BLM VALE DISTRICT, OREGON
SECTION C – PERFORMANCE WORK STATEMENT
C.1.0 GENERAL
C.1.1 Description of Work
C.1.1.1 The purpose of this contract is to conduct botanical surveys to determine the presence or absence of target species, document and map locations and populations of target species, and provide an ecological description for the areas surveyed including any special habitats encountered. Botanical surveys for this call will include target vascular plant species and target noxious weeds. See Attachment #3 for a target list of Special Status vascular plants and Attachment #4 for a target list of noxious weed species. Surveys will be conducted within proposed juniper treatment areas on Vale District during the spring and summer of 2025-2027. Surveys will be done following established written protocols.
C.1.1.2 The Contractor shall provide all services, equipment, and expertise necessary to search for, locate, and document population and habitat data for Special Status vascular plants and noxious weeds.
C.1.1.3 Field work shall occur between May 15, 2025 and June 30, 2025 for Item 1: Brown
Rocks and Item 2: Water Gulch FFR. Field work shall occur between May 15, 2026 and June 30, 2026 for Item 3: Clevenger Butte I, Item 4: Clevenger Butte II, and Item 5: Poison. Field Work shall occur between May 15, 2027 and June 30, 2027 for Item 6: Lockhart, and Item 7: Little Malheur. Field work shall only occur during the appropriate phenological stages for the target species.
C.1.1.4 Surveyors shall document surveys by completing Survey Report forms (Attachment
#5) for each Item, indicating their survey route on a topographical map, compiling species lists, documenting Special Status plant and noxious weed sites, and describing the area surveyed in a narrative report. See Section C.5.0 for detailed description of field work and documentation requirements.
C.1.2 Right to Share - Except as otherwise specifically provided for in this contract, the
Contractor shall not use for purposes other than the performance of this contract, nor shall the Contractor release, reproduce, distribute, or publish any data first produced in the performance of this contract, nor authorize others to do so, without written permission of the Contracting Officer (CO).
C.1.3 Location – There are two project areas for this call: Brown Rocks and Northwest Malheur
Brown Rocks Item 1:
The Brown Rocks juniper treatment project is located in the Baker County, OR. The proect is approximately 7 miles SW of Baker City, OR. Units are located in T11S R38E Section 36; T11S R39E Section 31; and T12S R38E Sections 1, 2.
NW Malheur Items 2-7:
The following projects are located approximately 22 miles southwest of the town of Ironside, OR off of Highway 26 and approximately 21 miles north of the town of Juntura, OR off of Highway 20. Units are located in T16S R36E Sections 25, 26, 35;
T16S R37E Sections 20, 21, 22, 28, 29, 30, 32, 33; T17S R36E Sections 1, 12, 22, 23, 26, 27, 34, 35; T17S R37E Sections 6, 7; T18S R36E Sections 2, 3; T18S R37E Sections 29, 32.
Units may contain rough steep terrain and thickets of dense vegetation. Surveyors must be physically fit. Permitted livestock may be present in the work area during the period of the contract.
C.1.4 The principle partners or key personnel of a business, whose resumes are submitted in the proposal, shall survey a minimum of 90% of the acres in each task order. A resume for each surveyor added after award of the contract shall be submitted to the Contracting Officer’s Representative (COR) for review prior to their beginning survey work. The technical requirements listed in C.3.2 shall apply to all personnel added after contract award.
C.1.5 Access
C.1.5.1 Access will be by both gravel roads (improved) and dirt roads (unimproved) which may require four-wheel drive vehicles. Portions of some survey areas do not have direct road access. Some roads or portions of roads may need to be accessed by foot.
C.1.5.2 Contractors accessing project areas via private land shall obtain permission from the landowner to travel over private lands before starting work on any project unit accessed through private land. The Contractor shall provide the Government a written statement or written documentation of verbal approval given by a named person on a stated date and time that the Contractor has been granted permission to travel over private lands.
C.1.6 Pre-work Conferences - A pre-work conference will be held after award and prior to the start of work to ensure a clear understanding of the scope of the contract, the sequence of work, submission times for progress reports, documentation requirements, inspection, and payment schedules. The Contractor will be notified in advance of the meeting time, date and place for pre-work conferences.
C.2.0 DEFINITIONS
GPS - Global Positioning System. Required settings are UTM Zone 11 North, NAD 83, in meters.
Intuitively Controlled Survey Method – Survey effort covers a representative cross section of all major habitats and topographic features including slopes, draws, benches, ridges, riparian or wet areas, rock outcrops and meadows and is concentrated in areas of probable habitat of target species.
Noxious Weeds – Plants found on the State of Oregon Noxious weed list found at https://www.oregon.gov/oda/Documents/Publications/Weeds/NoxiousWeedPolicyClassificati on.pdf
Special Status Species – See Attachment 3 for lists of Special Status vascular species.
