Trap Box FWS
SOLICITATION NO. 140FS125Q0027
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a separate written solicitation will not be issued.
U.S. Fish and Wildlife Service Dworshak NFH is issuing a request for Quotes for a Yankee Fork
Trap Box. Please see below Statement of Work for more info.
This Request for Quotation (RFQ) is a TOTAL SMALL BUSINESS SET ASIDE and is conducted under the procedures of FAR Parts 12 and 13, incorporating provisions and clauses in effect through Federal Acquisition Circular 2024-07. The NAICS code is 332999 and the small business size standard is 750 employees.
Instructions
All responsible small business sources may submit a quote, which shall be considered by the agency. Award will be made as a firm-fixed-price contract. The basis of award is the lowest price technically acceptable. All offers will be opened to establish a competitive range. Only those offers in the competitive range will be reviewed for responsibility and award. Quotes shall specify cost per ton and include cost of material, delivery, placement, and all associated fees and costs. Award will be made to a responsible source pursuant to FAR subpart 9.1.
Technical Acceptability: Selected Vendor must be within a 50-60 mile radius from the
Dworshak NFH.

STATEMENT OF WORK
Idaho Fish and Wildlife Conservation Office
10/29/2024
1. GENERAL:
The Idaho Fish and Wildlife Conservation Office (IFWCO) works with Tribal Partners on fisheries related issues throughout the State of Idaho. Currently, IFWCO has been building a resistance board weir for the
Shoshone-Bannock Tribe so they can capture adult Steelhead returning to the Yankee Fork in the Upper
Salmon River drainage. This resistance board weir replaces the Tribe’s existing picket weir that they operate in the summer and fall to capture Chinook Salmon. The new resistance board weir will allow operation in higher flows. All components (rail and panels) of the new weir have already been fabricated by IFWCO staff except the new trap box. The rail to the weir has already been installed in the stream.
IFWCO needs to have a new aluminum trap box fabricated by a contractor that will handle the higher flows for this spring trapping season. The design of the trap box was recommended, and drawings have been provided by FWS staff from Alaska who have used it in similar high flow situations. The trap box must be fabricated locally (within 50-60 Miles) so IFWCO staff can work with contractors on exact needs and so IFWCO staff can design and fabricate a fish chute system that attaches the new trap box to the existing weir panels. This project also needs to be completed in a quick time frame so the weir can be installed and operational by March.
2. DEFINITIONS:
Resistance board weirs consist of several components: 1) a substrate rail that anchors to the bottom of the stream, 2) weir panels that attach to the rail and form the barriers, 3) bulk heads and fixed pickets to prevent fish from passing around either side of the weir, 4) a fish passage chute that allows fish through an opening in one of the panels that goes to a 5) fish trap box that holds the fish. Components 1-3 have already been fabricated and the substrate rail has been installed in the river. The fish passage chute between the panels and the trap box will be built by IFWCO staff at the IFWCO office in conjunction with a local contractor (Jetco Machine and Fabrication) building the trap box. The trap box was designed by
FWS biologists from Alaska who use the box during high stream flows. The box is coffin shaped to help direct debris coming down the river away from the box. The trap box is made from aluminum so it is lighter and easier to move into and out of the stream.
3. SCOPE:
A. The vendor will use the existing design drawings developed for Alaska USFWS staff to fabricate an aluminum trap box. The vendor will be in communication about adjustments needed and allow
FWCO staff to inspect and take measurements in order to build the fish chute.
4. PLACE/DELIVERY AND PERIOD OF PERFORMANCE:
A. IFWCO will pick up the trap box upon completion from the selected vendor within 50-55 miles radius. IFWCO will bring the box to the IFWCO office for final preparations. The box, along with the weir panels, will be installed during March when Ice is off of the Yankee Fork but before high spring flows.
B. The trap box needs to be fabricated by mid-February so FWCO staff can finalize fish chute fabrications at the FWCO office and be ready for the install whenever ice is off the stream.
5. INSPECTION AND ACCEPTANCE:
A. The Trap box will be inspected throughout the fabrication and upon completion.
6. GOVERNMENT FURNISHED EQUIPMENT OR MATERIALS:
A. None is needed.
7. AVAILABILITY:
1. FWCO staff will be available for pick up or inspection of trap box from the selected vendor within 50-55 miles from 8:00 a.m. to 2:00 p.m. during the duration of the build.

