BUREAU OF LAND MANAGEMENT

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

In accordance with the authority granted under 41 U.S.C. 253(c), this request for award under other than full and open competition is hereby submitted.

1. Identification of the agency and the contracting activity:

Bureau of Land Management, Arctic District Office.

2. Nature and/or description of the action being approved:

Due to the circumstances described below, BLM requests the Ukpeaġvik Iñupiat Corporation (UIC) UMIAQ perform the plowing and snow removal of the Umiat airstrip and roadways in support of BLM’s requirements for routine fieldwork including data collection to support oil and gas exploration and development in the NPR-A.

3. A description of the supplies or services required to meet the agency’s needs:

Umait camp opening for spring and early summer use.

• complete snow removal of the airfield so that snow melt drains away from the runway, in order to minimize soft, wet gravel conditions (in order to avoid closure of the runway to fixed-wing aircraft landings).

• Complete snow removal of the main camp pad and access roads, including snow removal around the BLM quonset hut, sheds, connex boxes and other facilities.

• Complete snow removal of the fuel apron and fuel distribution facilities to facilitate fuel delivery and wheeled flights.

4. An identification of the Statutory Authority permitting other than full and open competition:

41. U.S.C. 253(c) (l) as implemented by FAR 6.302-1.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

UIC UMIAQ, is primary leaseholder at Umiat Airfield. The corporation has the heavy equipment, knowledge and expertise (from past practice) needed to perform the work. The corporation also has the required authorizations to work on the State owned airstrip.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Federal Acquisition Regulation (FAR) Subpart 5.2, and, if not, which exception under 5.202 applies:

A notice will be publicized as a sole source justification set forth by FAR subpart 5.2

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable, and the basis for that determination:

Similar services have been acquired by the Bureau of Land Management in the Alaska region.

Comparing like square footage of past procurements along with Davis Bacon Wage Determinations deems this price is fair and reasonable.

8. A description of the market research conducted (FAR part 10) and the results or a statement of the reason market research was not conducted:

Research was conducted and was based on the latest UIC price schedule published for Umiat.

The hourly rates are set by UIC UMIAQ to provide compensation for employees working in remote camp situations and rental rates for equipment usage are predetermined using their most current price schedule.

9. Any other facts supporting the use of other than full and open competition:

Bidders would need to currently have equipment and supplies in the area and get permission from UMIAQ to preform the work. Getting adequate equipment and supplies to the airfield is a long, expensive process to include permitting and seasonal snow trail travel or perhaps be flown in as there is no permanent road access to Umiat.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
