EUGENE O’NEILL NATIONAL HISTORIC SITE
DEER EXCLUSION FENCE REPLACEMENT PROJECT
Statement of Work
Replace Deer Exclusion Fence at the Tao House
PMIS #322393
1.0 INTRODUCTION
The National Park Service (NPS) Eugene O’Neill National Historic Site (EUON) has a requirement to replace an existing deer exclusion fence at the Tao House. The work includes demolishing and disposing of the existing fence, two existing vehicle gates, and two existing pedestrian gates; and furnishing and installing a new fence as detailed in this Statement of Work.
2.0 PROJECT LOCATION
The site address is 1000 Kuss Rd, Danville, CA 94526. The project vicinity and site are shown in Figure
1. The site is behind a gated community. Please coordinate with the Contracting Officer for access.
3.0 BACKGROUND AND EXISTING CONDITIONS
Figure 2 shows the location of the Tao House at the Eugene O’Neill National Historic Site. An existing deer exclusion fence surrounds the Tao House and adjacent landscaping. The existing fence is approximately 900 feet long by 6 feet high, constructed of 4x4 wood posts, wire mesh with 2-inch by 4-inch openings, and a top rail of sawn wood boards. The fence has two double-leaf vehicle gates and two pedestrian gates.
The existing fence and gates are in poor condition and requires complete replacement. The new fence shall be constructed of wood posts and top rail the same dimensions as the existing, with galvanized wire mesh of approximately the same opening size. The existing vehicle and pedestrian gates are constructed of wood frames with the same galvanized wire mesh attached to the frames, and a diagonal brace on one or both leaves of the gate. The new vehicle and pedestrian gates shall be built to replicate the existing gates except that both leaves of the vehicle gates shall include a diagonal brace.
The extent of the existing deer fence is shown in Error! Reference source not found., and a typical s ection of fence is shown in Error! Reference source not found.. The existing gates are shown in Figure
5 through Figure 8.
The descriptions and dimensions provided in this statement of work are approximate and are not to form the complete basis of any bid for performing the work. All prospective bidders are strongly encouraged to attend the pre-bid conference described in Section 4.0. Bidders are responsible for ensuring that their bids are based on current existing conditions, actual dimensions required to complete the work, and materials that reproduce the existing fence style and appearance.
4.0 PRE-BID CONFERENCE
See clause 52.236-27, Site Visit, for pre-bid conference information.
4.1 General
The general scope of this work is to:
• Remove and dispose of approximately 900 linear feet of existing fence.
• Replace the existing fence with a new fence meeting all the requirements of this document.
• Replace two existing double-width drive-through gates and two pedestrian gates.
• The Contractor shall furnish all materials, supplies, equipment, and labor required for a complete job.
4.2 Standards of Work
The materials and workmanship shall conform to all applicable industry and trade standards. The following standards apply to this work. Other standards referenced within those listed below as applicable to the listed standard also apply to this work. If a conflict exists between standards, the most stringent shall apply. Any deviations from standards must be approved in advance, in writing, by the
Contracting Officer.
• American Society of Testing and Materials (ASTM), current standards for materials required for this work.
• American Wood Protection Association Standard U1-23: (2023) Use Category System: User

5.0 CONTRACTOR USE OF SITE
5.1 Conduct of Operations
• At all times the Contractor shall conduct their operations in conformance with the rules and regulations promulgated by the Secretary of the Interior for the National Park Service, and applicable park rules and regulations prescribed by the Park Superintendent.
• No signs or advertisements (except as required for safety) shall be displayed on the construction site or within the park unless approved by the Contracting Officer.
• Smoking is not permitted within any Federal building or within 25 feet of entrances, operable windows, or outdoor air intakes.
• Contractor shall at all times conduct operations to ensure the least inconvenience to the public.
5.2 On-site Work Hours
• Work shall be generally performed during normal business working hours of 7 a.m. to 4 p.m., Monday through Friday, except when otherwise indicated.
• Work on Saturdays, Sundays, Federal holidays, early morning, or at night may not be performed without prior consent from the CO and COR. Submit requests for work outside of the stated normal business hours to the CO and COR for approval at least 48 hours in advance of the work.
• The following Federal holidays are observed by the National Park Service:

Note: Any of the above holidays falling on a Saturday will be observed on the preceding

Holidays (opm.gov).
5.3 Contractor Use of Site
• Contractor’s use of the site shall be limited to the work area and access to it, any allowed staging areas, the access roads, and restrooms designated by the Contracting Officer for
Contractor’s use. Coordinate with the Contracting Officer for a key.
