The U.S. Fish and Wildlife Service, Office of Law Enforcement located at 500 Gold Ave. SW, Room 9021, Albuquerque NM 87102 has a requirement for Storage Cleanout (Transport and Disposal of Wood and Stone), which is located at East Valley Storage, 18250 E. Valley Highway, Kent, WA 98032 (See Paragraph 4, Place and Period of Performance below), in accordance with the following Statement of Work:

Statement of Work

Storage Cleanout (Transport and Disposal of Wood and Stone)

1. General:

The U.S. Department of the Interior’s Indian Arts and Crafts Board (IACB) was established by the Indian Arts and Crafts Act of 1935 to promote the economic development of American Indians and Alaska Natives of federally recognized Indian tribes through the expansion of the Indian arts and crafts market.

The IACB collaborates with enrolled members of U.S. federally recognized Indian tribes, and Alaska Native villages, regional and corporations, to promote Indian art, culture, and history.

The IACB was tasked with the implementation and enforcement of the Indian Arts and Crafts Act (Indian Arts and Crafts Act of 1990, P.L..101-644). The Indian Arts and Crafts Act is a truth-in-advertising statute to protect the authentic marketplace selling traditional and contemporary Native American and Alaska Native art and craft work, while also protecting tribal and cultural heritage, artistic skills, tribal economies, and consumers whose intention is to buy authentic made artwork.

The U.S. Fish and Wildlife Service Office of Law Enforcement (USFWS/OLE) has an investigation unit to enforce the Indian Arts and Crafts Act. As a result, after successful Department of Justice criminal prosecutions and subsequent Judgements, abandoned or forfeited property is disposed of to ensure counterfeit items are removed from the market.

2. Project Purpose:

USFWS/OLE has a large quantity of forfeited/seized property located in one 10 ft x 30 ft storage unit in Kent, WA. The items are counterfeit Alaska Native totem poles and stone carvings that need destruction to prevent re-entry to the market. Items need to be hauled offsite in enclosed trailers or dump trucks to conceal contents from the public during transport. Destruction shall mean running the totem poles through a woodchipper or grinding equipment and crushing the stone carvings. Once the storage unit is empty, disassemble storage racks and transport to a USFWS/OLE office.

2.1 Items include the following:

• Approximately 108 wood totem poles (TPs) varying in length from 26” to 84” (there are no wood pallets in the storage unit as seen in the picture attached).

~ 15 TPs @ 84” with approximately 10” diameter ~ 18 TPs @ 60” with approximately 8” diameter

~ 25 TPs @ 48” with approximately 6” diameter ~ 20 TPs @ 36” with approximately 4” diameter ~ 30 TPs @ 26” with approximately 2-3” diameter

• Approximately 15 wood totem poles, in length from 14” with approximately 1.5" diameter.

• Approximately 55 pairs of wood totem pole wings, varying in length from 12” to 30” by

~1.5” thick.

• Most totem poles are painted on three sides and are made from Swietenia macrophylla (a Mahogany species in the Philippines). Most of the totem poles are wrapped with a mix of cardboard and bubble wrap.

• Stone carvings are mostly made of marble.

• Total estimated weight of all the stone carvings is approximately 15,000 lbs.

• Approximately 500 stone carvings located on metal shelving as seen below. The average carving weight is 30 lbs. per piece, with the largest carvings approximately 200 lbs. per piece.

• Approximately 670 smaller carvings (hand size and smaller) packaged in approximately forty-five 1 ft by 2 ft cardboard boxes. Some bubble wrap is used between carvings.

2.2 After the above wood and stone carvings have been cleared from the storage unit, contractor will disassemble eight (8) Whalen Industrial Racks and transport these to the USFWS /OLE office in Redmond, WA. The racks will pop apart for transport and storage.

3. Contractor’s Qualifications:

3.1 The contractor will:

• Specialize in cleaning out a storage unit.

• Must have the necessary equipment (heavy trucks, heavy duty trailers with covers, woodchipper, rock compactor) to do the job for both the wood and stone products.

• Supply ample employees (estimate a minimum of three) to move / lift the carving items from the storage unit into the trailers for transport.

• Supply any dolly, cart, or ramp necessary to move the stone carvings and wood carvings into trucks and/or trailers.

3.2 The contractor will perform the following work:

• Remove identified items from the storage unit and place in the appropriate truck or trailer.

• Secure and cover the load for transport offsite. Must have a covered trailer to transport the wood totem poles and stone carvings so items are not visible during transport to offsite facility.

• Once offsite, must have the ability to crush the stone carvings either with a compactor or by operating heavy track equipment over the product to pulverize it.

• Once offsite, must pass each wood carving through a woodchipper or similar equipment to shred the items.

• Plan to recycle the wood chips onsite and use the broken stone for erosion control, subbase, or in another capacity to avoid the landfill.

• Dismantle eight (8) shelving units and transport to USFWS/OLE office in Redmond, WA.

4. Place of Performance and Period of Performance:

4.1 Items are located at East Valley Storage, 18250 E. Valley Highway, Kent, WA 98032.

4.2 Shelving units will be transported to the USFWS/OLE office located at 14852 NE 95th Street, Redmond, WA 98052.

4.3 Actions will occur on or about April 17 -18, 2024, during the hours of 6:00 a.m. - 6:00 p.m.

5. Government-Furnished Information

Government personnel will accompany the wood and stone transport to the offsite location to witness destruction and acquire any necessary documentation for official USFWS/OLE records.

Government personnel will be available at the USFWS/OLE office in Redmond, WA to receive the shelving units.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
