WBR 1413.106-1 Template 1 (11/2020)

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Interior Region 8: Lower Colorado Basin.

2. Name and Address of Single Source.

Mann+Hummel Water & Fluid Solutions, Inc.

93 S La Patera LN Goleta, California 93117-3246, United States

3. Description of Supplies/Services and Estimated Cost. The Bureau of Reclamation, Yuma Area Office, has a requirement for the purchase of 112 Trisep brand owned by Mann+Hummel Water & Fluid Solutions, Inc. industrial sized (8-inch) cellulose acetate reverse osmosis membranes for use in the Yuma Desalting Plant for the treatment of Welton- Mohawk brackish groundwater. The delivery is expected to be 20 weeks after receipt of order with an estimated value of $96,824.00. There are several distributors that can meet the requirement therefore this is a brand name justification.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(ii), specific characteristics of the Trisep reverse osmosis membranes that limit the availability to a sole source is due to the size and type of material of the reverse osmosis membranes that are compatible with pilot system one at the Yuma Desalting Plant. Only this suggested source can furnish the requirements, to the exclusion of other sources, because Trisep brand model 8040-SB20-TSFA has characteristics that are compatible with pilot system one due to type of material of cellulose acetate and size industrial 8-inch reverse osmosis membranes.

5. Determination of Fair and Reasonable Price. . In accordance with FAR 13.106-3(a)(1), price will be determined fair and reasonable based on competitive quotes. This requirement will be a total small business set aside therefore competition is expected.

6. Description of Market Research. Market research was conducted and determined that only Trisep brand can meet the requirement due to the only brand that can meet the material type and size of reverse osmosis membranes. Suez is another brand that can provide this requirement however a separate requirement will be solicited for reverse osmosis membranes.