• Keep driveways and access roads clear and available to Government, Government's employees, and emergency vehicles at all times.
• Water from the existing water system is available for use without metering and without payment of use charges. Provide connections and extensions of services as required for construction activities. Use resources wisely and minimize waste of water.
• Electric power from existing system is not available for use.
6.0 SECURITY AND PROTECTION FACILITIES
6.1 Environmental Protection
• Conduct the work in ways and by methods that comply with state and federal environmental regulations and that minimize possible air, waterway, and subsoil contamination or pollution or other undesirable effects.
• All equipment shall be pressure washed free of soil, seeds, vegetative matter, or other debris that could contain or hold seeds prior to mobilizing to the project site. The Contracting Officer may visually inspect equipment prior to beginning work. Equipment shall be considered free of soil, seeds, and other debris when a visual inspection does not disclose such material.
Disassembly of equipment components or specialized inspection tools are not required.
• Protect existing trees and shrubs in the vicinity of the work from damage by the construction activities.
7.0 TASKS
7.1 Preparation
• The Contractor shall verify all existing conditions, measurements, access, and equipment needs as required to prepare a bid and to perform the work. The Contractor is solely responsible for providing labor and materials in quantities that are sufficient and appropriate to complete the work under the existing conditions at the site.
• Prospective bidders are strongly encouraged to attend the pre-bid conference described in
Section 4.0 for an opportunity to tour the site, observe existing conditions, take measurements, and ask questions about the work. Bidders are solely responsible for ensuring that their bids are based on accurate measurements of the work and on the existing conditions at the site. No cost changes for items viewable during site visit will be allowed.
7.2 Sequencing and Temporary Fencing
Provide temporary fencing and sequence demolition and construction so that the grounds are not left open to animals overnight. Plastic construction fencing is suitable for temporary use.
7.3 Submittals
Submittals are required to be approved by the Contracting Officer prior to starting work, as described in Section 10.0.
7.4 Pre-work Conference
The Contractor and the Contracting Officer or designated Contracting Officer’s Representative shall hold a pre-work conference either in person or remotely according to the schedule shown in Section
13.0. The purpose of the conference is to:
• Provide prospective bidders an opportunity to view the site, take measurements, and assess existing conditions;
• Discuss the scope of work, submittal procedures and timing, and key milestones of the work;
• Address any questions;
• Ensure a mutual understanding of the project requirements.
7.5 Site Access and Parking
• Coordinate with the Contracting Officer for access to the site during the work period.
• Parking at the project site is very limited. The Contractor may park one crew vehicle and one other vehicle at the site.
7.6 Demolition
• Demolish and dispose of the existing deer exclusion fence in its entirety in accordance with the approved work plan, including the existing gates to be replaced. Ensure that sequencing is followed to prevent deer intrusion overnight.
• Demolition debris shall become the property and sole responsibility of the Contractor.
Promptly remove all demolition debris from the site as demolition proceeds. Demolition materials may not be stored on-site.
• Excavate as needed to expose subsurface elements for removal in accordance with the Section
7.9 below.
• Reserve materials to be salvaged as indicated in Section 7.7.
7.7 Salvage
Reserve topsoil and excavation spoils as discussed in Section 7.9.
7.8 Staging
• Coordinate delivery of materials to minimize the need to store materials on site. The
Contractor may stage materials on the paved surface behind the building known as the New
Barn and in the adjoining corral.
• Coordinate deliveries with the Contracting Officer to gain access through the gated community.
7.9 Excavation
• The existing fence and gate post holes may be reused for the new posts. If additional excavation is required, use the narrowest excavations practical that meet the minimum requirements. Excavations may be made manually or with the smallest mechanized equipment suitable for the work.
• The diameter of the fence post holes shall be at least three times the cross-sectional dimension of the post and at least 18 inches deep. Existing fence post holes smaller than these dimensions shall be enlarged to meet the minimum dimensions required.
• The diameter of the gate post holes shall be at least four times the longest cross-sectional dimension of the gate post and at least 36 inches deep. Existing gate post holes smaller than these dimensions shall be enlarged to meet the minimum dimensions required.
• Excavate a trench 7 to 9 inches deep along the base of the fence on the outside of the fenced area and as narrow as practical to receive the bottom extension of fencing.
• Perform excavations only when soil conditions are dry enough to support the excavation equipment without leaving visible ruts.
• Avoid excavating or backfilling during periods of rainfall lasting more than an hour.
• Reserve a quantity of excavation spoils sufficient to backfill the trench and to restore disturbed areas after the fence is installed. Remove and dispose of rocks larger than 2 inches in diameter, sticks greater than 1 inch in diameter or 4 inches in length, root wads, clay balls, trash, debris, and any other materials other than clean soil. Dispose of unused excavation spoils on completion of the work.
