About this file

This document is an amendment to a Request for Quotation (RFQ) for a federal contract opportunity.

The purpose of the amendment is to respond to questions from potential offerors. It clarifies that the contractor must have the required insurance coverage, including $500,000 professional liability insurance, in place at the time of bid submission, not just within 10 days of contract award. The agency has encountered issues in the past where contractors claimed they could obtain the required insurance after award, but then encountered delays or higher than expected costs. The amendment also states that the due date and time for quotes remains unchanged, with all quotes due by July 31, 2024 at 4:00 pm EDT. All other terms and conditions of the RFQ remain unchanged.

1.The purpose of this amendment is to respond to questions.

QUESTION: In the RFP Section 4.4 (pgs. 15-16) there is conflicting information. The first paragraph states that the Certificate of Insurance must be provided within 10 days of the contract award. The following paragraph states that ¿insurance must be currently active and in use at the time the contractor's bid is submitted¿.

ANSWER: This is not conflicting information. Both statements are true. They need to have the correct insurance, as identified in the statement of work, in place at the time they submit their bid. They also need to provide a certificate of insurance to you - to verify their proof of insurance - within ten days after the award.

QUESTION: My company has current and sufficient

Workers Compensation insurance and General

Liability insurance. We also have a current

Profession Liability insurance policy, though not to the $500,000 amount requested. However, my company's policy can be increased to the required level for this RFP, but only after (within 10 days) we are awarded the contract.

ANSWER: So, we have been down this road before, and this typically does not work out. In many cases, the insurance company assures the bidder that they can get the additional insurance active within ten days of the bidder's request but then there is some kind of snag and then the contractor is still waiting, three months after the award, for the extra insurance to kick in and now we are three months into the period of performance and no work has started on the project. Keep in mind that an increase in this type of insurance often involves a re-inspection of the conservator's conservation studio by the insurer in order to approve the extra coverage.

We have also had issues where the bidder's firm fixed price is based upon the "quote" by their insurer of what it will cost to increase the coverage and then after the award, the contractor finds out the quote was low, and the extra insurance will cost twice as much. Then the contractor asks for a modification for more funding. So, the best way to avoid all of this -is to require this amount of insurance be in place at the time of the bidder's submission - so we know it is active.

DUE DATE AND TIME UNCHANGED: ALL QUOTES MUST BE

RECEIVED ON OR BEFORE JULY 31, 2024, AT 4:00 PM
