PR 0040436407

IGCE $197,660.08

Format in accordance to FAR 6.303-2.

1. (a) Each justification shall contain sufficient facts and rationale to justify the use of the specific authority cited.

2. (b) As a minimum, each justification, except those for sole-source 8(a) contracts over $22 million (see paragraph (d) of this section), shall include the following information:

(1) Identification of the agency and the contracting activity: NPS/Golden Gate National Recreation Area.

(2) Nature and/or description of the action being approved. To award a Sole Source to Design Minds Inc. in accordance to FAR 13.106-1(b)(1)(i)

(3) A description of the supplies or services required to meet the agency’s needs (including the estimated value). The purpose of this Purchase Order is to provide overall exhibit planning and design for the new exhibits at Fort Point National Historic Site including the planning and design of all exhibit structures, graphic layouts, audiovisual elements, interactive elements, artwork, artifacts, historical vignettes, and lighting of the exhibits. This Purchase Order specifically increases the level of design effort to successfully develop more extensive interactive digital media content. Work includes coordination with the park, its partners, the Contracting Officer and her or his representative to create interpretive exhibits that effectively tell the park’s stories and are well integrated with the building design and operations.

In addition, the purpose of this Purchase Order is to provide comprehensive research and information necessary for completing the planning and design for all of the exhibit elements at FOPO, including sourcing and acquisition of existing photographs, art, and illustrations identified for use in the exhibit. Total estimated cost $197,660

(4) An identification of the statutory authority permitting other than full and open competition. To identify SAT: In Accordance to DOI-AAAP 0148 v01, 05/02/2018 – Increasing the Micro-purchase Threshold and the Simplified Acquisition Threshold and FAR 2.101 “Simplified Acquisition Threshold” means $250,000 based on statute 41 USC

In accordance to FAR 13.106-1(b)(1)(i)

1. (b) Soliciting from a single source.

a. (1) For purchases not exceeding the simplified acquisition threshold.

(i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.

FAR 13.501(a)(1) Special Documentation Requirements:

(a) Sole source (including brand name) acquisitions.

(1) Acquisitions conducted under simplified acquisition procedures are exempt from the requirements in part 6. However, contracting officers must-

i. (i) Conduct sole source acquisitions, as defined in 2.101, (including brand name) under this subpart only if the need to do so is justified in writing and approved at the levels specified in paragraph (a)(2) of this section;

ii. (ii) Prepare sole source (including brand name) justifications using the format at 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C.1901 or the authority of 41 U.S.C.1903;

iii. (iii) Make publicly available the justifications (excluding brand name) required by 6.305(a) within 14 days after contract award or in the case of unusual and compelling urgency within 30 days after contract award, in accordance with 6.305 procedures at paragraphs (b), (d), (e), and (f);

41 U.S.C.1901

When Procedures Are To Be Used.—To promote efficiency and economy in contracting and to avoid unnecessary burdens for agencies and contractors, the Federal Acquisition Regulation shall provide for special simplified procedures for purchases of property and services for amounts — not greater than the simplified acquisition threshold

(5) A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited. A task order, 140P8618F0039 was awarded on an HFC IDIQ contract P13PC00270 on 5/22/2018 to provide concept drawings for design. Though another contractor may be able to use ideas from the concept drawings, it was determined rather than have a new artist apply their interpretation to the work at a greater expense to the government it is in the best interest of the Government to return to the original artists in order to reproduce the exact styling that is represented in the concept drawings. This will allow for the Park Service to maintain the unique style throughout all the exhibits and not have a duplication of effort. The HFC IDIQ contract in which the original work was awarded had expired on 01/31/2019

(6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies. Fair opportunities were given to 5 HFC IDIQ contract holders in accordance with FAR 16.505(b)(2)(i) with the original Task Order.

• P13PC00268 - Krister Olmon, Inc.

• P13PC00269 - Edquist Davis Exhibits, Inc

• P13PC00270 - Design Minds, Inc

• P13PC00274 - West Office Exhibition Design

• P13PC00276 – Healy Kohler Design, Inc.

All but Krister Olmon submitted a quote.

(7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Rates were first established as fair and reasonable with the original HFC contract P13PC00270. A level of effort was determined to be acceptable through task order 140P8618F0039, and Design Minds was low price. These will be used as comparisons to any new purchase order.

(8) A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted. See number 6.

(9) Any other facts supporting the use of other than full and open competition, such as:

None

(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

None

(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate:
