Pursuant to FAR subpart 13.106-1(b)(1)(i) and (ii), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Text3: Life Technologies instrument specialist informed the CGL that Life Technologies will not distribute non-consumable parts or service to 3rd parties. Due to this information no other sources exist that can supply repairs and preventative maintenance using original Life Technologies parts as well as remote technical support.
Text2: Life Technologies has proprietary rights to the instruments mentioned above and is therefore the only source that is qualified to provide technical support of the instruments and supply the parts needed for continued support of these systems. Life Technologies does not distribute non-consumable parts or service to 3rd parties making it impossible for any other source to perform repairs and maintenance for continued support of this system.
Text1: The CGL needs to purchase a service agreement for Life Technologies instrumentation used in its laboratory. These instruments are only sold and serviced by Life Technologies. The service agreement includes on-site repair service, inspection and maintenance with a 2 business day service response time. A yearly inspection and maintenance visit by a service engineer is also included. This service capability is essential for keeping these technical and expensive machines in good working order to allow the Conservation Genetics Lab to continue efficient operations. The estimated cost of the agreement is $92,009.89 per year.
Text4: Due to the fact that Life Technologies is the sole proprietor for their equipment for service agreements and maintenance. Barriers to completion could not be overcome.
Text6: This contract has been awarded historically to Life Technologies. The most recent contracts were PO 140FS123P0243 and 140FS123P0324. The current request will combine these contracts and add an additional three instruments that have expiring warranties. Allowing for annual inflation and the consolidation and increase of instruments onto a single quote this quote is in line with prior year costs. The price is deemed fair and reasonable.
