About this file

This document is a Standard Form 30 Amendment of Solicitation/Modification of Contract for a Phragmites Herbicide Treatment project at Chincoteague National Wildlife Refuge. Amendment 0002, effective 07/21/2025, addresses an industry concern regarding Unmanned Aerial Systems (UAS) usage, specifically noting that the DJI AGRAS T40 Systems do not meet End-Product Contracting requirements aligned with the 2024 National Defense Authorization Act (NDAA). The contract closing remains 11 August 2025 at 2pm, with technical points of contact including Lauren Cruz and William (Scott) Schwenk, and the contract point of contact being Fred Riley. The amendment includes guidance on UAS restrictions, emphasizing that covered UAS manufactured by or containing components from adversary countries are prohibited, with specific operational and funding limitations for Department of Interior contracts.

Questions and Answers

Question 1: Are able to submit our proposal by the due date with utilizing our two proven systems ( DJI AGRAS T40 Systems.)

Answer 1: Unfortunately, "DJI AGRAS T40" is not listed on the "Non-Covered UAS" (Approved) list. Therefore, it does not meet End-Product Contracting (Aligned with the 2024 NDAA) requirements.

Additional information below-

We discussed guidance on the use of UAS/drones for this project that lead to reviewing Appendix 2 - Guidance for End-Product Contracting (Aligned with the 2024 NDAA) of DOI Operational Procedures Memorandum (OPM) -11 (attached)... policy covers the acquisition and use of all UAS under the operational control of DOI bureaus and offices as well as operations under departmental contracts, grants, and cooperative agreements relying on UAS for achieving objectives.

6. DOI Implementation of the 2024 National Defense Authorization Act (NDAA)

In compliance with the requirements of the 2024 NDAA, the Department of the Interior (DOI) will adopt the following policies to ensure that all UAS-related activities, acquisitions, and operations align with the Act's provisions. This policy outlines the processes for achieving compliance across the DOI's bureaus and offices.

A. Compliance with NDAA Restrictions

1) The DOI will not procure, operate, or authorize the use of any UAS systems or components manufactured by entities in, or with significant connections to, countries designated as adversaries under the NDAA.

Appendix 2 excerpts:

Contracts must ensure that no covered UAS are used in performance of DOI missions unless exempted by the 2024 NDAA

1. Funding Restrictions: "Department contracts, grants, and agreements shall not allocate funds for the use of covered UAS."

2. Operational Restrictions: "Covered UAS shall not be operated on Department-managed lands."

A "covered UAS" (NOT authorized) is defined as any UAS that:

• Is manufactured by an entity domiciled in an adversary country.

• Contains critical electronic components (e.g., flight controllers, radios, cameras) made by an entity in an adversary country.

• Uses operating software developed by an entity in an adversary country.

• Relies on network connectivity or data storage administered by an adversary country.

• Transmits data or imagery through components manufactured by such entities.

End Product contracts ensure contractors deliver specified outcomes without aviation-specific oversight by DOI. Adhering to the 2024 NDAA and related policies ensures compliance, particularly regarding the use of covered UAS. Bureau personnel must focus on procurement oversight, not operational control of contractor aircraft, to maintain clear boundaries between End Product and flight service contracts.