• Provide cultural resources monitoring during excavation activities as described in Section
12.0.
7.10 Fence Installation
• Set fence posts in the post holes and fill with concrete, ensuring that the buried end of each post rests on concrete and not directly on the soil surface. The concrete surface shall be slightly convex at the ground surface. Allow the concrete to cure for at least 7 days before installing the fence wire or applying any force to the posts.
• Install wooden stretch panels (shown in Figure 9) for tightening along straight sections of fence at a maximum of 180 feet between panels and at points at which the fence changes direction.
• Apply the fence wire to the posts, ensuring that the top edge aligns with the top surface of the top rail, and the bottom edge extends at least 6 inches beyond the ground surface. No gaps are permissible between the bottom edge of the fencing and the ground surface. The full fence height shall be achieved without splicing the fence fabric.
• Attach fencing to each post at the top, bottom, and in at least 3 more evenly spaced locations along the height of the fence, and to the edge of the top rail. Staple attachment shall be in accordance with Figure 10. Fence shall be evenly tight, without sags, gaps, bulges, or overstretched areas.
• Extend the bottom 6 inches of fencing into the trench along the base of the fence, ensuring that the fencing is straight and vertical. Secure the bottom edge of the fencing with ground stakes spaced no more than 6 feet apart.
• Backfill the trench with excavation spoils tamped firmly into place, taking care not to snag and stretch the fence material. Prior to using excavation spoils, remove and dispose of rocks larger than 2 inches in diameter, sticks greater than 1 inch in diameter or 4 inches in length, root wads, clay balls, trash, debris, and any other materials other than clean soil. If quantity is insufficient to fill the trench, import clean fill material to backfill the trench to its original grade.
• Install new gates and reinstall existing gate hardware.
• Scatter a thin layer of reserved excavation spoils over the surface of the concrete at each post to mask its appearance. Ensure that no soil is placed directly in contact with the wood post.
7.11 Gates
• Furnish gates of same size and similar style as the existing gates except that both leaves of the vehicle gates shall be diagonally braced.
7.12 Disposal, Clean-up and Reclamation
• When installation is complete, restore the site to its previous or better condition.
• Use reserved excavation spoils, if any, and import additional topsoil as needed to restore disturbed areas.
• If seeding is required to repair disturbed soil areas, use seed, fertilizer, and mulch materials approved by the Government.
• Remove all extra materials, supplies, scrap, and trash from the Project area and dispose of off-site in a legal manner.
• The Government’s goal is to salvage and recycle as much nonhazardous construction waste as possible. Use sustainable methods to extent possible during this project, recycling material as is probable with local means.
7.13 Wood Finish
• Stain wood items per stain manufacturer’s directions.
• Allow the wood to age in the field for 4 to 6 months prior to staining.
7.14 Final Inspection
• Submit written certification of project completion and request a final inspection to the
Contracting Officer. The Contracting Officer or designee will inspect the work within 10 calendar days of receipt of request or at a mutually agreeable time.
• If the work is determined to be substantially complete with minor comments, the Contracting
Officer will prepare and provide the Contractor a Punch List noting outstanding items to be addressed.
• If the work is not determined to be complete following the final inspection, the Contracting
Officer will notify Contractor in writing, stating the reasons. The Contractor shall complete the
Punch List within the contract performance period, resubmit the certification of completion, and request a new final inspection. Re-inspection costs may be charged against the Contractor in accordance with the Inspection of Construction contract clause.
• If the Contractor fails to complete the work within the time frame, the Contracting Officer may correct the work with an appropriate reduction in contract price or charge for re-inspection costs in accordance with the Inspection of Construction contract clause.
• When all contractually required items are accepted by the Contracting Officer, the Contracting
Officer will issue a Letter of Final Acceptance of Work and request the final pay application.
The Contractor shall execute and submit a Release of Claims to the Contracting Officer before final payment can occur.
8.0 WARRANTY
A Construction Warranty shall be based on date of final acceptance of the work and remain in effect for one year.
9.0 MATERIALS
• The Contractor is responsible for ensuring that all materials used in the work conform with the requirements in this document and the Construction Drawings, whether approved by the
Government or not. The Government may require the removal and replacement of any materials found to be in nonconformance, regardless of the stage of the work.
• All materials shall be new, undamaged, and meet or exceed the requirements of this document.
• All galvanized materials shall conform with ASTM A153/A153M (2016a) Standard
Specification for Zinc Coating (Hot-Dip) on Iron and Steel Hardware.