Includes Federal and State Threatened and Endangered; Bureau Sensitive and Strategic species.
USDA NRCS Plants Database Species Codes – 4-6 letter and number codes assigned to plants in the United States Department of Agriculture Natural Resources Conservation Service database, located at plants.usda.gov. The code consists of the first two letters in the genus name, the first two letters in the species name, and sometimes one or two numbers to distinguish between species with similar four letter codes.
UTM (Universal Transverse Mercator) - A mapping coordinate grid system based upon one of many different mapping projections. The BLM in eastern Oregon uses a projection in UTM Zone 11, US Datum of 1983 (CONUS NAD83). The data is displayed in meters easting and northing.
C.3.0 CONTRACTOR FURNISHED PROPERTY AND SERVICES
C.3.1 The Contractor shall furnish all labor, equipment, supervision, materials (except
Government furnished items specified in C.4.0) and incidentals necessary to perform vascular plant surveys in accordance with the enclosed specifications, terms, and conditions.
C.3.2 Surveyors shall meet the following technical requirements:
Project Leader, Supervisor - Writes survey results and is ultimately responsible for the performance of the survey crew.
Minimum Requirements:
1) Bachelor’s degree in botany or related field, such as biology or ecology.
Minimum 8 upper division credits in vascular plant taxonomy. Participation in professional workshops in vascular species identification can be counted for credit (32 workshop hours equals one quarter credit hour).
2) Training and experience with field techniques for surveying for and locating Special Status vascular plants. Skill using technical dichotomous flora and botanical keys of eastern Oregon floristic ecoregions listed under Section C.3.3.h.
3) Skill using 35 mm or digital camera, GPS unit, aerial photos, topographical maps, and compass. Skill navigating in rough country using maps, compass, and GPS unit.
4) Experience completing survey reports, organizing crews to complete surveys within biological windows, and coordinating and reviewing final paperwork submission for quality control.
Crew - Crew Leader supervises survey crew and data collection. Crew Member conducts botanical surveys and collects field data. Trainee conducts botanical surveys and collects field data under the supervision of the crew leader. Only one or two trainees may be utilized.
Minimum Requirements:
1) 4 upper division credits in vascular plant taxonomy. Participation in professional workshops in vascular species identification can be counted for credit (32 workshop hours equals one quarter credit hour).
2) Training and experience with field techniques for surveying for and locating Special Status vascular and nonvascular plants. Ability to use technical dichotomous flora and botanical keys of eastern Oregon floristic ecoregions listed under Section C.3.3.h.
3) Ability to navigate in rough country using maps, compass, and GPS unit. Ability to use 35 mm or digital camera.
4) Ability to complete all required report forms.
C.3.3 Specifically, but not necessarily all inclusive, the Contractor shall furnish:
a. Compass with azimuth and declination setting.
b. GPS unit that can download information to ArcMap10.5.1
c. Clinometer.
d. Hand lens (minimum magnification 10 X).
e. Dissecting microscope.
f. 35 mm camera with 200 or 400 ASA film or digital camera with a minimum resolution of 5 mega-pixels and zoom capability, JPEG format on CD, and high quality photo-paper for color hard copies.
g. Cronquest, A. Holmgren, N. Holmgren, & Revel Intermountain Flora , Hitchcock & Cronquist Flora of the Pacific Northwest, Peck A Manual of the Higher Plants of Oregon, Whitson et al. Weeds of the West, or other appropriate flora required to accurately identify plants encountered during the inventories.
h. Minimum of two colors of fine-lined permanent marking pens for marking aerial photos and topographical maps.
i. Wide-lined permanent markers for marking flagging and plant sites in the field.
j. Additional color photo copies of aerial photos if needed (BLM provides one upon request).
k. Additional copies of 1:12,000 topographical section maps if needed (BLM provides two upon request).
C.4.0 GOVERNMENT PROVIDEDPROPERTY AND SERVICES
C.4.1 The Government will furnish to the Contractor the following materials, information, property or services:
a. District road maps and topographic maps of project areas.
b. Electronic shapefiles of the survey units – available upon request, lneely@blm.gov
c. Flagging for populations of Special Status plants.
e. Word compatible versions of Special Status Plant Survey Report Form (Attachment 5), Special Status Plant Site Form (Attachment 6), and Noxious Weed Report Form (Attachment 7).
f. Vale District Special Status Plant Lists (Attachment 3).
g. Oregon State Noxious Weed list (Attachment 4).
C.4.2 The Contractor shall be liable for all loss or damage of such Government-provided property until completion and final acceptance of work required under this contract.
