Lahontan Basin Area Office, Carson City, Nevada

July 2024

1. GENERAL INFORMATION: The Blanket Purchase Agreement (BPA) Holder/Contractor shall provide necessary and qualified personnel, facilities, equipment, transportation, and materials required to provide non-aquatic and aquatic vegetation treatment application and dead vegetation removal services for Derby Dam, Prosser Creek Dam, and

Stampede Dam and Dikes under the jurisdiction of the United States Bureau of Reclamation (USBR), Lahontan Basin

Area Office (LBAO). The BPA Holder/Contractor shall ensure that good business and management practices are followed in performing the ordered services, such that the Government receives the greatest value for the services provided.

a. Background: Derby Dam is a diversion dam on the Truckee River, located between Reno and Fernley in in Storey and Washoe Counties, Nevada; approximately 20 miles east of Reno, Nevada. The dam consists of a concrete buttress style gated spillway structure, a canal headworks, and an embankment wing. The facility also includes a rock lined

Fishway located in the embankment wing, and a recently constructed Fishscreen. The embankment wing is located on the left abutments and has an upstream face that is partially protected by riprap. The northern end of the embankment wing contains a low section referred to as a “soft plug” and serves as an emergency spillway. The Fishscreen includes an array of five (5) horizontal fish screens and provides flow into the Truckee Canal. The Fishscreen includes access roads that need to remain free of vegetation to complete maintenance and perform visual inspections of the screens as needed. The area to be treated at Derby Dam includes the roadways within the project area, the upstream and downstream dam faces, the Fishway channel and slopes, and the emergency spillway channel. The area that requires vegetation management for this facility is approximately 13 acres. The 13 acres includes approximately 4.9 acres of non-aquatic vegetation treatment application services, 1.2 acres of aquatic vegetation treatment application services, and approximately 6.9 acres of hand-applied aquatic vegetation treatment application services targeting Purple

Loosestrife (refer to Figure 1). Vegetation removal services shall be performed on the 13 acres shown in Figure 1.

Prosser Creek Dam is in Nevada County, California; approximately 1½ miles upstream of Truckee River and about four miles northeast of Truckee, California. The dam is a zoned earthfill structure with a structural height of 165.6 feet and a crest length of 1,830 feet. The area to be treated at Prosser Dam includes the downstream face (25 feet beyond the groins and 50 feet beyond the downstream toe), the toe drain channel, the well-vegetated (dark green) area at the right toe, and the top 1/3 of the upstream face (25 feet beyond the groin and a finger section between the reservoir and spillway channel). The approximate acreage that requires vegetation management is 11.9 acres. The 11.9 acres includes approximately 11.3 acres of non-aquatic vegetation treatment application services and 0.6 acres of aquatic vegetation treatment application services (refer to Figure 2). Vegetation removal services shall be performed on the 11.9 acres shown in Figure 2.

Stampede Dam is in Sierra County, California; approximately 11 miles northeast of Truckee, California. Stampede

Dam has a height of approximately 250 feet, with a crest length of 1,511 feet. Stampede Dam includes the original dike and two saddle dikes, the east and west, which were constructed as part of a recent modification at topographic lows along the reservoir rim for impounding extreme floods. The original dike is a zoned earthfill approximately

1,449 feet long, with a maximum structural height of 85 feet, a crest width of 40 feet at elevation 5,974 feet and extends across a saddle on the south side of the reservoir about 1,200 feet from the right abutment of the dam. The saddle dikes are homogeneous earthfill embankments, with a 10-foot-wide crest. The east dike has a structural height of 19.5 feet and the west dike has a structural height of 4.5 feet. The original dike, the two saddle dikes, and the dam’s downstream face require vegetation treatment 25 feet beyond the groin and 50 feet beyond the toe on all features.

Additionally, the toe drain channel to the convergence with natural drainage from left and the top 1/3 upstream face of dam are the other areas requiring treatment at Stampede Dam. The total vegetation treatment area for the dam and dikes is approximately 24 acres. The 24 acres includes approximately 22.7 acres of non-aquatic vegetation treatment application services and approximately 1.3 acres of aquatic vegetation treatment application services (see Figure 3 and

Figure 4). Vegetation removal services shall be performed on the 24 acres shown in Figure 3 and Figure 4.

LBAO requires vegetation application treatments and dead vegetation removal at Derby Dam, Prosser Creek Dam, and Stampede Dam and dikes to continue performing adequate visual inspections as well as maintain access to roads and all other pertinent facility features. All work performed on this project shall be done in accordance with applicable federal safety practices. Federal and safety practices include, but are not limited to items outlined in the

Reclamation Directives and Standards (https://www.usbr.gov/recman/) and the Reclamation Safety and Health

Standards (RSHS) (https://www.usbr.gov/ssle/safety/). Approved chemicals that may be used for vegetation management practices on Reclamation Land are provided by the U.S. Bureau of Land Management (refer to Section

6. General Requirements for more information).

b. Government Regular Working Hours: The government regular working hours at all facilities included in this blanket purchase agreement are between 7:30 A.M and 4:00 P.M., Monday through Friday, except for federal holidays and other days specifically designated by the Contracting Officer. Federal holidays include New Year’s Day, Martin Luther King Jr.’s Birthday, Presidents Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, Christmas Eve, and Christmas Day.

