About this file

This is an evaluation criteria document that outlines how proposals will be evaluated for a commercial items solicitation. The evaluation will be based on two primary factors: Technical Approach/Capability (rated as either Technically Acceptable or Unacceptable) and Price. The award will go to the lowest-priced, technically acceptable offer.

This document relates to solicitation #140G0125Q0068 from the US Geological Survey for passive soil gas samplers, drill bits, analysis services, and delivery of Level IV data package and isopleth maps. While the evaluation criteria suggests a competitive process, the related opportunity notice indicates USGS intends to make a non-competitive award to Batta Environmental Associates for sampling of NARL Lagoons. The anticipated award date is March 3, 2025, with no option years. The NAICS code is 541380 with a size standard of $19.0M. Though listed as a competitive solicitation, the notice states it is for informational purposes only with the intent to award noncompetitively under FAR 13.106-1(b)(1).

52.212-2 Evaluation - Commercial Items (OCT 2014)

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Technically Approach/Capability

(i) Technically Acceptable - Proposal clearly complies with all requirements of the PWS/specifications/salient characteristics and solicitation.

(ii) Technically Unacceptable - Proposal does not clearly comply with all requirements of the PWS/specifications/salient characteristics and solicitation and/or lacks sufficient detail to be properly evaluated.

(2) Price The purchase order will be awarded to the offeror submitting the lowest priced proposal that is technically acceptable in technical approach/capability.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