All property not consumed during the performance of this contract, shall be returned upon acceptance of the work required under this contract. Items will be available from the COR at the Vale District Office, 100 Oregon St, Vale, OR 97918.
C.5.0 SPECIFIC TASKS
C.5.1 Field Work
C.5.1.1 Survey Methodology: Surveys for Special Status vascular plants shall be conducted using the Intuitively Controlled Survey Method. Units shall be surveyed by walking routes that cover a representative cross section of all major topographic (slopes, draws, benches, ridges) and special features (wet areas, rock out crops, riparian areas, etc.) of each survey unit. Upon arrival in an area of high potential habitat, a more thorough survey for the target species should be made. Noxious weeds shall be documented when encountered.
C.5.1.2 Units where boundaries are not clearly identified on the ground shall be surveyed by approximating the boundary location from GPS and shapefiles of units provided by the Government.
C.5.1.3 Tracking routes: Survey routes may be tracked and recorded with a GPS. GPS tracked routes will be recorded on a GPS in NAD 83 UTM Zone 11. Recorded tracts shall be given to BLM in GIS shapefile format.
C.5.1.4 Noxious weeds: The Contractor shall collect noxious weed data when populations are encountered. Data collection will include the following tasks:
a. Indicate the extent of the population as a polygon associated with a GIS shapefile or on a separate topographical map and aerial photo.
b. Complete the Noxious Weed Report Form (Attachment 7)
C.5.1.5 The Contractor shall compile species lists for each unit of all vascular plants encountered during surveys. The lists shall be specific for the unit surveyed, not generic lists, and shall include all species encountered and no species not encountered. The lists shall be in the formats shown in Attachment 8. Vascular species lists shall include species codes (USDA NRCS Plants Database), scientific names, common names, families, special habitats, if applicable, and Special Status.
Special habitats include areas such as riparian areas, rock outcrops, old growth juniper. All species lists should include a heading on each page with the 1.) project name, 2.) legal description, 3). type of survey (vascular), 4). survey date, and 5.)
Surveyor’s name.
C.5.1.6 The Contractor shall complete a Survey Report for each contract item surveyed, whether or not Special Status plant sites are found. A habitat summary by contract item shall be provided in each survey report. The summary report shall include information on topography (including relationship to watershed), special habitats (e.g.
seeps, rock outcrops), apparent history (e.g. burned), management effects, Special Status plants and habitats if found, noxious weed populations encountered, dumps, impacts from heavy OHV use or grazing, and other noteworthy observations.
C.5.2 Documenting Special Status Vascular Plants
C.5.2.1 When Special Status vascular plants are discovered, the location or boundaries of the population shall be clearly delineated on the ground as described below with flagging provided by the COR. The Contractor shall also indicate on the site form how the site was flagged.
a. Sites less than 30 feet in diameter shall be marked with two long flags as close to the center of the population as possible, but in a location where they can easily be seen from a distance. If no trees or shrubs are close to the species occurrence to attach the flags to, hang them on the closest trees or shrubs within 50 feet and indicate on the flagging the azimuth and distance to the actual plant location. Hang 4 flags that can be seen from a distance around the population. Map as a point on topographical map and aerial photo.
b. Populations greater than 30 feet in diameter shall be marked with single flags around the perimeter of the population and double flags close to the actual locations of the Special Status plants. Map the population on the topographical map and aerial photo as a small polygon. Populations within 300 feet of each other shall be included on one site form, but flagged and mapped separately and GPS coordinates collected for each site. Subpopulations shall be uniquely numbered on the map, on the site form, and on the ground.
c. For all populations, label flagging from the knot down on the upper end of the flag, using a wide-tipped permanent black marker. Include the plant code (NRCS), date, site number, and surveyor’s initials on the flags. Clearly label flags for multiple sightings of one species within one unit or proposed project area as Population 1, 2, 3, etc. When multiple flagging is hung at a site, label the center flag with all required information and at least some of the additional flags with the species code and the site number. For larger populations, indicate on the site form how the site was flagged and signed.
C.5.2.2 Record population, habitat, and site data on a Special Status Plant Site Form
(Attachment 6).
C.5.2.3 Photograph Special Status species. Take at least one photograph of the plant(s) and at least one photograph of the general habitat where it is located. The habitat photograph should be taken after identifying flagging has been hung. Label each photograph with the township, range, section, unit number, species code, site number, date, and surveyor’s name.
C.5.2.4 Collect UTM coordinates at the site and record on the site form. Indicate the type of
GPS equipment used on the site form (e.g. Trimble Juno). The GPS point data should be accurate to within 30 feet. The accuracy level shall be recorded on the site form if provided on the GPS unit (e.g. accurate within 8 feet). No more than 15 minutes total is required at any site to collect GPS point data. If, after this time, insufficient satellites are detected, try off-setting the location to an area where adequate satellites are detected and record the distance and azimuth to the site on the site form. If insufficient satellites are detected after 15 minutes at the offset location, no further attempts are required and the mapped location will be accepted.