The Contractor shall schedule regular working hours between 7:30 A.M. and 4:00 P.M., Monday through Friday, except for federal holidays. After-regular-working hours are the hours not included in the regular hours as described and include weekends and holidays.

2. TASKS: This Blanket Purchase Agreement shall cover requirements to complete the application of vegetation treatments and dead vegetation removal services to Reclamation facilities, including Derby Dam, Prosser Creek Dam, and

Stampede Dam and Dikes. The Contractor shall provide all labor, administration, transportation, equipment, materials, supervision, and personnel necessary to complete the project tasks and vegetation management work at the listed

Reclamation facilities.

2.1 TASK 1 – Annual Management Site Visit, Vegetation Management Work Plan, and Site-Specific Hazard

Analysis Plan

2.1.1 Management Site Visits

Reclamation will schedule a kick-off meeting with the Contractor to review the tasks, schedule, and funding. Reclamation will schedule a mandatory site visit each year prior to the update of the Work Plan; and as applicable before onsite treatments or vegetation removal occur.

Deliverable

The Contractor and LBAO will determine the baseline schedule, potential risks, and evaluate task needs. The Contractor will evaluate the vegetation species that are present, recommend treatment methods, and determine the effectiveness of the previous season treatments for vegetation.

2.1.2 Vegetation Management Work Plan

The Contractor shall develop a Vegetation Management Work Plan (Work Plan) that will be updated prior to each management season. The Work Plan shall cover the applicable period of performance.

https://www.usbr.gov/recman/ https://www.usbr.gov/ssle/safety/

The Work Plan will provide recommendations of chemical use and outline the proposed method and timing necessary for the elimination of vegetation from the treatment area. The Work Plan will include a proposed timetable for vegetation treatment along with the chemicals and their application rates proposed for each target species noted at each project site.

Additionally, the Work Plan shall outline the proposed dates for removal of dead vegetation that resulted from previous or current vegetation treatment practices. The Work Plan shall also describe the effectiveness of the previous season treatments for target vegetation and recommend changes as applicable.

The Contractor shall include in the Work Plan steps to be taken to prevent the unauthorized release of any chemicals, and the steps to be taken to remediate an unauthorized chemical release (including clean-up procedures to be undertaken) allowing for the protection of the visiting public, workers, Reclamation employees, neighbors/adjoining property owners, and the environment.

The Work Plan shall include all managerial and administrative duties the Contractor must perform to manage this blanket purchase agreement. Some of the project management duties shall include:

Officer or employee of an agency includes the following individuals who are employed by an agency:

(1) An individual who is appointed to a position in the Government under Title 5, United States Code, including a position under a temporary appointment.

This term excludes an Indian tribe, tribal organization, or any other Indian organization eligible to receive Federal contracts, grants, cooperative agreements, or loans from an agency, but only with respect to expenditures by such tribe or organization that are made for purposes specified in paragraph (b) of this clause and are permitted by other Federal law.

Reasonable compensation means, with respect to a regularly employed officer or employee of any person, compensation that is consistent with the normal compensation for such officer or employee for work that is not furnished to, not funded by, or not furnished in cooperation with the Federal Government.

Reasonable payment means, with respect to professional and other technical services, a payment in an amount that is consistent with the amount normally paid for such services in the private sector.

Regularly employed means, with respect to an officer or employee of a person requesting or receiving a Federal contract, an officer or employee who is employed by such person for at least 130 working days within 1 year immediately preceding the date of the submission that initiates agency consideration of such person for receipt of such contract. State means a State of the United States, the District of Columbia, or an outlying area of the United States, an agency or instrumentality of a State, and multi-State, regional, or interstate entity having governmental duties and powers.

(b) Prohibition. 31 U.S.C. 1352 prohibits a recipient of a Federal contract, grant, loan, or cooperative agreement from using appropriated funds to pay any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with any covered Federal actions. In accordance with 31 U.S.C. 1352 the Contractor shall not use appropriated funds to pay any person for influencing or attempting to influence an officer or employee of any agency, a Member of

Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the award of this contractor the extension, continuation, renewal, amendment, or modification of this contract.

(1) The term appropriated funds does not include profit or fee from a covered Federal action.

(2) To the extent the Contractor can demonstrate that the Contractor has sufficient monies, other than Federal appropriated funds, the Government will assume that these other monies were spent for any influencing activities that would be unallowable if paid for with Federal appropriated funds.

