Clarifications for Solicitation #140P2123R0014
Amendment 7 posted on 7/7/23
This document provides clarifications based on submitted queries.
Clarifications 1 – 17 are in Attachment 4.
Clarifications 18 - 31 are in Attachment 5.
32) Please confirm that this project is a lump sum price for up to 160 Cubic Yards of removal and disposal of ACM debris and this is not a unit price contract? Are all unit prices provided are for quantities in excess of 160 CY?
a) The price of CLIN 1 for transportation and disposal of approximately 160 CY of ACM debris is lump sum. Unit prices for Options A and B are for quantities in excess of the approximately 160 CY identified and included in CLIN 1. Refer to Q&A 12, 23, and 25.
33) Do contractors performing work under this contract in the US Virgin Islands need to have a business license issued by the Government of the Virgin Islands Department of Licensing and Consumer Affairs?
a) This contract does not require prime or subcontractors to submit proof of local business licenses, although all are expected to comply with applicable licensing regulations for the localities in which they perform work.
34) Will soil grabs or soil sampling be required to confirm asbestos removal?
a) Soil samples are only necessary if there is evidence of potential asbestos dust on the ground where debris is removed.
35) Hawksnest Beach area: How much soil can be taken, particularly where asbestos is clearly touching on and within the ground? What triggers the necessity for soil removal below the debris?
a) If there is evidence of ACM fragments or dust, remove the top inch of soil.
36) Scott Beach area: How much site work (e.g. excavation, contouring) is needed or allowed?
a) Excavation and contouring are not included in the scope of work.
37) Scott Beach area: What is expected with the non-asbestos material - should it remain or be disposed?
a) This contract is for the removal of ACM debris. Debris that does not contain ACM will remain.
38) Debris may be across all 150 acres of the Caneel peninsula, correct? Are we to focus on the pit piles only? Will all 150 acres be assessed by us or by someone else? Do we only focus on the approximately 3 acres referenced in the solicitation? Will the NPS-hired monitoring firm assist the prime contractor with checking for ACM in areas beyond what has already been identified? Will the Park Service aid in identifying (flagging, mark out) the materials in the SOW? Is there a monitoring agency or company who will be responsible for ensuring all asbestos material is identified and removed?
a) Contractor is expected to conduct due diligence to check the areas with known ACM debris for additional debris of the same type. Contractor should focus on the three acres identified in the solicitation.
b) Project Monitor will assist in identifying ACM debris in the field. Project Monitor will be on site to ensure all identified ACM debris is removed.
c) Refer to earlier Q&A for additional information.
39) Scott Beach area: Where will the decontamination section be for clean off of persons and materials?
a) Contractor to identify in their submittals where they will place decontamination unit(s) prior to mobilizing to the site.
40) Scott Beach area: How much traffic is there inside the resort in the areas of concern?
a) Minimal traffic occurs through the areas of concern. Traffic is primarily from the front gate to Honeymoon Beach.
41) Need clear instruction on what vegetation can and cannot be cut for the execution of this project. What size trunk or height of plant is allowed for cutting/ removal? Will the roads be cleared and/or vegetation growth cut back? Guidance on vegetation management is needed.
a) Heritage trees cannot be removed during vegetation clearing. NPS will assist in flagging heritage trees.
b) Contractor is expected to clear vegetation that impedes access to ACM debris, and as is necessary to facilitate safe movements of crews and equipment on site. Contractor should flag any trees over 6 inches in diameter they intend to remove for concurrence by NPS staff prior to removal. However, all Tan-Tan and all Cacia trees of any size may be removed as these are invasive.
c) No protected species of tree or vegetation can be removed.
d) Contractor shall mark planned clearing areas for NPS approval prior to removing vegetation. Clearing shall be limited to only those areas necessary to complete the Work.
Protect all vegetation that is to remain in place from injury. Obtain the approval of NPS and the Project Monitor before cutting vegetation outside the Work Limits.
42) Turtle Point B: Can the concrete parking/maintenance area at Turtle Point be used as staging area?
a) Yes.
43) Turtle Point B: Can a tractor or other heavy equipment be used in this (and other) areas?
a) Yes. Contractor will need to work with VIIS cultural resources staff on heavy equipment use in the Turtle Bay area of Caneel Bay to protect cultural resources.
b) Heavy equipment should not be used during or immediately following heavy rain events to prevent ground disturbance. Any track marks left by equipment shall be scraped or raked at the conclusion of site work. Ground should be in the same condition as it was prior to on-site work at the end of the contract. Contractor will need to have a spill kit on hand for each piece of machinery on site.
c) Any equipment mobilized to the Site shall be inspected by the Project Monitor for cleanliness before it is unloaded. Any equipment that has soil, excess grease or fluid leaks shall not be allowed on the Site.
44) What is the likely start date (Notice to Proceed, NTP)?
a) We anticipate awarding a contract by early September. The NTP will be issued approximately 30-45 days thereafter, depending on timeliness and quality of post-award submittals and subsequent NPS reviews thereof.
45) Is the concrete pad at the rear of the estate restaurant available as a lay down area?
a) No.
46) Is there a possibility of pre-cutting select roadways to allow access for waste haulers?
a) Pre-cutting of vegetation from roadways in advance of the contractor mobilizing is unlikely.
47) RFP: FAR clause 52.244-6, Subcontracts for Commercial Products and Commercial
Services, is updated to June 2023 version, which incorporates new clause 52.204-7, Prohibition on a ByteDance Covered Application (Jun 2023) (Section 102 of Division R of Pub. L. 117-328), by reference.
48) RFP: FAR clause 52.204-27 Prohibition on a ByteDance Covered Application (Jun 2023) is added to the RFP and contract.
