About this file

This is a Sole Source Justification and Approval document for a federal acquisition under simplified acquisition procedures.

The Department of the Interior, Bureau of Land Management (BLM), Richfield Field Office is contracting on a sole source basis with Garfield County, Utah under the Good Neighbor Authority to install low water crossings on Henry Mountain Road at Sandy Creek and two of its tributaries. The project, valued at $134,000, will be completed between September 2026 and September 2027 and includes mobilization, materials, equipment, and labor. The work addresses chronic road impassability caused by sediment deposits and washouts at stream crossings, which reduces public access to millions of acres of public land in the Henry Mountains area near Hanksville, Utah, and impacts human health and safety. The low water crossings will prevent future washouts, reduce sediment deposition on the roadway, and minimize negative impacts to riparian areas and downstream water quality.

The sole source authority is justified under FAR 6.103-5 (Authorized or Required by Statute) based on the Good Neighbor Authority, which allows the BLM to contract directly with Garfield County. Garfield County possesses the necessary expertise and standard design for low water crossings, routinely maintains roads in the area, and has a shared mission with the BLM to provide public land access. The partnership is characterized as mutually beneficial, as it will result in lower costs and reduced road maintenance for both entities. No market research was conducted, and no plans exist for future competition as this is a one-time project. The justification was certified by Contracting Officer Tori Blunt Mayes and Contracting Officer's Representative Mackenzie Johnston.

SOLE SOURCE JUSTIFICATION AND APPROVAL

FOR ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION PROCEDURES

This document sets forth the justification and approval as required by 13.101(b).

1. Contracting agency and activity.

The Department of the Interior, Bureau of Land Management (BLM), Richfield Field Office, requests the Utah State Office, to contract on a sole source basis under the Good Neighbor Authority with Garfield County, Utah.

2. Nature and/or description of action being approved.

The Henry Mountains Road is a primary public route for millions of acres of public land in the Henry Mountain area near Hanksville, Utah. The road is frequently covered with sediment or washed out where it crosses Sandy Creek and its tributaries. This makes the road impassable which reduces public access and can impact human health and safety if travelers get stranded. Frequent road maintenance as a result of these washouts also disturbs the stream channels negatively impacting adjacent riparian areas and downstream water quality. The BLM is proposing to install low water crossings on Sandy Creek and its tributaries so these streams can be crossed following high stream flows. These structures prevent washouts and reduce the amount of sediment deposited on the roadway.

3. Description of supplies or services.

Install low water crossings on Henry Mountain Road at Sandy Creek and two of its tributaries. Work will be completed between September 2026 and September 2027. Low water crossings will provide improved access to the Henry Mountains area and reduce impacts on riparian areas and water quality.

4. Estimated dollar value.

The estimated dollar value is $134,000 for all aspects of the project including mobilization materials, equipment, and labor.

5. Statutory authority.

____41 U.S.C. 1901 – Simplified acquisition procedures (use when the simplified procedures for purchases of property and services for amounts (1) not greater than the simplified acquisition threshold

____41 U.S.C 1903 – Special emergency procurement authority (applies when in support of a contingency operation as defined in section 101(a) of title 10 or to facilitate the defense against or recovery from nuclear, biological, chemical, or radiological attack against the United States).

_X__ FAR 6.103-5 Authorized or Required by Statute: Agencies may contract without providing for full and open competition when a statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source.

6. Rationale supporting use of the authority stated in paragraph 5.

The BLM has a shared mission with Garfield County to provide access to public lands in the Henry Mountains area. Garfield County routinely maintains and repairs roads in the area and has a standard design for low water crossings. Garfield County has the expertise necessary to complete the required work.

7. Other information.

This is a mutual benefit for both BLM and Garfield County. Partnering with Garfield County on this effort will result in lower costs allowing for additional low water crossings being constructed. These low water crossings will reduce road maintenance for both BLM and Garfield County.

8. The efforts to identify additional sources including the market research conducted.

As Good Neighbor Authority authorizes the BLM to sole source with the County, no further market research was conducted.

9. Future plans to permit competition.

There are no plans to permit future competition for this project because it is a one-time project.

10. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.

I certify that the facts and representations under my cognizance, which are included in this justification and which form a basis for this justification, are complete and accurate.
