Emergent Vegetation Suppression to Create Large Grebe Nesting Habitat

Tule Lake National Wildlife Refuge Klamath Basin NWRC

1. GENERAL

1.1 Introduction

This is a non-personal end-product service contract for the control of encroaching emergent vegetation in managed wetlands on the Tule Lake National Wildlife Refuge (NWR) to create and enhance wetland fringe and hemi-marsh nesting habitat for large grebe species. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and non-personal services necessary to perform work services outlined in this Statement of Work except those items specified in the Government Furnished Equipment or Materials section below.

1.2 Purpose

The purpose of this work is for herbicide application to approximately 600 acres of emergent cattails that are encroaching into open water and degrading grebe nesting habitat. Treatment will consist of application of aquatic glyphosate (e.g. Aquamaster) with all necessary surfactants and adjuvants as necessary. Locations for treatments (see figure 1) are broadly outlined but discretion must take place during time of treatment to avoid sensitive wildlife and desirable wetland vegetation (e.g. hard stem bullrush). Equipment capable of herbicide application in technically challenging application conditions in dense wetland vegetation with no road or boat access is necessary to achieve this level of accuracy in treatments.

1.3 Contractor qualifications

The contractors shall have the following skills, licenses, equipment, and demonstrated experience in 1) herbicide application of invasive plants in technically difficult application conditions, with ability to identify wetland vegetation by species before application 2) the collection, analysis, and summary of application spatial data 3) ability to safely navigate wetland emergent marsh habitat without disturbing sensitive wildlife species or habitats. 4) equipment able to meet the requirements to operate on federal property using federally allocated funds.

2. PLACE/DELIVERY AND PERIOD OF PERFORMANCE:

2.1 Place of performance

Tule Lake National Wildlife Refuge, California. (Figure 1 below).

2.2 Period of performance

The contract window shall be from Date of award through October 31, 2026. The optimal treatment window is late summer to early fall (August-September) to take advantage of optimal cattail translocation timing, and treatments must take place before the public waterfowl hunt season begins in early October. A spatial map of the treatment area will be provided within two weeks of treatments. A contracting window extending through 2026 is due to the large project size and to account for time constraints in the application window if all treatments cannot be completed in a single season.

2.3 Duty hours

Normal FWS duty hours are Monday through Friday, 8:00 AM – 4:30 PM Pacific Time. In the event of emergencies, the Contractor shall provide contact information. Emergency/Miscellaneous maintenance functions may be required to be scheduled during non-duty hours due to the nature of the work or specific scheduling requirements. FWS Non-duty hours include weeknights, weekends, and Government holidays.

3. GENERAL CONDITIONS AND SPECIFICATIONS:

3.1 Scope

The Klamath Basin National Wildlife Refuge Complex, herein referred to as the Refuge, requires equipment, personnel, and services to conduct herbicide treatment on approximately 600 acres of emergent wetland vegetation (primarily cattails) in order to create and improve hemi-marsh habitat for large nesting grebe species (e.g. Western and Clark’s). Treatment will consist of applications of aquatic glyphosate (i.e. Aquamaster) with all necessary surfactant and adjuvants necessary, and mapping of all treated areas with GIS compatible equipment.

Locations for treatments (see figure 1) are broadly outlined using satellite imagery but have not been ground-truthed to differentiate cattails from open water or desired vegetation or identify sensitive wildlife. Discretion must take place during time of treatment to avoid sensitive wildlife as well as desirable wetland vegetation (e.g.

hard stem bullrush). A map of treatment areas will be provided to the contractor before treatment; however, the applicator will have to determine which areas within these areas to treat to maximize application on cattails, and minimize application to open water, hard stem bullrush, and sensitive wildlife.

Equipment capable of herbicide application over wetlands inaccessible by roads or boats is necessary to achieve this level of accuracy in treatments. Due to the technical challenge of applying emergent vegetation over open water habitat along sinuous stream channels and semi-open bays, a vehicle capable of a large degree of precision is necessary to complete this project while avoiding large patches of established desirable vegetation (i.e.

hardstem bullrush), open water devoid of vegetation, or sensitive wildlife.

3.2 Data Collection Standards

The contractor will keep a record of all herbicide and adjuvants used during treatment and record an accurate treatment dispersal trajectory with software compatible with ArcGIS Pro (ESRI).

3.4 Sensitive Habitat and Species Avoidance

The contractor shall work with the Refuge staff to determine areas to avoid for operational safety, which shall be identified and provided to the contractor before operations begin. Any locations to be avoided due to risk of human or wildlife disturbance will be identified and provided to the contractor before operations begin, or during operations as necessitated by site conditions.

4 CONTRACTOR RESPONSIBILITY

4.1 Equipment

The Contractor shall supply all appropriate application equipment, supplies, herbicides, adjuvants, applicator(s) and support (equipment and personnel) for transporting and tracking and mapping application data. All repairs and servicing of equipment and PPE will be the responsibility of the contractor. Any damage to refuge property resulting from the misuse of equipment, or spills resulting from equipment or pesticide will be the full responsibility of the contractor.

Contracting statement on prohibiting non-compliant UAS:

The use of an unmanned aircraft system (UAS or drone) manufactured or assembled by American Security Drone Act-Covered foreign entities is prohibited. This includes all UAS that:

• Is manufactured by an entity domiciled in an adversary country.

