Memorandum
To: Contract File
From: Kim Karalus, Contract Specialist
Subject: Single Source Documentation
In accordance with FAR subpart 13.106-1, this memorandum justifies soliciting a single source procurement herein.
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY.
Bureau of Land Management, Oregon State Office, Branch of Procurement Management, P.O. Box 2965, Portland, OR 97208.
2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED.
The BLM will solicit law enforcement support for Benton County in Oregon as a single source procurement to Benton County, 201 Laurel Avenue, Benton, OR 97141-2311 to be issued as a firm fixed price commercial service contract.
3. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
(INCLUDING THE ESTIMATED VALUE).
The Government requires obtaining law enforcement support to BLM Rangers to assist in patrolling BLM lands for administration and regulation of use and occupancy of public lands, waters, roads, and trail within the confines of Benton County, Oregon. This helps provide for the health and safety of the recreating public and those enjoying our public lands.
The estimated value of this acquisition is
4. AUTHORITY AND SUPPORTING RATIONALE AND, IF APPLICABLE, A DEMONSTRATION OF
THE PROPOSED CONTRACOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED
SUPPLY OR SERVICE.
The authority permitting the single source consideration is FAR 13.106-1(b) Soliciting from a single source.
The Federal Land Policy and Management Act of 1976 section 303(c)(1) authorizes the BLM to engage in contracts with local law enforcement agencies.
Benton County Sheriff’s Office is the only responsible source to provide law enforcement support with full arrest authority. This statutory authority is provided by the State of Oregon Revised Statutes (ORS) 801.395:
“Peace officer authority extends to any place in the State of Oregon, 100.2.1 authority to Arrest Pursuant to Oregon Revised Statutes 133.235, and ORS 133.310(1).” These authorities are not extended to security firms or other privatized patrols.
In addition, Oregon Sheriff Deputies officers are provided the privileges and immunities that apply to the activity of law enforcement officers when performing their respective functions. These privileges and immunities, to include arrest authority, are not extended to security firms or other privatized patrols.
Lastly, Benton County Sheriff’s Office deputies have undergone required training as prescribed by the Oregon State Department of Public Safety Standards and Training as well as BLM law enforcement procedures and policies.
5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ORDER REPRESENTS THE
BEST VALUE.
The Benton County Sheriff’s Office will be furnishing services in accordance with their collective bargaining agreement. Pricing is anticipated to be fair and reasonable.
6. DESCRIPTION OF MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND
THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED.
Market research conducted on 02/26/2024 indicates that there are only two (2) known sources that can provide the required services of this contract, the Benton Sheriff’s office and Oregon State Patrol. Oregon State Patrol does not have adequate personnel to monitor individual counties in the State.
7. ANY OTHER FACTS SUPPORTING JUSTIFICATION.
None.
8. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME
ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE
SUPPLIES OR SERIVCES IS MADE.
Because the barrier to competition lies in the Oregon Revised Statutes, there are no actions the BLM can take to overcome it.
CONTRACTING OFFICER CERTIFICATION
I certify that this justification is accurate and complete to the best of my knowledge and belief. I determine the circumstances of the contract action deem only one source reasonably available.
