Questions and Answers

Q1. Our company is very interested in the solicitation noted in the subject line and was wondering if this solicitation is labeled under construction or services?

A1. This is a construction project.

Q2. I looked up the NAIC code definition below however I wanted to confirm it with you as to what the sub-contracting limitation (is) on this project. NAICS Code 238320- Painting and Wall Covering Contractors is a final level code of the “Construction” Sector. Is it 15%?

A2. No, it is 25%.

52.219-14 Limitation on Subcontracting section c reads as follows:

(c) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of the contract in the case of a contract for—

(1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.

(2) Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials.

(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.

(4) Construction by special trade contractors. The concern will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees.

NAICs with 238 are specialty trade NAICs; therefore, Painting is a specialty trade. Per the above the contractor should perform at least 25% of the cost of the contract, not including the cost of materials, with its own employees.

Q3. Will painting be required in the closet on the upper level?

A3. No painting will be required in the upper-level closet.

Q4. Is painting required for the ends of the bench seating?

Q14. Please provide greater details as to what type of foundation etc is needed to build this roofing structure. It is tough for contractors to bid the same type of structure without drawings.

A14. Needs to match the adjacent pent roof on the building.

Q15. Are there any reports for the building showing lead paint results?

A15. No current reports.

Q16. If the contractor is awarded the project and lead paint is found, how is the contractor supposed to price for this potentially large cost unknown?

A16. If lead is found, then a modification to the contract would need to be submitted to take into account additional lead abatement costs.

Q17. The contract states “Any employee that will be required to work on surfaces containing hazardous materials shall have the appropriate training and certifications for working with that material.” Could you define “appropriate training and certifications” more in detail? Will the company need to be state certified?

A17. Yes, state certification is required if hazards are found.

Q18. Will prime contractor employees of superintendent and safety manager be onsite at all times during construction?

A18. Yes, a project superintendent needs to be on site. A safety manager does not need to be on site, but a safety plan needs to be submitted.