• Contains critical electronic components (e.g., flight controllers, radios, cameras) made by an entity in an adversary country.

• Uses operating software developed by an entity in an adversary country.

• Relies on network connectivity or data storage administered by an adversary country.

• Transmits data or imagery through components manufactured by such entities.

4.2 Transportation and Fueling

Contractor is responsible for providing the appropriate personnel, safety equipment for transportation and fueling and mixing all equipment and pesticides following all pertinent federal, state, and local laws.

4.3 Communication

Before and during the treatment Contractor will communicate with the Project Coordinator to identify any hazards, sensitive habitat or species concerns, or changes to habitat conditions or species. The contractor will provide progress reports following each application day to Service staff via conversations, in-person meetings, or email as necessary to update staff on accomplishments and issues.

4.4 Law and Policy

1) Contractor is responsible for having all the appropriate licenses and permits needed for operating equipment and applying pesticides.

2) The contractor must comply with all applicable federal, state, and local regulations and land-use permitting procedures.

3) Operator is responsible for following all other appropriate laws and policies applicable to the Department of the Interior, including the NDAA covering UAS operations if applicable.

5. INSPECTION AND ACCEPTANCE:

The contractor will be evaluated as detailed herein. All work included in the contract specifications shall be subject to inspections by the U.S. Fish and Wildlife Service at periodic intervals during performance of this contract. Final acceptance shall be based upon satisfactory completion of the work in accordance with the specifications on a task-by-task basis.

6. GOVERNMENT FURNISHED EQUIPMENT OR MATERIALS/INFORMATION:

U.S. Fish and Wildlife Service shall provide to the Contractor a map of treatment areas and identify any hazardous locations and sensitive wildlife habitat to avoid during application.

DOI-AAAP-0050 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (DEC

2015)

1) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.

2) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

3) We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official (AO). Information in the report must be protected as source selection sensitive information not releasable to the public.

4) When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.

5) Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.

a) Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment.

b) Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.

c) All information provided should be reviewed for accuracy prior to submission.

d) If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.

e) Your response is due within 60 calendar days after receipt of the CPAR. On day 15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.

f) If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."

6) The following guidelines apply concerning your use of the past performance evaluation:

a) Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.

b) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

c) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.

7) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.

8) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than , the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor-

(1) Any order for a single item in excess of ;

(2) Any order for a combination of items in excess of ; or

(3) A series of orders from the same ordering office within days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph

(b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of clause)

52.216-22 INDEFINITE QUANTITY (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the 'maximum.' The Government shall order at least the quantity of supplies or services designated in the Schedule as the 'minimum.'

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract afterPoP Expiration.

52.217-7 OPTION FOR INCREASED QUANTITY-SEPARATELY PRICED LINE ITEM (MAR 1989)

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to PoP expiration. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to PoP expiration.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years 6 months.

52.252-6 AUTHORIZED DEVIATIONS IN CLAUSES (NOV 2020)

(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the clause.

(b) The use in this solicitation or contract of any Department of the Interior Acquisition Regulation (48 CFR Chapter 14) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the name of the regulation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. 52.223-2, Reporting of Biobased Products Under Service and Construction Contracts (MAY

(a) Definitions. As used in this clause—

Biobased product means a product determined by the U.S. Department of Agriculture (USDA) to be a commercial product or industrial product (other than food or feed) that is composed, in whole or in significant part, of biological products, including renewable domestic agricultural materials and forestry materials, or that is an intermediate ingredient or feedstock. The term includes, with respect to forestry materials, forest products that meet biobased content requirements, notwithstanding the market share the product holds, the age of the product, or whether the market for the product is new or emerging. ( 7 U.S.C. 8101) ( 7 CFR 4270.2).

USDA-designated product category means a generic grouping of products that are or can be made with biobased materials—

(1) That are listed by USDA in a procurement guideline available at https://www.biopreferred.gov/resources/categories.html; and

(2) For which USDA has provided purchasing recommendations (available at https://www.biopreferred.gov ) or 7 CFR part 4270.

(b) The Contractor shall report to https://www.sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any biobased products in USDA-designated product categories purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and

(c) Submit this report no later than—

(1) October 31 of each year during contract performance; and

(2) At the end of contract performance.

52.223-10, Waste Reduction Program (MAY 2024) (DEVIATION FEB 2025)

(a) Definitions. As used in this clause- Recycling means the series of activities, including collection, separation, and processing, by which products or other materials are recovered from the solid waste stream for use in the form of raw materials in the manufacture of products other than fuel for producing heat or power by combustion.

Waste prevention means any change in the design, manufacturing, purchase, or use of materials or products (including packaging) to reduce their amount or toxicity before they are discarded. Waste prevention also refers to the reuse of products or materials.

Waste reduction means preventing or decreasing the amount of waste being generated through waste prevention, recycling, or purchasing recycled and environmentally preferable products.

(b) The Contractor shall establish a program to promote cost-effective waste reduction in all operations and facilities covered by this contract. The Contractor’s programs shall comply with applicable Federal, State, and local requirements, specifically including Section 6002 of the Resource Conservation and Recovery Act ( 42 U.S.C.6962, etseq.) and implementing regulations (40 CFR Part 247).