(c) Exceptions. The prohibition in paragraph (b) of this clause does not apply under the following conditions:

(1) Agency and legislative liaison by Contractor employees. (i) Payment of reasonable compensation made to an officer or employee of the Contractor if the payment is for agency and legislative liaison activities not directly related to this contract. For purposes of this paragraph, providing any information specifically requested by an agency or Congress is permitted at any time.

(ii) Participating with an agency in discussions that are not related to a specific solicitation for any covered Federal action, but that concern-

(A) The qualities and characteristics (including individual demonstrations) of the person’s products or services, conditions or terms of sale, and service capabilities; or

(B) The application or adaptation of the person’s products or services for an agency’s use.

(iii) Providing prior to formal solicitation of any covered Federal action any information not specifically requested but necessary for an agency to make an informed decision about initiation of a covered Federal action;

(iv) Participating in technical discussions regarding the preparation of an unsolicited proposal prior to its official submission; and

(v) Making capability presentations prior to formal solicitation of any covered Federal action by persons seeking awards from an agency pursuant to the provisions of the Small Business Act, as amended by Pub. L. 95-507, and subsequent amendments.

(2) Professional and technical services. (i) A payment of reasonable compensation made to an officer or employee of a person requesting or receiving a covered Federal action or an extension, continuation, renewal, amendment, or modification of a covered Federal action, if payment is for professional or technical services rendered directly in the preparation, submission, or negotiation of any bid, proposal, or application for that Federal action or for meeting requirements imposed by or pursuant to law as a condition for receiving that Federal action.

(ii) Any reasonable payment to a person, other than an officer or employee of a person requesting or receiving a covered

Federal action or an extension, continuation, renewal, amendment, or modification of a covered Federal action if the payment is for professional or technical services rendered directly in the preparation, submission, or negotiation of any bid, proposal, or application for that Federal action or for meeting requirements imposed by or pursuant to law as a condition for receiving that Federal action. Persons other than officers or employees of a person requesting or receiving a covered Federal action include consultants and trade associations.

(iii) As used in paragraph (c)(2) of this clause, "professional and technical services" are limited to advice and analysis directly applying any professional or technical discipline (for examples, see FAR 3.803(a)(2)(iii)).

(iv) Requirements imposed by or pursuant to law as a condition for receiving a covered Federal award include those required by law or regulation and any other requirements in the actual award documents.

(3) Only those communications and services expressly authorized by paragraphs (c)(1) and (2) of this clause are permitted.

(d) Disclosure. (1) If the Contractor did not submit OMB Standard Form LLL, Disclosure of Lobbying Activities, with its offer, but registrants under the Lobbying Disclosure Act of 1995 have subsequently made a lobbying contact on behalf of the Contractor with respect to this contract, the Contractor shall complete and submit OMB Standard Form LLL to provide the name of the lobbying registrants, including the individuals performing the services.

(2) If the Contractor did submit OMB Standard Form LLL disclosure pursuant to paragraph (d) of the provision at FAR

52.203-11, Certification and Disclosure Regarding Payments to Influence Certain Federal Transactions, and a change occurs that affects Block 10 of the OMB Standard Form LLL (name and address of lobbying registrant or individuals performing services), the Contractor shall, at the end of the calendar quarter in which the change occurs, submit to the

Contracting Officer within 30 days an updated disclosure using OMB Standard Form LLL.

(e) Penalties. (1) Any person who makes an expenditure prohibited under paragraph (b) of this clause or who fails to file or amend the disclosure to be filed or amended by paragraph (d) of this clause shall be subject to civil penalties as provided for by 31 U.S.C. 1352. An imposition of a civil penalty does not prevent the Government from seeking any other remedy that may be applicable.

(2) Contractors may rely without liability on the representation made by their subcontractors in the certification and disclosure form.

(f) Cost allowability. Nothing in this clause makes allowable or reasonable any costs which would otherwise be unallowable or unreasonable. Conversely, costs made specifically unallowable by the requirements in this clause will not be made allowable under any other provision.

(g) Subcontracts. (1) The Contractor shall obtain a declaration, including the certification and disclosure in paragraphs (c) and (d) of the provision at 52.203-11, Certification and Disclosure Regarding Payments to Influence Certain Federal

Transactions, from each person requesting or receiving a subcontract under this contract that exceeds the threshold specified in FAR 3.808 on the date of subcontract award. The Contractor or subcontractor that awards the subcontract shall retain the declaration.

(2) A copy of each subcontractor disclosure form (but not certifications) shall be forwarded from tier to tier until received by the prime Contractor. The prime Contractor shall, at the end of the calendar quarter in which the disclosure form is submitted by the subcontractor, submit to the Contracting Officer within 30 days a copy of all disclosures. Each subcontractor certification shall be retained in the subcontract file of the awarding Contractor.

(3) The Contractor shall include the substance of this clause, including this paragraph (g), in any subcontract that exceeds the threshold specified in FAR 3.808 on the date of subcontract award.

(End of clause)
