delivery, and customer satisfaction. The Government may use information obtained from other sources, including CPARS.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Factor 4 – Small Business Participation
All offerors (both other than small businesses and small businesses) will be evaluated on the extent of proposed participation/commitment to use U.S. small businesses in the performance of this acquisition (as small business prime offerors or small business subcontractors) relative to the objectives and requirements established herein. Small business offerors classified as small business (SB) under NAICS 333310 Commercial and Service Industry Machinery, self-certified in SAM.gov will receive the maximum credit for this evaluation factor and do not need to submit any documentation supporting this evaluation factor. DIAR 1452.215-71 Use and Disclosure of Proposal Information—Department of the
Interior Apr 1984
(a) Definitions. For the purposes of this provision and the Freedom of Information Act (5 U.S.C. 552), the following terms shall have the meaning set forth below:
(1) "Trade Secret" means an unpatented, secret, commercially valuable plan, appliance, formula, or process, which is used for making, preparing, compounding, treating or processing articles or materials which are trade commodities.
(2) "Confidential commercial or financial information" means any business information (other than trade secrets) which is exempt from the mandatory disclosure requirement of the Freedom of Information Act, 5 U.S.C. 552.
Exemptions from mandatory disclosure which may be applicable to business information contained in proposals include exemption (4), which covers "commercial and financial information obtained from a person and privileged or confidential," and exemption (9), which covers "geological and geophysical information, including maps, concerning wells."
(b) If the offeror, or its subcontractor(s), believes that the proposal contains trade secrets or confidential commercial or financial information exempt from disclosure under the Freedom of Information Act, (5 U.S.C.
552), the cover page of each copy of the proposal shall be marked with the following legend:
"The information specifically identified on pages of this proposal constitutes trade secrets or confidential commercial and financial information which the offeror believes to be exempt from disclosure under the Freedom of Information Act. The offeror requests that this information not be disclosed to the public, except as may be required by law. The offeror also requests that this information not be used in whole or part by the government for any purpose other than to evaluate the proposal, except that if a contract is awarded to the offeror as a result of or in connection with the submission of the proposal, the Government shall have the right to use the information to the extent provided in the contract."
(c) The offeror shall also specifically identify trade secret information and confidential commercial and financial information on the pages of the proposal on which it appears and shall mark each such page with the following legend:
"This page contains trade secrets or confidential commercial and financial information which the offeror believes to be exempt from disclosure under the Freedom of Information Act and which is subject to the legend contained on the cover page of this proposal."
(d) Information in a proposal identified by an offeror as trade secret information or confidential commercial and financial information shall be used by the Government only for the purpose of evaluating the proposal, except that
(i) if a contract is awarded to the offeror as a result of or in connection with submission of the proposal, the Government shall have the right to use the information as provided in the contract, and (ii) if the same information is obtained from another source without restriction it may be used without restriction.
(e) If a request under the Freedom of Information Act seeks access to information in a proposal identified as trade secret information or confidential commercial and financial information, full consideration will be given to the offeror's view that the information constitutes trade secrets or confidential commercial or financial information. The offeror will also be promptly notified of the request and given an opportunity to provide additional evidence and argument in support of its position, unless administratively unfeasible to do so. If it is determined that information claimed by the offeror to be trade secret information or confidential commercial or financial information is not exempt from disclosure under the Freedom of Information Act, the offeror will be notified of this determination prior to disclosure of the information.
(f) The Government assumes no liability for the disclosure or use of information contained in a proposal if not marked in accordance with paragraphs (b) and (c) of this provision. If a request under the Freedom of Information Act is made for information in a proposal not marked in accordance with paragraphs (b) and (c) of this provision, the offeror concerned shall be promptly notified of the request and given an opportunity to provide its position to the Government. Yuma Desalting Plant Pressure Vessel Replacement Colorado River Basin Salinity Control Project Solicitation No. 140R3026Q0091
Pressure Vessels, Grooved Mechanical Couplings, and Gaskets for Grooved Mechanical Couplings
YUMA DESALTING PLANT PRESSURE VESSELS
AND GROOVED MECHANICAL COUPLING COMPONENTS
Part 1 Background The Bureau of Reclamation’s (Reclamation) Yuma Desalting Plant (YDP) is 73-million Gallon per day rated brackish water desalination facility utilizing Reverse Osmosis (RO) technology. When the facility was designed in the 1980’s the market for RO membrane elements had yet to converge on a standard element size, and the plant was designed to operate with 12-inch (in) and 8.5-in diameter elements. Since that time the market has converged on standard sizes of 8-in and 4-in diameter elements. This has resulted in limited availability of 12-in and 8.5-in elements. To increase the number of potential membrane element suppliers Reclamation has decided to retrofit the YDP with 8-in diameter pressure vessels (PV).
The YDP originally had 720 of the 8.5-in diameter PVs installed. Due to the availability of 8-in membrane elements with the same active membrane area as the 8.5-in, the 8.5-in PVs will be replaced with 8-in PVs on a one-to-one basis, which have already been purchased. To continue the retrofit for this section, Reclamation requires the purchase of 720 grooved mechanical couplings, and new gaskets for the couplings on hand. The grooved mechanical couplings have been chosen for interoperability with the existing connections. In the coming years, more equipment will be required to complete the retrofit.
Separate sections of the YDP originally had 1,080 of the 12-in diameter PVs, which will be replaced with an estimated 1,890 of the 8-in PVs. This increase in the number of pressure vessels, and therefore connections, will require new design efforts for completion. The typical feed pressure of the RO system is
300 pounds per square inch (psi); however, the piping and pumps are designed for a maximum feed pressure of 500 psi. To ensure safe operation, the supplied PVs must be designed for an operating pressure of at least 600 psi.
