STATEMENT OF WORK
Reclamation is implementing the B.F. Sisk Safety of Dam Modification project located in Merced County. Section 404 of the Clean Water Act (CWA) requires compensatory mitigation for unavoidable adverse impacts to Waters of the U.S. The U.S. Army Corps of Engineers issued a 404-permit the Project on January 27, 2022. On June 15, 2023, Reclamation submitted a 404-permit amendment to the U.S.
Army Corps of Engineers with an additional 0.57 acres of impacts to Waters of the U.S. The amended 404 permit requires Reclamation to purchase 1.71 Aquatic Resource Credits in the San Joaquin River Watershed Service Area from the National Fish and Wildlife Foundation’s In-Lieu-Fee Program. The Central Valley Regional Water Quality Control Board issued a CWA 401 Water Quality Certification for impacts directly associated with the project in 2023. DOI-AAAP-0050 Contractor Performance Assessment Reporting System
(CPARS)
May 2018
1. Use PPIRS for past performance information during source selection 1.1. To meet the requirements of FAR 15.304(c)(3)(i), the Contracting Officer (CO) or Contract Specialist (CS) shall retrieve past performance information from PPIRS (www.ppirs.gov) for use in the source selection process for all negotiated competitive acquisitions expected to exceed the simplified acquisition threshold, unless they have documented the reason past performance is not an appropriate evaluation factor in accordance with FAR 15.304(c)(3)(iii). The CO and source selection official may also consider past performance information when making awards under existing contract vehicles such as Federal Supply Schedule (FSS) contracts and Government-wide Acquisition Contracts (GWACs).
1.2. Potential offerors shall be notified in the solicitation that PPIRS will be used as a source of past performance information in the source selection process, in addition to any other past performance information required under the solicitation. The CO shall ensure that available, relevant reports contained in PPIRS are provided to the evaluation team and used in the source selection process. Any reports used must be retained in the record of the evaluation.
https://www.ipp.gov/ mailto:ippgroup@bos.frb.org
2. Use CPARS for reporting past performance evaluations
2.1. The Office of Acquisition and Property Management (PAM) has a Memorandum of Understanding with the Defense Procurement and Acquisition Policy Office to use CPARS to meet the requirements of FAR
42.1502 for preparing past performance evaluations. Use of CPARS as the mechanism for completing past performance evaluations is mandatory. 2.2. In accordance with FAR 42.1502, past performance evaluations shall be prepared for the following eligible contract actions:
■ Supplies and services contracts exceeding the simplified acquisition threshold (including DOI Indefinite Delivery Vehicles (IDV));
■ Orders under single-agency contracts;
■ Task and delivery orders exceeding the simplified acquisition threshold against FSS contracts, GWACs, and multi-agency contracts;
■ Construction contracts of $700,000 or more, and each construction contract terminated for default regardless of dollar value; and
■ Architect-engineer services contracts of $35,000 or more, and each architect-engineer services contract terminated for default regardless of dollar value.
2.3. For contracts that meet the thresholds above and which have a total period of performance that exceeds 12 months, interim evaluations must be prepared at least annually.
2.4. For contracts with a base period of one year followed by one or more one-year option periods, evaluations must be completed after the base period and at the end of each option period.
2.5. For those contract actions identified above, a final past performance evaluation must be prepared at contract completion.
2.6. For contracts that follow a different structure, the CO shall use business judgment to determine the appropriate evaluation schedule. An evaluation in CPARS cannot cover a period of time that exceeds 12 months.
2.7. Evaluations must be completed within 120 days after the end of the assessment period. This time frame includes the required 60-day contractor comment period.
2.8. Past-performance evaluations for contracts that contain a Small Business Subcontracting Plan must include an assessment of contractor performance against, and efforts to achieve, the goals identified in the plan.
2.9. IDVs that are awarded by DOI and have a total value expected to exceed the relevant threshold fall under this CPARS requirement.
