About this file

This document is a Justification and Approval for a sole-source acquisition under simplified acquisition procedures. The Bureau of Land Management (BLM) Colorado State Office seeks to award a firm-fixed-price commercial purchase order to the original equipment manufacturer (OEM) or distributor of Steelcase furniture to redesign and supplement furniture for an executive assistant suite. The total estimated value is $15,899.61. The rationale for sole-source justification is that the incumbent vendor has proprietary drawings and design information, and any other contractor would require duplication of effort, increasing costs and delaying workspace access. The contract will be awarded to Steelcase (UEI: GGKLKCCKVZ16) under the GSA Multiple Award Schedule. No additional furniture items are anticipated at this time, and future requirements will be competed under FAR Part 15.

SOLE SOURCE (INCLUDING BRAND NAME) JUSTIFICATION AND APPROVAL

FOR ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION PROCEDURES

This document sets forth the justification and approval as required by 13.106-1(b)(1) &(2).

1. Contracting agency and activity.

The Department of the Interior, Bureau of Land Management (BLM) – Colorado (BLM-COSO), State Directors Office, Lakewood, CO, requests the Division of Support Services Branch of Business Services, Lakewood, CO, to contract on a brand name basis.

2. Nature and/or description of action being approved.

The requirement is anticipated to result in the award of a Firm-Fixed-Price Commercial Purchase Order pursuant to FAR 13.302 with a Period of performance concluding within 90 days of award.

The government intend to make award to the OEM or distributor of Steelcase furniture (UEI:

GGKLKCCKVZ16) pursuant to paragraph 6. The government determines that the product service code for this procurement is 7110 Office Furniture and NAICS 337214 Office Furniture (except wood) Manufacturing.

3. Description of supplies or services.

The Colorado State Office (140L17) of the Bureau of Land Management seeks a qualified contractor for the redesign of furniture and supplement key items to maintain a uniform appearance and functionality in establishing an executive assistant suite. The suite must establish a receptionist station maximizing the use of the existing two cubicles of materials and minimize the addition of new materials to render the area functional. There is an additional requirement for lateral filing space supplemented by upper storage, galley storage, a buffet credenza maintaining a uniform design and appearance across the workspace.

4. Estimated dollar value.

Quote is for $15,899.61 http://www.blm.gov/colorado

5. Statutory authority.

41 U.S.C. 1901 – Simplified acquisition procedures (use when the simplified procedures for purchases of property and services for amounts (1) not greater than the simplified acquisition threshold

6. Rationale supporting use of the authority stated in paragraph 5.

BLM-COSO recently moved our State Office to the DFC and GSA awarded the furniture requirement to Workplace Elements (UEI: RV33A43BMGC1) via MAS 47QSMA21D08N8 based on competed GSA RFQ and was awarded the contract (47PJ0023F0021) to furnish our new building with furniture (Approximately $1,400,000).

A follow-on order (140L1723F0098) for $160,204.10 was requested and went out for bid.

No quotes were received on the original solicitation for the follow-on order. Due to this, a DI-1886 was issued to dissolve the SB set-aside. In the subsequent solicitation, the only quote that was received was from Steelcase who is a large business. The award was made to Steelcase (UEI: GGKLKCCKVZ16) in September 2023 for additional cubicle and furniture space. They used existing information from the original installation and have all our specifications and drawings related to the building. For any other contractor to provide these items would require a duplication of effort to design their items in the existing workspaces. This vendor has the colors, textures, and proprietary access to matching the existing furniture.

The additional work currently sought was solicited as 140L1724Q0006, a total small business set-aside, on 29 January 2024 and resulted in one estimate that did not conform to the technical requirements of the solicitation. Utilizing another, non-matching, product creates design inconsistencies that result in products that are not compatible with each other. Such inconsistencies detract from the professional appearance of the environment and limit the utility of the workspace. If the sole-source procurement of this follow-on requirement is not approved, then the workspace will remain incomplete subject to the complete replacement of furniture in the office space costing in excess of $1,400,000 compared to the anticipated cost equaling less than one percent of the alternative cost.

7. Other information.

The original vendor, who is a supplier of Steelcase furniture, competed in the original GSA RFQ against 362 other contractors and was deemed the best value for the government. They performed significant effort to coordinate with the customer and design the furniture to meet the needs to fit our space requirements. Those drawings are proprietary to the original vendor and Steelcase. Replacement of the incumbent contractor would require a duplication of cost and time to coordinate with the customer which has already been done with the requested vendor. The redesign, demolition, and build out of replacement furniture would result in a loss of workspace for employees and reduce production towards mission accomplishment for an unspecified period of time.

8. The efforts to identify additional sources including the market research conducted.

Market research was completed by the customer and Contracting Specialist in order to identify alternative offerors capable of providing compatible materials and design. Conversations with industry and an initial competition yielded the following information: competition of this follow-on requirement and award to a contractor other than the incumbent results in substantial duplication of efforts, inexecutable impacts to the budget, and unacceptable delays in access to the workspace. These furniture items are on the GSA schedule with prices that are already determined fair and reasonable as catalog pricing.

9. Future plans to permit competition.

The required furniture items are on the GSA schedule with prices that are already determined fair and reasonable. No additional furniture items are anticipated at this time. Evaluation of UNICOR provided sources resulted in the determination that products did not meet the quality requirements of the government. Future requirements will be synopsized to include the possibility of discussions under a FAR 15 competition.

10. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.

I certify that the facts and representations under my cognizance, which are included in this justification, and which form a basis for this justification, are complete and accurate.