The GPS equipment should be programmed at the following settings:
Coordinates: UTM Zone: 11 North Datum: North American Datum 1983 Units: Meters
C.5.3 Documentation
C.5.3.1 All field work shall be fully documented. For inspection purposes, progress reports on work completed shall be submitted to the COR every two weeks, including GIS tracks of survey routes and shapefiles or maps with the locations of any noxious weeds and special status plant species. The day and time for submittal of progress reports will be established at the pre-work conference.
C.5.3.2 The following documentation is required for each contract item completed:
a. Special Status Plant Survey Report.
b. GIS shapefile with survey routes for each unit surveyed. The shapefile must be compatible withArcMap.
c. Special Status Plant Site form for each Special Status vascular plant population.
d. Separate topographical map showing each Special Status plant location found.
The map should contain only the population described on the Plant Site form.
e. Composite topographical map for each section showing all Special Status plant sites.
f. Separate topographical map(s) for noxious weed populations, with locations and data.
g. Vascular plant species list (hard copy and electronic) of all plants encountered during the surveys.
h. Narrative report.
i. Photographs of Special Status vascular plants found.
j. Vouchers of Special Status vascular plants found.
C.5.3.3 The Contractor shall review and edit all forms and maps prior to submitting them to the COR to ensure that forms are properly filled out and all information submitted is legible. All paperwork shall be organized and submitted by unit.
C.5.4 Special Status Plant Collection
C.5.4.1 A voucher specimen showing key identifying characteristics shall be collected and pressed for each special status vascular plant site located. Collection of Special Status plant species shall be made only when the population can withstand a reduction in its numbers. The minimum number of vascular plants in a population which can withstand a reduction shall be twenty or more. No collection shall be made in populations of less than twenty without the authorization of the COR. No collection of Threatened, Endangered or Proposed species shall be made.
C.5.4.2 All vascular plant voucher collections shall be pressed and dried to herbarium standards as described in Vascular Plant Taxonomy by Dirk R. Walters and David J.
Keil with labels bearing the survey unit name, unit number, township, range, section, species name, date collected, and collector. The collection number shall be written on the corresponding site form. E.1.0 INSPECTION
E.1.1 Field Survey
E.1.1.1 The Contractor shall update the COR or Project Inspector (PI) during the every other week progress reporting of which units have been surveyed. Based on Contractor’s bi-weekly progress reports, the COR may inspect a randomly selected 10% or more of the areas where surveys have been completed, evaluating (1) if a representative cross section of the unit was surveyed, and (2) that no noxious weeds or Special Status plants were overlooked.
E.1.1.2 At a minimum 10% of all positive sightings will be inspected.
E.1.2 Documentation
E.1.2.1 100% of the field forms and maps will be inspected.
E.2.0 ACCEPTANCE
E.2.1 The Contractor will receive payment for units inspected and accepted.
E.2.2 For field surveys: 90% of special status plant sites, and noxious weeds were found and flagged according to the contract specifications. For documentation 100% of the required fields on field forms completed with accurate information.
E.2.3 The Contractor will be required to rework any area or portion thereof that does not meet the terms of the contract. If the inspection reveals the need for rework, the COR will notify the Contractor immediately in writing. All rework must be completed prior to proceeding with new areas.
E.2.4 Documentation shall be submitted within the timeframes specified in the BPA call.
Failure to submit paperwork within the established timeframe may be cause for default of the BPA call. The COR will inspect all documentation for legibility and completeness according to specifications in Section C.
E.3.0 PAYMENT
E.3.1 Payment will be made for the number of units completed and accepted at the unit price stated in the contract. Partial payments will be allowed for this contract.
E.3.2 Final payment under the contract will not be made until all Government-furnished property not consumed during performance of the contract has been returned as directed by the COR.
E.3.3 Measurement of Survey Areas - Survey area acreage is determined by digitizing proposed units from hand drawn maps into an ArcMap GIS program. Acreages are then calculated by ArcMap.
E.3.4 Re-measurement of Survey Areas
E.3.4.1 The Contractor may, at any time during the course of the contract, request in writing to the CO re-measurement of any survey area if they think that the acreage stated in the task order and on the project maps is incorrect.
E.3.4.2 If re-measurement indicates that a variance of 5% or less exists, the Contractor shall pay for the actual cost of the re-measurement. Payment will be based on the acreage stated in the task order.
E.3.4.3 If re-measurement indicates that the actual acreage variance is more than 5% of that shown in the task order, payment will be based on the re-measured acreage. The cost for re-measurement will be incurred by the Government.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.
The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.
Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph
(d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