■ Blanket Purchase Agreements (BPA) and Basic Ordering Agreements (BOA): For BPA and BOA orders/calls, CPARS must be completed on each order/call meeting the reporting threshold, and not on the base agreement.
■ All other single-agency indefinite-delivery contracts: There are two possible methods of reporting for these contracts. Past performance evaluations shall either be prepared for each individual order or at the IDV level.
● IDV level (base contract) reporting: For IDVs where the majority of the orders are substantially similar in size, scope, and complexity, past performance evaluations may be prepared at the IDV level. For such IDVs, one past performance evaluation that evaluates performance on all orders would be prepared for each 12-month period of the contract. An example of a contract for which this type of reporting is appropriate would be an IDV for aviation services where each order is for flight services. Note that if the base contract is evaluated, then none of the orders placed against it should be evaluated individually, and the contract number in CPARS should reflect the base contract number only.
● Order level reporting: For IDVs where the orders are not similar in size, scope, or complexity, past performance evaluations should be prepared at the order level for all orders that exceed the relevant dollar threshold. In this case, each order would be treated as if it were a contract of the same dollar amount and duration. For each order evaluated individually, the contract number in CPARS should reflect the base contract number and the order number should reflect the individual order number.
2.10. BPCs may establish thresholds lower than those identified above and may require past performance evaluations to be completed for additional types of contract actions. BPCs may also prohibit the use of CPARS for actions below these thresholds within their bureau or office.
3. Use FAPIIS for reporting contractor responsibility information
3.1. FAPIIS is a module within CPARS that is used to collect contractor responsibility information. Once records are entered in FAPIIS, they become available in PPIRS for retrieval. Use of the FAPIIS module is mandatory per FAR 9.1.
3.2. The FAR requires COs to check contractor performance and integrity information found in the FAPIIS module of PPIRS prior to awarding a contract in excess of the simplified acquisition threshold, and to document how this information was used in the responsibility determination.
3.3. COs are required to enter information into FAPIIS (through CPARS) within 3 calendar days when taking any of the following actions:
■ Terminations for default,
■ Terminations for cause,
■ Defective pricing, and
■ Non-responsibility determinations. 3.4. In accordance with DOI-AAAP-0056, Referrals to the DOI Suspending and Debarring Official, COs must forward a copy of each final termination for default or cause decision to the DOl Office of lnspector General (OIG) Administrative Remedies Division for evaluation and where appropriate preparation of a suspension or debarment referral to the DOI Suspending and Debarring Official (SDO).
3.5. Financial Assistance Agreement Officers are responsible for the following actions:
■ Forward a copy of each final award termination for nonperformance or material failure to perform determination under 2 CFR 200.339 or 2 CFR 200.213; or termination action under 2 CFR 180.440, 2 CFR 180.445, or 2 CFR 180.450 to the DOl Office of lnspector General Administrative Remedies Division for evaluation and, where appropriate, preparation of a suspension or debarment referral to the
SDO.
4. Ensure access to PPIRS, CPARS, and FAPIIS
■ For PPIRS, each bureau must have a point of contact (Group Owner) and may also have an alternate point of contact (Group Manager). Access is requested through the DOI Group Owner/Manager. All other DOI personnel shall obtain access to PPIRS by submitting a request through the PPIRS website; the bureau Group Owner/Manager will either approve or deny the request.
■ Each bureau shall appoint an Agency Point of Contact (APOC) for CPARS and FAPIIS.
■ BPCs shall designate Focal Points for the bureau; the number of Focal Points will vary from bureau to bureau according to the needs of each organization. For CPARS and FAPIIS, new users must be entered into the system by a Focal Point.
4.2. BPCs may establish additional roles and responsibilities necessary to implement the requirements outlined in this policy.
5. Provide Notice to Contractors 5.1. COs must include the CPARS Notice to Contractors in the solicitation and final award for all eligible contract actions. COs may include the notice as an attachment to the order or contract, as part of the Statement of Work or Executive Summary, as part of an award letter to the contractor, or by other means as appropriate to the acquisition.
