ADDITIONAL INFORMATION
1. Background
Wild horses and burros on public lands administered by the Bureau of Land Management (BLM), and Forest Service are protected, managed and controlled under the provisions of the Act of December 15, 1971, as amended (16 U.S.C. 1331-1340). As resource conditions and other factors warrant, excess wild horses and burros are removed from the public lands and placed in private maintenance through the Adopt-A-Horse program. The pregnancy status of wild horses and burros is unknown when they are removed from the range, but it is anticipated that many will be pregnant at various stages. Vaccinations and de-worming are deemed especially important by the public in the adoption program. Adopters view vaccinations and de-worming as a very important factor in their decision to adopt due to the time needed for gentling the animals before additional vaccination could be administered. The purpose of this contract is to obtain a supply of common horse vaccine to administer to wild horses and burros.
2. Objective
All wild horses and burros removed from public lands will require vaccinations prior to being offered for adoption or moved to holding facilities. Due to the wild nature of these animals, to minimize the stress of handling and to increase labor efficiency in the face of a high workload, the vaccine needs to be easily administered with little time spent preparing the vaccine at the time that it is administered.
Vaccines must be provided in the combinations described in the schedule of supplies table above.
3. General Services
a. All vaccines will be administered by the BLM or a BLM designated individual.
b. Vaccines shall be provided so that they may be administered by injection. De-wormer shall be provided so they may be administered by oral delivery. Vaccines will stimulate a protective immune response in naïve horses and burros.
c. Vaccines will be available in multi-dose vials or preloaded into syringes. Vaccines will need to be preloaded in syringes or to be prepared for injection without mixing or other labor intensive or special handling requirements. The liquid de-wormer will need to be in at least 1-dose bottles.
The Moxydectin de-wormer is acceptable in single doses. The vaccines will need to be administered safely, quickly, and easily to the wild horses and burros in a variety of field situations.
d. Vaccines shall remain effective for at least 72 hours after being prepared for injection.
e. Vaccines and de-wormers need to be able to be administered in all types of weather, rain, snow, cold, heat, and sunlight without any adverse effects on safety or efficacy.
f. Upon request the Contractor must provide evidence that the vaccines and de-wormers are safe for use in a broad age range of horses and burros (or in foals greater than 4 months of age), with minimal side effects.
g. Upon request the Contractor must provide evidence that the vaccines and de-wormers are safe for use in pregnant horses or burros with minimal adverse effects on the animal or fetus.
4. Specific Requirements
a. The contractor shall have the ability to ship the vaccine overnight to areas within the United States where needed.
b. The contractor shall have access to product to support BLM needs and deliver within five days of notification.
c. The contractor shall provide product with a minimum of six (6) months of shelf life remaining. If the contractor delivers product that does not meet this requirement the government reserves the right to reject the product and have it replaced at no additional cost to the government with product that satisfies this requirement.
5. Contract Administration
Contract COR: In accordance with Clause 1452.201-70 Authorities and Delegations the Contracting Officer will appoint a Contract COR at time of contract award. The contract COR will be responsible for coordinating vaccine requirements with the BLM Facility Representative and the National Operations Center (NOC).
The contract COR provides technical direction which is guidance to support delivery on this contract and resultant delivery orders.
The term “Technical Direction” is defined to include:
• Providing written/verbal information to the contractor that assists in the interpretation of specifications.
• Review and approve product specifications, as needed, to be delivered by the contractor to the BLM Facilities under the contract.
The COR has the authority to issue technical directions that do not change the scope of the contract or resultant delivery orders. If, in the opinion of the contractor, the COR issues technical directions that change the scope of the contract or delivery order, the contractor shall not proceed and notify the Contracting Officer in writing within five (5) working days. Upon receiving notification from the contractor, the Contracting Officer shall:
• Advise the contractor in writing within five (5) business days after receipt of the contractor’s correspondence that the technical direction is within the scope of the contract effort and does not constitute a change under the “Changes” section of FAR 52.212-4; or
• Advise the contractor within a reasonable time that the Government shall issue a written change order; or
• Rescind the technical direction.
A failure of the contractor and contracting officer to agree that the technical direction is within the scope of the contract, or a failure to agree upon the contract action to be taken with respect thereto shall be subject to the “Disputes” section of FAR 52.212-4(d), of this contract.
The COR does not have the authority to, and may not, issue any technical directions which:
• Constitutes an assignment of additional work outside the terms and conditions of the contract or delivery orders.
• Constitutes a change as defined in Federal Acquisition Regulation (FAR) clause 52.212-4(c) title “Changes”, incorporated in this contract.
• Cause an increase or decrease in the total price or the time required for contract performance.
• Changes any of the expressed terms, conditions, or specifications of the contract.
• Interferes with the contractor’s right to perform the terms and conditions of the contract.
All such actions must be formalized by a proper contractual document executed by the CO. The contractor shall not take direction of any contract revisions without the written authority of the CO.
Upon designation the CO will notify the contractor in writing of the names, duties, and limitations of appointed COR. Acceptance of all work and effort under this contract shall be accomplished by the CO or the designated COR.
Correspondence Procedures
To promote timely and effective administration, correspondence submitted under this contract shall include the contract number/delivery order and shall be subject to the following procedures:

Delivery orders will be competed amongst contract awardees, contractors shall not propose unit pricing that exceeds the unit prices incorporated into the base contract, but may propose lower unit prices during delivery order competitions. When delivery of vaccines is of the essence (emergency or urgent need), the Contracting Officer may issue an oral and/or email notice to proceed to the successful offeror, with a formal delivery order to follow. Oral or email orders will only be issued after confirmation of availability of appropriated funds.
Delivery Orders will be issued in writing by an authorized warranted contracting officer within the BLM
NOC.
Any authorized changes to contract or delivery order content shall be documented by a modification to the contract and/or delivery orders.
Each delivery order may have multiple delivery locations. The Facility Representative located at each delivery location will verify the product conforms to the delivery order requirements and then notify the contract COR via e-mail of accuracy and/or non-conforming products; e.g. damaged product, outdated product, or quantity discrepancies, etc.
