About this file
This document is a Brand Name Justification for Other Than Full and Open Competition (JOFOC) for the National Park Service's Denver Service Center. The document supports a $65,867.00 acquisition for roofing repairs at the Freedom Riders National Monument in Anniston, Alabama, specifically requiring Johns Manville thermoplastic membrane roofing products. The justification is based on maintaining the existing roof warranty, which necessitates using the original manufacturer's specific materials and methods.
The acquisition will be processed as an 8(a) sole-source construction services contract, with the contracting team determining that only Johns Manville thermoplastic membrane roofing can meet the project's technical requirements. The roofing repairs are part of the FRRI 253825 project to rehabilitate civil rights structures (Greyhound Bus Depot and Mural Building), and the government aims to protect its investment by using brand-specific materials that ensure warranty compliance and system integrity. The solicitation is dated 07/23/2025, with the contracting officer and project manager certifying the justification on the same date.

Solicitation No. 140P2025R0035 Park/PMIS: FRRI 253825
Date: 07/23/2025 Reference: Portion of the Construction Services, FRRI 253825 - Rehabilitate Civil Rights Structures
(Greyhound Bus Depot and Mural Building), Freedom Riders National Monument, Anniston, Alabama, Subject: Brand Name Justification for Other Than Full and Open Competition
FAR Part 15, in accordance with FAR 6.303-2, the following information is provided:
1. Identification of the Agency and the Contracting Activity:
Department of the Interior (DOI), National Park Service (NPS), Denver Service Center (DSC), Contracting Services (CS) Division on behalf of DOI NPS DSC, Design and Construction (D&C) Division and Freedom Riders National Monument in Anniston, Alabama.
2. Nature and/or Description of the Action Being Approved:
This document is justification for the approval of brand-name requirements for a portion of the construction services acquisition in support of the FRRI 253825 project to rehabilitate civil rights structures (Greyhound Bus Depot and Mural Building) at Freedom Riders National Monument in Anniston, Alabama. Specifically, that of Johns Manville thermoplastic membrane roofing products.
3. A Description of the Supplies or Services Required to Meet the Agency’s Needs, Including the Estimated Value:
This FRRI 253825 project calls for repairs to the roofing system. The necessary materials are required to maintain the current roof warranty for the existing membrane roofing. The estimated value of this acquisition is $65,867.00.
4. Identification of the Statutory Authority Permitting Other Than Full and Open Competition:
FAR 6.302-1 – “Only One Responsible Source and No Other Supplies or Services will Satisfy the Agency Requirements.”
5. A Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited.
This FRRI 253825 project calls for essential repairs to the existing roofing system. The scope of work includes repairs that directly impact the integrity of the current membrane roofing. In order to maintain the manufacturer’s warranty on the existing membrane system, the repairs must be performed using specific materials and methods that are compatible with the original installation and approved by the roofing manufacturer.
Using a contractor not authorized by the membrane manufacturer would result in the loss of warranty protection, potentially leading to significant additional costs and risk to the government. Therefore, the nature of the acquisition—specifically, the requirement to maintain the roof system warranty—necessitates the use of the cited authority for sole-source procurement.
6. A Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will be Publicized as Required by FAR 5.2 and, if Not, Which Exception Under FAR 5.202 Applies:
This Brand-Name J&A is for a portion of the construction services acquisition in support of the FRRI 253825
Page 2 of 2 v1 Feb2025 A15 JOFOC - Brand Name FAR Part 15 project and shall be posted with issuance of the solicitation in accordance with FAR 6.302-l(c)(l)(ii)(C) and 5.102(a)(6).
7. A Determination by the Contracting Officer that the Anticipated Cost to the Government Will be Fair and Reasonable:
The contracting method for this acquisition will be an 8(a) sole-source for construction services in support of the FRRI 253825 project. Price and Cost analysis will be performed to ensure that pricing is fair and reasonable prior to making contract award.
8. A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted:
Additional market research was not conducted by the Contracting team, as the Architect-Engineer (AE) Designer of Record (DOR) and Project team have provided technical expertise regarding the compatibility of the existing thermoplastic membrane roofing with that of/from other manufacturers. Efforts included internet research, correspondence with manufacturers, value analysis, and recommendations based on professional knowledge.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition (see FAR 6.302-2 (9) (i) –
(iii) for examples):
It is critical to use the specified brand name materials for this FRRI 253825 project because the existing roofing system is under a manufacturer’s warranty that is contingent upon the use of approved, brand-specific products.
The roofing membrane and its associated components are proprietary and must be repaired using original manufacturer materials to ensure compatibility and maintain the integrity of the system.
Substituting alternate brands or non-approved materials would void the warranty, potentially resulting in costly future repairs or full system replacement at the government's expense.
Therefore, specifying the brand name is not for preference but to protect the government's investment in the existing roof system and to avoid warranty invalidation, financial loss, and technical risk.
10. A Listing of the Sources, if any, that Expressed in Writing, an Interest in the Acquisition:
None.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition Before any Subsequent Acquisition for the Supplies or Services Required:
The NPS-DSC team has determined that the salient characteristics can only be met by the Johns Manville thermoplastic membrane roofing material as discussed above. The Government will continue to monitor the market for compatible thermoplastic membrane roofing material with salient characteristics that meet the Agency’s minimum needs and ensure specifications are written to allow the use of those thermoplastic membrane roofing material if identified.
