About this file

This document is a noncompetitive justification for a federal contract award under the simplified acquisition threshold. The Department of the Interior US Geological Survey Office of Acquisitions and Grants awarded a fixed-price purchase order for $74,996 to AECOM Technical Services, Inc on September 22, 2023 to provide architectural and engineering design services. The services included designing a new metal deck and steel bar joist roof system to replace the deteriorated existing roof structure at Bay 1 of Building N144 at NASA Ames Research Center in Moffett Field. AECOM was selected noncompetitively due to urgency to protect the building from weather, as AECOM was already providing construction administration services for the project and could immediately begin the roof redesign after the existing roof's poor condition was discovered during renovation work.

NONCOMPETITIVE JUSTIFICATION FOR ACQUISITION UNDER THE

SIMPLIFIED ACQUISITION THRESHOLD

1. Contracting Agency and Activity. The Department of the Interior, United States Geological Survey, Office of Acquisition and Grants – Sacramento, has contracted on a single‐source basis. This document sets forth the justification for having done so as required by FAR 13.106‐1(b)(1), prepared retroactively due to urgency. Necessary approvals as indicated by signatures below were obtained verbally before awarding the contract action.

2. Nature of Action Being Approved. The action being approved is a new fixed‐price purchase order, number 140G0323P0367, awarded to AECOM Technical Services, Inc.

3. Description of Supplies or Services. A&E services in support of the replacement of the metal deck and steel bar joists (part of the roof structure) at bay 1 of building N144 at NASA Ames Research Center (Moffett Field).

4. Dollar Value. $74,996.

5. Statutory Authority. This action was awarded noncompetitively under the authority of FAR 13.106‐ 1(b)(1) – only one source reasonably available – due to urgency.

6. Rationale Supporting Use of Citation in No. 5. Building N144 is a warehouse. Bay 1 is currently under renovation for USGS’ use, while bays 2 through 4 are empty and will eventually be demolished by NASA. Part of the scope of renovation is structural revisions so that bay 1 can be a stand‐alone building, and replacement of the roof waterproofing, which was known to be leaking when the project started.

AECOM is the A&E contractor who completed the design and is currently supporting the project in a construction administration role. AECOM supports NASA at Moffett Field in many roles, and USGS acquired AECOM’s services for this project via an interagency agreement (assisted acquisition) with

NASA.

The roof system consists of heavy steel trusses, which support lighter steel bar joists, to which a corrugated metal deck is fastened. Looking up from inside the warehouse, one sees all these elements and the underside of the metal deck. Above the metal deck there is fiber insulation and a waterproof roofing membrane. The original design called for the construction contractor to remove the existing fiber insulation and membrane, patch any holes in the metal deck (it was assumed less than 20% of the area would need patching), and install new insulation and waterproofing membrane. Upon removal of the roofing materials, the metal deck was discovered to be extremely deteriorated. Pull tests indicated that approximately 85% of the deck needed to be replaced and the manufacturer of the intended roofing membrane refused to issue a warranty if the product was installed on the existing decking. With that level of deterioration and years of water intrusion, and because the bar joists are a light gauge of steel compared to the trusses, AECOM recommended and USGS decided the best course of action was to replace the entire system – deck and joists – rather than attempt an extensive repair. The heavier trusses are assumed to be sound, or at least repairable.

This means AECOM needs to design a new bar joist and deck system, perform structural calculations to make sure the existing trusses and the rest of the building can support it, submit the new design to NASA for permit review, review submittals from the construction contractor, etc.

The urgency of getting the building protected from the weather justifies the noncompetitive purchase order, issued to AECOM on 09/22/2023. They were able to start the design immediately and, as of the date of this document, have already produced a preliminary set for the construction contractor to begin engaging with potential subcontractors. No other contractor could be reasonably expected to begin immediately to protect government property because of AECOM’s existing proximity to the project.

They are familiar with the building and the authority having jurisdiction (AHJ) and, further, we are acting on their recommendation to replace the entire roof structure. If we sought competition, we would first have to absorb the delay associated with competition itself, then the delay associated with another contractor familiarizing themselves with the existing conditions, analyzing them, and making a recommendation. With AECOM’s recommendation in‐hand, we need to act.

7. Other Information. None.

8. The Efforts to Identify Additional Sources Including the Market Research Conducted. Market research indicates no other contractor could have been reasonably able to perform this emergency design work as noted in paragraph 6.

9. Future Plans to Permit Competition. This was a one‐time action. Any additional work which AECOM may need to perform for USGS related to this project will occur via modification to the existing interagency agreement.

10. Recommendation and Certification from Program Office

Based on the information above, which I certify to be accurate and complete to the best of my knowledge and belief, I recommended this acquisition be conducted on a noncompetitive basis.

11. Certifications from the Contracting Officer

The firm‐fixed price is fair and reasonable. It is based on AECOM’s underlying contract rates and an assumed level of effort and labor mix that appears appropriate for the scope of work required, as reviewed by the Project Manager.

Based on the information above, which I certify to be accurate and complete to the best of my knowledge and belief, I executed noncompetitive purchase order 140G0323P0367 on 09/22/2023 after discussing with the undersigned Bureau Competition Advocate on 09/21/2023.