• Posts:
1. All wood posts shall be kiln-dried, solid wood of cedar, pressure-treated Douglas fir, or pressure-treated hemlock sawn 4 sides (S4S). Tops shall be flat to accept the top rail.
Provide posts free of ring shake, season cracks more than 1/4 inch wide, splits in the end, and unsound knots. Pressure treatment shall be in accordance with AWPA Use Category 4.
2. Fence posts shall be 4 inches x 4 inches x sufficient length to produce a fence 6 feet high with at least 18 inches of post embedded in the ground.
3. Gate posts shall be 4 inches x 6 inches x sufficient length to support a 6-foot high gate and with at least 36 inches of post embedded into the ground.
• Fence Fabric: Fence fabric shall be galvanized, 12-1/2 gage, fixed-knot, high-tensile strength wire mesh with 2-inch by 4-inch openings at least high to provide a 6-foot-high fence without splicing to gain the fence height.
• Top rails: Top rails shall be kiln-dried solid wood, of cedar, pressure-treated Douglas fir, or pressure-treated hemlock, sawn 4 sides (S4S),1-inch by 4-inch x the length of the center-to-center spacing of the posts.
• Gates: Gate lumber shall be solid kiln-dried cedar, pressure-treated Douglas fir or pressure treated hemlock, 2-inch by 4-inch, sawn 4 sides (S4s).
• Stain: Oil based, semi-transparent wood stain and sealer with ultraviolet protection, formulated for application on new wood; color to be selected from the manufacturer’s standard range of colors.
• Fence Fasteners:
o Fence fasteners shall be galvanized, high-strength steel u-nails at least ¾ inch long.
o Top rail fasteners shall be galvanized, high-strength steel screws sufficiently long to anchor the wood members securely together without penetrating through to the other side or splitting the wood.
• Gate Hardware:
1. Gate fasteners shall be galvanized, high-strength steel screws sufficiently long to anchor the gate members securely together without penetrating through to the other side or splitting the members.
2. Gate hardware, if being replaced, shall be galvanized, heavy-duty steel.
• Ground stakes: Ground stakes shall be galvanized steel, kinked, 12 inches long, with a hook at one end for securing the bottom edge of the fence to the ground.
• Concrete: Ready-mix, 4,000-psi strength at 28 days, ASTM C-387.
10.0 HAZARDOUS MATERIALS
• Store and handle hazardous materials such as fuel and lubricants in accordance with manufacturers and OSHA 29 CFR 1926 Subpart D requirements 1926 | Occupational Safety and Health Administration (osha.gov). Maintain readily available, on site, MSDS/Safety Data
Sheets (SDS) for each hazardous substance.
• Refuel equipment on level, paved surfaces at the location identified in the approved work plan.
In the event of a spill of any size:
1. Immediately report all spills of hazardous materials to the Contracting Officer, Contracting
Officer’s Representative, and on-site NPS personnel.
2. Maintain a spill emergency response kit.
3. Train employees how to respond to a spill and use the emergency response kit.
11.0 SUBMITTALS
Submittals are required to verify that the materials and sequencing are in accordance with the requirements in this document. The Contractor shall submit the required submittals at least 7 calendar days before the pre-work conference. Required submittals include:
• A work plan indicating how the Contractor will sequence the work, where equipment and materials will be staged, where equipment would be refueled if refueling is anticipated on-site, and the safety protocols for cleaning up spills.
• Manufacturer’s product data sheets for each product to be used in this work. Product data shall be sufficiently detailed to show that the product meets the requirements.
• Shop drawing of each gate type to be replaced.
• Submittals which provide insufficient information for approval, or which indicate that a material or plan does not meet requirements, will be noted and returned for revision.
• The Contractor is solely responsible for ensuring that all materials used in the work conform with the requirements in this document, whether approved by the Government or not. The
Government may require the removal and replacement of any materials found to be in nonconformance, regardless of the stage of the work.
12.0 CULTURAL RESOURCES
The Government’s archeological monitor will spot-check excavation work. The Contractor shall:
• Notify the Contracting Officer’s Representative at least 5 calendar days prior to conducting ground-disturbing activities.
• Facilitate access for the archeological monitor to the working areas.
• Refrain from ground-disturbing work if cultural items are uncovered, whether or not an archeological monitor is present. Other work that does not involve ground disturbance may continue.
• Report all finds to the Contracting Officer’s Representative immediately.
13.0 GOVERNMENT FURNISHED DOCUMENTS AND PROPERTY
There are no Government-furnished documents or property associated with this work.
14.0 PERFORMANCE PERIOD
See clause 52-211-10 of the SF 1442 for period of performance.