(a) Definitions. As used in this clause– Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.
Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).
Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
Safeguarding means measures or controls that are prescribed to protect information systems.
(b) Safeguarding requirements and procedures.
(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.
(v) Identify information system users, processes acting on behalf of users, or devices.
(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.
(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.
(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

DIAR 1452.215-71 USE AND DISCLOSURE OF PROPOSAL INFORMATION --
DEPARTMENT OF THE INTERIOR (APR 1984)
(a) Definitions. For the purposes of this provision and the Freedom of Information Act (5 U.S.C.
552), the following terms shall have the meaning set forth below:
(1) "Trade Secret" means an unpatented, secret, commercially valuable plan, appliance, formula, or process, which is used for making, preparing, compounding, treating or processing articles or materials which are trade commodities.
(2) "Confidential commercial or financial information" means any business information (other than trade secrets) which is exempt from the mandatory disclosure requirement of the Freedom of Information Act, 5 U.S.C. 552. Exemptions from mandatory disclosure which may be applicable to business information contained in proposals include exemption (4), which covers
"commercial and financial information obtained from a person and privileged or confidential," and exemption (9), which covers "geological and geophysical information, including maps, concerning wells."
(b) If the offeror, or its subcontractor(s), believes that the proposal contains trade secrets or confidential commercial or financial information exempt from disclosure under the Freedom of Information Act, (5 U.S.C. 552), the cover page of each copy of the proposal shall be marked with the following legend:
"The information specifically identified on pages ______ of this proposal constitutes trade secrets or confidential commercial and financial information which the offeror believes to be exempt from disclosure under the Freedom of Information Act. The offeror requests that this information not be disclosed to the public, except as may be required by law. The offeror also requests that this information not be used in whole or part by the government for any purpose other than to evaluate the proposal, except that if a contract is awarded to the offeror as a result of or in connection with the submission of the proposal, the Government shall have the right to use the information to the extent provided in the contract."
(c) The offeror shall also specifically identify trade secret information and confidential commercial and financial information on the pages of the proposal on which it appears and shall mark each such page with the following legend:
"This page contains trade secrets or confidential commercial and financial information which the offeror believes to be exempt from disclosure under the Freedom of Information Act and which is subject to the legend contained on the cover page of this proposal."
(d) Information in a proposal identified by an offeror as trade secret information or confidential commercial and financial information shall be used by the Government only for the purpose of evaluating the proposal, except that (i) if a contract is awarded to the offeror as a result of or in connection with submission of the proposal, the Government shall have the right to use the information as provided in the contract, and (ii) if the same information is obtained from another source without restriction it may be used without restriction.
(e) If a request under the Freedom of Information Act seeks access to information in a proposal identified as trade secret information or confidential commercial and financial information, full consideration will be given to the offeror's view that the information constitutes trade secrets or confidential commercial or financial information. The offeror will also be promptly notified of the request and given an opportunity to provide additional evidence and argument in support of its position, unless administratively unfeasible to do so. If it is determined that information claimed by the offeror to be trade secret information or confidential commercial or financial information is not exempt from disclosure under the Freedom of Information Act, the offeror will be notified of this determination prior to disclosure of the information.
(f) The Government assumes no liability for the disclosure or use of information contained in a proposal if not marked in accordance with paragraphs (b) and (c) of this provision. If a request under the Freedom of Information Act is made for information in a proposal not marked in accordance with paragraphs (b) and (c) of this provision, the offeror concerned shall be promptly notified of the request and given an opportunity to provide its position to the Government.
However, failure of an offeror to mark information contained in a proposal as trade secret information or confidential commercial or financial information will be treated by the Government as evidence that the information is not exempt from disclosure under the Freedom of Information Act, absent a showing that the failure to mark was due to unusual or extenuating circumstances, such as a showing that the offeror had intended to mark, but that markings were omitted from the offeror's proposal due to clerical error.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL
PRODUCTS AND COMMERCIAL SERVICES (MAY 2024)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision—
Covered telecommunications equipment or services has the meaning provided in the clause 52.204- 25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
