About this file

This is a Justification and Approval (J&A) document for a simplified acquisition from the Bureau of Land Management (BLM) Canyon Country District Office for upfitting a K9 Law Enforcement 2024 Dodge Ram 2500 truck. The document justifies a sole-source award to Two Way Communications, Inc. of Grand Junction, CO (UEI: ZNXYAQKCJYJ1) for $8,220.00.

The J&A cites that Two Way Communications is the only vendor within 150 miles of Moab, UT that can perform the specialized K9 vehicle upfit within the required 4-week timeframe. The next closest vendor is 474 miles away, making shipping costs prohibitive. The work involves installing off-road equipment on a 2024 Dodge Ram 2500 crew cab Tradesman with Power Wagon package. The vehicle requires specific safety equipment per BLM policy before a K9 can patrol with its handler. The work will be performed at the contractor's facility with FOB Origin delivery terms. The procurement is being conducted under simplified acquisition procedures per 41 U.S.C. 1901.

JUSTIFICATION AND APPROVAL

FOR ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION PROCEDURES

This document sets forth the justification and approval as required by 13.106-1(b)(1) & (2).

1. Contracting agency and activity.

The Department of the Interior, Bureau of Land Management (BLM), requests the Canyon Country

District Office to contract on non-competitive, sole source basis.

2. Nature and/or description of action being approved.

This requirement is to upfit a K9 Law Enforcement 2024 Dodge Ram 2500 truck. This upfit is necessary to ensure that the Law Enforcement vehicle is outfitted in accordance with BLM policy and ensures the equipment is working properly and meets the safety needs of the Law

Enforcement Ranger and K9. The intended contractor is Two Way Communications, Inc. located at Grand Junction, CO 81505 (UEI: ZNXYAQKCJYJ1).

3. Description of supplies or services.

The requirement is to install some off-road equipment on a 2024 Dodge Ram 2500 crew cab. The truck is the Tradesman trim with the Power Wagon off road package with a 6’4” bed. Specific requirements are listed in the Statement of work. Place of performance is the contractor’s site.

Inspection and acceptance are performed at the contractor’s site, where delivery is FOB Origin.

4. Estimated dollar value.

The total estimated contract value is $8,220.00.

5. Statutory authority.

X_41 U.S.C. 1901 – Simplified acquisition procedures (use when the simplified procedures for purchases of property and services for amounts (1) not greater than the simplified acquisition threshold

41 U.S.C 1903 – Special emergency procurement authority (applies when in support of a contingency operation as defined in section 101(a) of title 10 or to facilitate the defense against or recovery from nuclear, biological, chemical, or radiological attack against the United States).

6. Rationale supporting use of the authority stated in paragraph 5.

Two Way Communications Inc. is the closest vendor within a 150-mile radius from Moab, UT.

Two Way Communication is the only vendor that can perform this vehicle upfit in a 4-week time frame, once the vehicle is received from the BLM.

The timeframe for a K9 police vehicle upfit is uniquely important, since by policy a K9 can only patrol with its handler in a vehicle that has very specific safety equipment installed.

Two-Way Communications proximity to Moab makes them uniquely situated since the delivery and retrieval of the truck is within a reasonable radius that minimizes cost to the Government.

Other potential vendors are significantly further from Moab making shipment and retrieval cost prohibitive.

7. Other information.

Not Applicable

8. The efforts to identify additional sources including the market research conducted.

Market Research was performed to determine the availability of vendors within a 150-mile radius and the next closest vendor was 474 miles away. Two-Way Communications Inc has indicated that they can perform the work within the time frame needed. Two-Way Communication is 143 miles from the Canyon Country District Office and their proximity to Moab. It was determined that Two-Way Communications Inc is the most capable vendor that could meet the demands of the Canyon Country District Office Law Enforcement mission.

9. Future plans to permit competition.

No future plans at this time.

10. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.

I certify that the facts and representations under my cognizance, which are included in this justification, and which form a basis for this justification, are complete and accurate.
